Consumer Complaint: While trying to refinance my mortgage loan in XX/XX/XXXX, the mortgage originator advised that there was a lien on my property. This was a surprise to me. After researching the issue, I discovered : In XXXX my wife defaulted on a very small credit card debt. The debt was handed over to law firm here in Florida ; XXXX, XXXX and XXXX. According to the court records, this law firm filed suit against my wife in XXXX. My wife does not recall being served. The document filed for proof of service gives an incorrect physical description. Regardless, the firm obtain a default judgement against her. Afterward, they did knowingly file a certified copy of the judgment causing a lien to appear in the public record associated with my property. We filed XXXX in early XXXX, but this was done after the judgment and lien was in place. Neither the judgement nor the lien came to light in the XXXX process. I have three major complaints. 1. By nature, the county recorders website associates my name with the property and therefore the debt and judgment. When searching property records using my name, this debt and judgment that I am not responsible for and did not know about appears. The word lien appears as the category chosen to classify the certified copy of the judgment. It is my understanding that FDCPA prohibits publishing debtor list, especially if the person defamed is not even party to the debt and is just a spouse or relative. 2. Placing a lien on homestead property is contrary to Florida law unless the judgement is derived from a subject matter regarding the property itself. The firm that caused the lien to appear is well aware of this, but proceeded regardless. The attorneys involved are bound by a code of ethics that prohibits misdirected legal pursuits. I will attach this complaint to the bar complaint. They caused a lien to appear on record knowing it was not valid. 3. I have a right to be notified and to participate in any legal proceeding that may result in the seizure of my property or could harm me in any way. This right was violated when the firm continued litigation in secret and intentionally caused a lien to appear in the public record against my property. Ive been denied an opportune to contest the matter in court or to have paid the amount due myself. Last week my wife and I called the firm to clear up the judgement so my mortgage refinance can move forward. The representative failed to properly place the call on hold as they spoke to their manager. We heard the conversation. The manager explained to the phone representative that they could not accept payment from us due to the XXXX XXXX bankruptcy. The representative gave the fdcpa mini maranda anyways. After the representative refused to accept a payment to satisfy the judgment we asked to speak with someone about the lien. The representative hung up the phone. It is clear that intentionally or negligently filing a lien against homestead property for credit card debt while knowing that Florida law does not recognize such a lien is an unfair and deceptive debt collection practice. From my analysis of the public record it is being done en mass by this firm without regard for the rights or reputation of property owners. Without the XXXX in place I would have been compelled to just pay the judgement before closing having been denied the right to contest the debt, respond to the lawsuit or work out any other arrangement. The delay in my mortgage refinance is costing me time and money. I was embarrassed and distraught when the mortgage representative informed me that they needed a signed authorization so they could get a payoff quote for the judgement. My professional reputation was also damaged since I work in the same industry in a capacity that requires a high degree of trust and ethical responsibility. I would have gladly paid the entire balance of given the opportunity. At the moment, I have no way of getting in touch with an attorney at the firm. I can not get through the call vent without an account number. My only option is to hire my own attorney and suffer legal fees to resolve the matter. This will cost sub more than the amount of the original debt.

Consumer Complaint: I believe there has been a mistake in my account billing for Account Number : XXXX, for the auto : XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXXXXXX ). I have a late payment of longer than 30 days in my credit score report. However, when reviewing my account I discontinued automatic payments in XX/XX/XXXX. I made a payment on XX/XX/XXXX that went to the Principal instead of the Monthly Payment. This was an error in billing, I did pay the amount of {$590.00} in XXXX and TD Auto Finance took in the amount to pay for the principal. I consider this fraud. I then on XX/XX/XXXX of XXXX did a double monthly payment of {$1200.00} as I noticed that you had not taken in my XX/XX/XXXX payment towards my monthly payment. I contacted TD Auto Finance Bank multiple times regarding this error by phone before the 6 month limitation in billing changes per their policies took place, but I never received a positive response. We can look at phone recordings to verify. I believe this is a billing error and I should not have a 30 day late payment flag in my credit report since this institution received the monthly amount on time, but failed to bill it as a monthly payment. In reality this institution received 3 payments from me totalling {$1800.00} in the period from XXXX to XXXX and still received a derogatory mark from TD Bank Auto Finance. which I respect, but which made a billing error that cost me a significant drop in my credit score. Please note that I am willing to dispute this at the Credit Bureau level since this is the only bad mark in my credit report, since this is a billing error, not a denial to pay from my side. Consumer Complaint: On XX/XX/XXXX, I logged into the TD Bank online portal to access my Raymour and Flanigan credit card account. On that date, I scheduled two payments : one for {$100.00} due on XX/XX/XXXX, and another for {$100.00} on XX/XX/XXXX. However, on XX/XX/XXXX, upon receiving my physical credit card invoice, I noticed a {$29.00} late fee on the account. Upon logging into my account, I observed that the payment I had set up on XX/XX/XXXX, to cover my XX/XX/XXXX, payment had been canceled. Surprisingly, the payment for XX/XX/XXXX, was still pending on XX/XX/XXXX. In response to the late fee, I contacted customer service. The representative acknowledged that I had scheduled two payments on XX/XX/XXXX, but explained that the system does not allow for two payments to be simultaneously in a " pending '' status. When I set up the payment for XX/XX/XXXX, it automatically canceled my XX/XX/XXXX, payment, leading to a missed payment. Fortunately, the representative was able to reverse the {$29.00} fee. Unfortunately, the situation worsened as TD Bank decided to cut my credit line by XXXX due to this system mishap. Upon inquiry, another department explained that the credit line reduction was a consequence of a late payment on the account. Despite having never made a late payment before, the system 's automatic cancellation led to this unfavorable outcome. To restore my credit line back to {$9000.00}, the representative informed me that they would need to pull my credit again. I find this request unreasonable, considering it stems from a system glitch and involves an individual with a clean payment history on this card and all other credit cards. I have attached a snapshot of the payment status page from their website for your reference. Please review the dates and times of the requests. On XX/XX/XXXX, at XXXX XXXX, I set up a {$100.00} payment. One minute later on the same date, I established another {$100.00} payment scheduled for XX/XX/XXXX. To test my cancellation theory, on XX/XX/XXXX, at XXXX XXXX, I set a payment as a " pay now '' option for {$150.00}. Upon accessing my online account on XX/XX/XXXX, the status of this payment was processed. Subsequently, I made an " on this date payment '' for {$160.00}, dated for XX/XX/XXXX. This set up canceled the previously processed " pay now '' payment. I find this situation deceptive and seek resolution.

Consumer Complaint: During Fall 2022, I mailed XXXX checks to XXXX XXXX XXXX in XXXX, MA. These checks were stolen from the mailbox at the church along with several other congregation members ' checks. This theft was reported to the police, and the individuals responsible have been identified, but I do not believe an arrest was ever made. These checks were made out to XXXX XXXX XXXX from my account at XXXX XXXX in XXXX, MA. They were deposited into and TD Bank ATM, and TD Bank cashed these checks without checking ID and into an account NOT operated by XXXX XXXX XXXX. I have tried for over a year to get XXXX to refund my money, but they tell me that TD Bank is refusing to release the funds despite the fact that they know they are at fault for failing to follow any reasonable procedures to make sure the person cashing the cash was actually the person who the check was made out to.

Yesterday, XX/XX/XXXX, the sum of {$720.00} with XXXX ID # XXXX and the TD Bank processing fee of {$120.00} was debited ( stolen ) from my TD Bank checking account. When I called TD Bank they informed me that this belongs to a garnishment imposed by XXXX XXXX XXXX. This company on XX/XX/XXXX sent me a Notice of Garnishment Dismissal ( See attached letter ) stating that they voluntarily dismissed the garnishment. After that I have not received any new communication from XXXX XXXX XXXX or its attorney so I assume nothing has changed. The money charged is NOT even earned income because I am unemployed. ( please read my previous complaints for a better understanding ). The account was overdrawn once again and I don't understand why my bank admits making these types of charges without the authorization of me as a customer. I repeat, I have not received any new communication from XXXX XXXX XXXX or its attorney. I'm attaching the response from XXXX XXXX to my last complaint and the solution I received by mail.
