Issue: Managing an account

Subissue: Funds not handled or disbursed as instructed

Consumer Complaint: Hello, thank you for trying to help me. On XX/XX/2022, I noticed several fraudulent checks that were withdrawn from my Suntrust checking account, totaling {$4000.00}. After a 60-minute hold with Suntrust 's fraud department, I was able to speak to someone who closed the account, opened a new account, and initiated a fraud investigation. I have not heard anything additional from Suntrust regarding the investigation, and both I and my local branch representative have waited hours on hold with Suntrust 's fraud department without a human ever answering the call. Suntrust states that their policy is to return stolen funds to accounts within 10 days, at least temporarily while the investigation proceeds ; my funds have not been returned to my account, and I am unable to speak to anyone at Suntrust regarding the investigation, as they are impossible to reach, even by their own branch employees. Suntrust is undergoing a merger, but this is no excuse to violate their own policies and to leave customers in this much of a bind, unable to contact anyone at bank in a reasonable amount of time. Please help if you can. Thanks!

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Investigation took more than 30 days

Consumer Complaint: XXXX XXXX/ XXXX Please correct this inaccurate information on my credit report. I recently pulled my credit report from your XXXX and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me 30 days late on this account in XXXX, XXXX, XXXX, XXXX, XXXX As well as 60 days late on this account in XXXX, XXXX As well as 90 days on this account in XXXX, XXXX I immediately disputed this information with REGIONAL ACC and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated below : 1666. Correction of billing errors ( b ) Billing error ( 4 ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. ( 6 ) Failure to transmit the statement required under section 1637 ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than twenty days before the end of the billing cycle for which the statement is required. ( 7 ) Any other error described in regulations of the Bureau. 1666a. Regulation of credit reports ( a ) Reports by creditor on obligor 's failure to pay amount regarded as billing error After receiving a notice from an obligor as provided in section 1666 ( a ) of this title, a creditor or his agent may not directly or indirectly threaten to report to any person adversely on the obligor 's credit rating or credit standing because of the obligor 's failure to pay the amount indicated by the obligor under section 1666 ( a ) ( 2 ) of this title, and such amount may not be reported as delinquent to any third party until the creditor has met the requirements of section 1666 of this title and has allowed the obligor the same number of days ( not less than ten ) thereafter to make payment as is provided under the credit agreement with the obligor for the payment of undisputed amounts. ( b ) Reports by creditor on delinquent amounts in dispute ; notification of obligor of parties notified of delinquency If a creditor receives a further written notice from an obligor that an amount is still in dispute within the time allowed for payment under subsection ( a ) of this section, a creditor may not report to any third party that the amount of the obligor is delinquent because the obligor has failed to pay an amount which he has indicated under section 1666 ( a ) ( 2 ) of this title, unless the creditor also reports that the amount is in dispute and, at the same time, notifies the obligor of the name and address of each party to whom the creditor is reporting information concerning the delinquency. ( c ) Reports by creditor of subsequent resolution of delinquent amounts A creditor shall report any subsequent resolution of any delinquencies reported pursuant to subsection ( b ) to the parties to whom such delinquencies were initially reported. 1666b. Timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years ' worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements, or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). I DEMAND to see proof that I was mailed my statement to the correct address notifying me of both payment due date and delinquency of payment on the account. If you can not provide 100 % Verifiable proof and proper documentation that the CREDITOR fulfilled its obligations under the ( FCBA ) and ( FCRA ), I, therefore, demand these late payments are removed from my account or I will be forced to be in contact with the Attorney General of my State and the Consumer Financial Protection Bureau. I, therefore, am submitting my written request to you to conduct an investigation. Per the FCRA, you have 30 days to conduct this investigation and respond to my request. If you do not respond within this time period, per the FCRA, you must remove this negative information. Thank you for your time, XXXX XXXX XXXX

Consumer Complaint: On XX/XX/XXXX the car loan was Charged off on my account and it reflected that. When the company charged it off I was never sent a 1099C according to the IRS any charged off of debt over {$600.00} the lender must sent the customer a 1099C there for could never file it on my taxes. As of XX/XX/XXXX BB & T the original lender stated I was late on a months car note payment of {$530.00} on an account that had already been charged off back in XXXX. The company also fraudulently forged payment records stating that I have been in good standing with my payments since the loan first originated in XXXX. My credit had been hit hard & Im losing money by this recent fraudulent late payment Delinquency. I would like this BB & T lender removed from my credit profile Expeditiously due to their fraudulent activities and shady business tactics. I also would like this recent late payment taken off of my record as well. According to the FCRA it must be removed. I would like it to be removed on all three credit bureaus on which it is reflecting. I dont understand why a closed account is still reporting and also report fraudulent information. Issue: Closing an account

Subissue: Funds not received from closed account

Consumer Complaint: On XX/XX/2022, I applied for a payday loan through what I thought was XXXX XXXX Bank, at least that's where I was told they were from. The scammers I spoke with gave me false information and stated that they were depositing funds into my account that I would have to pay back via gift card to show a good faith payment. The funds were deposited ( through banking information that I did give out ) via mobile check. The mobile check cleared and I figured it was all a legit bank. I did then purchase the required gift cards to payback and gave the scammers all that information as well. More fake checks were deposited into my account and I had to go through the cycle again. On XXXX, I saw that the first two checks were returned, but was told by the scammers that this was because I didn't do things in a timely manner. I was also threatened at this point and told that I was going to have charges against me and arrested if I didn't continue doing what they told me. On XXXX, I stopped doing what they asked and at this point called the bank to let them know what was going on. Because I had been scammed and had given out all my information, the bank told me that they could not close my account. I had no idea that the checks were fraudulent and that they were being returned by the bank. I truly thought the scammers were pulling the money out of my account. Therefore, I had lost all the money from the gift cards and now my account is negative {$14000.00}. Under the advice of the bank, I was asked to open a new account so my paychecks could be deposited in that account and I could still use that money at least. My old account now sits at {$14000.00} negative, which I am desperately trying to figure out how to amend that, but my new account with a positive balance has now been frozen. I have not been contacted by my bank at all to get any information regarding my case and I now have no idea what else to do. I have filed reports with the FTC, FBI ( internet crime prevention unit ), and the local police department. I am desperately seeking assistance to just have access to my last two paychecks that were deposited, but I also want the public to know that this is a serious scam. I had no idea that " cleared '' The people that scammed me were at first extremely convincing with fake profiles and websites and then became very threatening. I have spent hours and hours and hours on hold with my bank to try and get through to talk with people about my case and I am told that I need to wait for a letter to arrive with their decision in 15 days. Finally, I want the public to know that even if a check clears, it can bounce up to 6 months later and could be returned. I also want the public to know that these scams are out there and to never give out any information no matter what the scammers threaten with. I have submitted all the gift cards and all documentation to my local police department.

Issue: Improper use of your report

Subissue: Credit inquiries on your report that you don't recognize

Consumer Complaint: My complaint is against Suntrust who I believe is now Truist Bank. My complaint is for Suntrust failing to take action to remove an unauthorized credit inquiry on my credit report from Suntrust. On XXXX 2021 I purchased a vehicle from XXXX XXXX. Before making The purchase by without the assistance of XXXX applied and obtained an auto loan using XXXX XXXXXXXX XXXX. While XXXX was processing the paperwork they made a mistake and applied for financing though several banks including Suntrust without my permission. XXXX has sent a certified letter to Suntrust and others explaining this mistake and ask them to contact XXXX to have this hard credit inquiry removed from my credit report. I have also sent a certified letter to Suntrust asking them to contact XXXX to have this inquiry removed because it was not authorized by me and is having a negative affect on my credit report, my loan applications and my acquisition of credit. I have since wrote several letters and made numerous phone calls to Suntrust since these first letters were sent. Suntrust has not responded at all. Each time I call Suntrust Im told the complaint will be forwarded to the Suntrust credit reporting department and Im given a reference number. Every time I call back for an update Im told the previous reference numbers do not bring up a case and I must start the complaint all over again. I have contacted XXXX and Im told I do have the right to have this inquiry removed since it wasnt authorized by me. XXXX also explained to me that ti have this inquiry removed the removal should be requested by the creditor that did the inquiry which is Suntrust. When XXXX made this error applying for loans in my name they applied to several other banks creating many credit inquiries. All of the others with the exception of one have contacted the credit bureaus requesting these inquiries be removed. So far most have been removed with a couple still pending with the credit bureaus. I am requesting Suntrust contacts XXXX Credit Bureau and asks that this credit inquiry be removed from my credit report since it was done in error.
