Consumer Complaint: I've been paying this mortgage since 2004 my principal balance is not went down I started out with option one and The Man Who Sold me the house and the underwriter went to federal prison for fraud by real estate. I have received a hemat loan and alone modification with balloon payments and my principal balance keeps going up like I've never made a payment they have transferred my mortgage to five different sister companies they have broken the Fair Debt credit Act by stating that I was in foreclosure and was only 15 days late they have accessed me NSF FEES and late fees which were from XXXX XXXX where I did have enough money in my account but due to the overdraft fees in regards to my online banking which made me short but was maybe {$2.00} sometimes {$12.00} short and XXXX XXXX accept me overdraft fees which made me over drafted and is currently in a class civil action suit which I am in today I want the predatory lending to stop on NSF fees and late fees taken off and my principal balance the show all the money that I paid over the years I have documentation

Consumer Complaint: I was approved for the homeowners assistance program in XX/XX/XXXX and have been receiving payments since then. My mortgage company was recently sold to Shellpoint and I am missing mortgage payments that HAF has said they have sent to Shellpoint. I am given no answers when I call and talk to Shellpoint and I am in fear of losing my home. I need answers as to where my missing payments are. My mortgage payment was due on XX/XX/XXXX and HAF informed me that they sent the payment of XXXX on XX/XX/XXXX. Shellpoint can not locate the payment and will not apply it to my account.

They kept saying I already had insurance available then afterwards tells me they didnt pay my insurance and I didnt have any home insurance. Then they kept messing up my escrow account going from positive to negative and Im unable to pay my home insurance and they continue to charge me and will not provide a refund or contact me. Consumer Complaint: Hello, I have issues with Shellpoint company. During my forbearance repayment plan, there was miscommunication. I did not miss my XXXX payment, as the due date coincided with weekend I sent my payment XXXX XXXX which was intended for XXXX. I explained this in my previous messages but they never gave any reference to my attached receipts, they just ignored my request. According to the forbearance plan which was given to me to follow, I didnt miss any payment as they claim.please see the attachment names as receipt. I believe you have the substantial amount of evidence to state that I have already finished my payments in time. It is their mistake not to take into account that. The third payment should have been considered to be XXXX payment not XXXX. Due to this misunderstanding I got Derogatory Account and delinquent account. ( Page 4 ) Because of this issue I got XXXX problems. XXXX of them is about my credit history, the other XXXX XXXX my PMI request was rejected and I had to pay it in XXXX. Consumer Complaint: Shellpoint keeps playing games and has not shown where they applied XXXX partial payments I made to my mortgage last year. These amount were XXXX each. They received XXXX funds and applied full amounts from XXXX XXXX XXXX of the partial payments. When I have asked them to rectify this they claim they took the XXXX partial payment and added them to the XXXX total and then paid out other months. No proof and nothing reflects this. XXXX shellpoint agree with state of maryland ot bring loan current. They received funds XX/XX/2023 and then attempted to still bill me fully for that month which is not what they agree to state of maryland. so there is XXXX give or take that they need to credit me. Addtionally they PROMISED the state of maryland XXXX dept that they would not raise my interest rate and would work on lowering monthly payments. instead they drastically raised my rate a huge amount.

Consumer Complaint: Newrez/Shellpoint has reported my mortgage delinquent to all three credit bureau agencies . This reporting is inaccurate I called the mortgage company to Inquire what they had and they insisted that my payments are up to date and on their end they have not reported my mortgage account as delinquent yet this does not align with my credit report. They are refusing to do anything about this and I pay my mortgage every month. I am highly upset this is a e ethical and fraudulent. I am requesting that they remove these incorrect delinquent reports from my credit report ASAP.

Consumer Complaint: My mortgage was sold to a servicing company approximately 3- 5 years ago, In XXXX of XXXX I was asked to provide proof of homeowners insurance which I did. First I had to prove I had my own HOA insurance and then I had to provide the XXXX 's insurance. Meanwhile the servicer went and purchased insurance on my behalf. I have received letters from the escrow dept saying that I have satisfied their request. In spite of this every month My account shows that I still have an escrow balance. I have been unable to make my payments on line for 10 months. I call it in and sometimes they apply it other times they take the payment but leave it unapplied. This results in my accounts showing delinquency and late charges. I have been getting letters stating that I can lose my home ( for being 30 days late when I'm not ) even though I have made the payments As a senior I feel that I am being harassed I am so stressed each month. I desperately need help

Consumer Complaint: I keep getting notices from my mortgage company that I dont have an XXXX policy, which I do. I verified on my account via their website that they know who my insurer is. At my first notice, I contacted my insurer and stayed on the phone with them as they faxed my mortgage company my policy. At that time, I also verified that they had the correct contact info, loan number, etc. They already had that information and their system auto sends that to the mortgage company, but either way, it was faxed that day. Second notice : I called the mortgage company to ask why I was getting notices. They responded that the notice wasnt for my XXXX policy, but for the condo associations master policy that they had since received and no further action was required. At this time, I also verified that they had received the XXXX policy, which they had. Third notice notified me that the mortgage company was going to purchase an XXXX policy since mine had expired and that they would charge me for it and that it would cost me more money. This has occurred over several months. I can not resolve this on my own. Their customer service says one thing, then I receive notices that Im non compliant in the mail. I need help. Consumer Complaint: Shellpoint Mortgage reported my mortgage past due during the Pandemic. in XXXX from XXXX - XXXX and in XXXX in XXXX - XXXX. Per the following law - 15 U.S. Code 1681s2 - Responsibilities of furnishers of information to consumer reporting agencies a ) Duty of furnishers of information to provide accurate information ( 1 ) Prohibition ( A ) Reporting information with actual knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. ( B ) Reporting information after notice and confirmation of errors A person shall not furnish information relating to a consumer to any consumer reporting agency if ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate; and ( ii ) the information is, in fact, inaccurate. ( C ) No address requirement A person who clearly and conspicuously specifies to the consumer an address for notices referred to in subparagraph ( B ) shall not be subject to subparagraph ( A ) ; however, nothing in subparagraph ( B ) shall require a person to specify such an address. ( D ) Definition For purposes of subparagraph ( A ), the term reasonable cause to believe that the information is inaccurate means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of the information. ( E ) Rehabilitation of private education loans ( i ) In general Notwithstanding any other provision of this section, a consumer may request a financial institution to remove from a consumer report a reported default regarding a private education loan, and such information shall not be considered inaccurate, if ( I ) the financial institution chooses to offer a loan rehabilitation program which includes, without limitation, a requirement of the consumer to make consecutive on-time monthly payments in a number that demonstrates, in the assessment of the financial institution offering the loan rehabilitation program, a renewed ability and willingness to repay the loan ; and ( II ) the requirements of the loan rehabilitation program described in subclause ( I ) are successfully met. ( ii ) Banking agencies ( I ) In general If a financial institution is supervised by a Federal banking agency, the financial institution shall seek written approval concerning the terms and conditions of the loan rehabilitation program described in clause ( i ) from the appropriate Federal banking agency. ( II ) Feedback An appropriate Federal banking agency shall provide feedback to a financial institution within 120 days of a request for approval under subclause ( I ). ( iii ) Limitation ( I ) In general A consumer may obtain the benefits available under this subsection with respect to rehabilitating a loan only 1 time per loan. ( II ) Rule of construction Nothing in this subparagraph may be construed to require a financial institution to offer a loan rehabilitation program or to remove any reported default from a consumer report as a consideration of a loan rehabilitation program, except as described in clause ( i ). ( iv ) Definitions For purposes of this subparagraph ( I ) the term appropriate Federal banking agency has the meaning given the term in section 1813 of title 12 ; and ( II ) the term private education loan has the meaning given the term in section 1650 ( a ) of this title. ( F ) Reporting information during COVID19 pandemic ( i ) Definitions In this subsection : ( I ) Accommodation The term accommodation includes an agreement to defer 1 or more payments, make a partial payment, forbear any delinquent amounts, modify a loan or contract, or any other assistance or relief granted to a consumer who is affected by the coronavirus disease XXXX ( COVID19 ) pandemic during the covered period. ( II ) Covered period The term covered period means the period beginning on XX/XX/XXXX and ending on the later of ( aa ) 120 days after XX/XX/XXXX ; or ( bb ) 120 days after the date on which the national emergency concerning the novel coronavirus XXXX ( XXXX ) outbreak declared by the President on XX/XX/XXXX under the National Emergencies Act ( 50 U.S.C. 1601 et seq. ) terminates. ( ii ) Reporting Except as provided in clause ( iii ), if a furnisher makes an accommodation with respect to 1 or more payments on a credit obligation or account of a consumer, and the consumer makes the payments or is not required to make 1 or more payments pursuant to the accommodation, the furnisher shall ( I ) report the credit obligation or account as current; or ( II ) if the credit obligation or account was delinquent before the accommodation ( aa ) maintain the delinquent status during the period in which the accommodation is in effect; and ( bb ) if the consumer brings the credit obligation or account current during the period described in item ( aa ), report the credit obligation or account as current.
