Issue: Struggling to pay mortgage

Subissue:

Consumer Complaint: My loan is currently serviced by SLS. They recently issued a notice of default claiming that {$1600.00} was needed to cure the default. This amount was paid to bring the account current. SLS claims that the account is still in default and proceeding with foreclosure action. SLS has not provided any records to prove up up the overall validity of the debt. As defined under Real Estate Settlement Procedures Act ( RESPA ) Fair Debt Collection Practices Act as well as the Fair Debt Collection Practices Act ( FDCPA ), it is required that current creditors hold the necessary documentation granting the authority of servicing rights and all applicable mortgage assignments from one lien holder to the next. These documents have been request in writing by way of a Qualified Written Request ( QWR ). SLS is in violation RESPA and CFPB law for proceeding with foreclosure action on a current loan. Since SLS is ignoring my requests for clarification on this matter, I am seeking your assistance.

Consumer Complaint: On XX/XX/2020 my bank, XXXX XXXX, sent a check for {$16000.00} to pay down our HELOC balance close to XXXX. Specialized Loan Servicing sat on the check, then returned it to me on XX/XX/XXXX, thinking that it was a loan payoff for a traditional mortgage. Two customer service representatives acknowledged the company 's mistake and agreed to a credit of {$150.00} in interest that I should not have paid due to the delay. I have spoken to customer service five times over the last six weeks ( several hours on the phone in total ) and each time they promise to refer my case to a supervisor and call me back. No one has every called me back, and the issue is still unresolved. On XX/XX/XXXX, the customer service representative told me that the HELOC department does not have a supervisor, so there isn't anyone to review the credit request. Please help.

I received a trial period plan agreement from my mortgage company SLS dated XX/XX/XXXX stating they would set me up pre modification in the amount {$1200.00}. Trial Payments -3 and post modification {$960.00} starting XXXX. The letter also indicated that my application was denied because the financial information provided doe not demonstrate the ability to repay- - The application has been denied because we were not able to verify a qualifying hardship I had sent in all the required documents/proof of my grandmothers death certificate as requested. I feel I am being discriminated against as a consumer please look into this issue immediately.

Issue: Struggling to pay mortgage

Subissue:

Consumer Complaint: We filed several loan modification applications after struggling through several hardships, including most recently the Coronavirus pandemic. We are seniors who have had many medical issues ; a XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX. We have lived in this home for years and SLS servicing is tearing us apart. However we have worked hard to keep up on our mortgage. We have submitted several loan modification applications over the last 3 years. Each time we are told they are incomplete. ON XX/XX/XXXX we submitted a new application with all of our income., with proof of income exceeding $ XXXX/month. IN early XXXX approximately XX/XX/XXXX, we receveid notification from SLS servicing that they had received a complete package from us, no more documentation was needed and that a decision on a modification would be forthcoming. We then received a letter dated XXXX XX/XX/XXXX that our modification application was denied, and that XXXX $ was used as our income. The enclosed 12 page attachment shows the income was documented and proof of income. How SLS has the audacity to make a decision to deny seniors based on " XXXX income '' is outrageous, abusive and fraudulent. How dare SLS deny us, with incorrect information, stating just 2 weeks before that they had all of our income information which exceeds $ XXXXmonth. This is a pattern and practice that SLS has repeated for years and we would like the CFPB to take action.
