Consumer Complaint: To Whom It May Concern : I am writing this complaint letter due to the discriminatory treatment I have received while going through the modification process for this loan. I am a XXXX female living in a majority minority census tract in XXXX, GA. During this modification process, the acts of the servicer ( Select Portfolio Servicing, Inc. ) and investor ( XXXX XXXX XXXXXXXX XXXX have been unfair and deceptive as they will not take a payment from me and have asked for the same information several times and refuse to move the process along despite my providing the requested information each time requested. This has resulted in negative credit reporting, making it even harder to complete the modification. The credit terms of the original loan were predatory and was made prior to the implementation of the Dodd Frank Act. I am requesting that the loan be modified and the servicing practices of the servicer and investor be reviewed and addressed with formal action to mitigate any further discriminatory and unfair practices. I am desperately trying to modify this loan and/or make a payment to ensure I do not lose this home due to foreclosure. The negative credit reporting, due to no fault of my own, is driving down my credit score making it impossible to access credit in the future. I have owned this home for close to 20 years and I am being discriminated against because I am a female living in a XXXX neighborhood. Again, I am requesting that the loan be modified and the servicing practices of the servicer and investor be reviewed and addressed with formal action to mitigate any further discriminatory and unfair practices. I have never been late, however, Select Portfolio Servicing continually violate my civil rights by unnecessary harassment and lies, among other violations of my civil rights. I have a paper trail of deceit from Select Portfolio Servicing. And I also have my own paper trail, that will prove their deceitful practices.

Consumer Complaint: Fact we obtained a ( Residential Mortgage Backed Securitized Loan ) with XXXX XXXX Bank XXXX, XXXX XXXXXXXX XXXX was closed by the XXXX, and FDIC became the Receiver, XXXX XXXX XXXX XXXX became the Servicer, after the FDIC became Receiver XXXX, the next day XXXX, the Parent Company of XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ) filed bankruptcy, ( Case # XXXX ) and part of the reorganization the XXXX Liquidation, Canceled or Extinguished all Securitized bonds, and reissued Stocks, per United States of Security Exchange Commission Quarterly report dated XXXX. After XXXX filed the Bankruptcy Case, XXXX, XXXX, the FDIC in its corporate capacity ( XXXX ), and the Receiver became involved in several lawsuits contesting the ownership of over {$20.00} XXXX in assets. The parties reached a settlement in the Bankruptcy Case that was approved by the FDIC 's Board of Directors on XX/XX/XXXX, and XXXX filed a plan of reorganization incorporating the terms of the settlement ( " XXXX Bankruptcy Settlement '' ). Several parties objected to XXXX 's proposed plan, in particular, XXXX 's proposal to release its claims against XXXX, FDIC-C, and the Receiver. At the request of XXXX 's equity holders, the Bankruptcy Court appointed an examiner to thoroughly investigate XXXX 's claims against XXXX, FDIC-C, and the Receiver, and determine whether the proposed settlement ( which would release these claims ) was fair and equitable to XXXX. The examiner found that the XXXX Bankruptcy Settlement was a fair resolution. As a matter of fact, some years earlier, he nearly died in the hospital there for lack of proper treatment, and was sent by plane to a hospital in XXXX Alabama. Consumer Complaint: I purchased a home as a rental property in XX/XX/XXXX. I set up automatic payments ( ACH ) with the lender upon purchase. The loan was transferred in XX/XX/XXXX to Select Portfolio Servicing ( SPS ) Company. During the transfer, the ACH payment was not collected. SPS did not notify me of this oversight until XX/XX/XXXX. I set up a payment plan in XX/XX/XXXX to correct the missed payment due to SPS 's error upon loan transfer. I have paid off the missing payment, yet SPS raised my interest rate to 20 % on XX/XX/XXXX because they state the payment is missing. They will not accept that I have corrected their error. The Ombudsman will not accept that I have corrected their error. I refuse to accept the 20 % interest rate and I have not paid that amount.

Consumer Complaint: I asked SPS if they could provide me with the Note and Deed Holder and who this owner of my Note and Deed is on my property located at XXXX XXXX XXXX XXXX, XXXX WA XXXX. Instead they provided a DEED to a different property therefore, have NOT provided me with the requested documents on XX/XX/2023 CFPB claim # XXXX. I just received SPS 's response in the mail today and yet CFPB closed my case so I am having to submit again. Until I have actually received this requested information please DO NOT close my claim. I also would like all Assignments, Allonges, owner and holder of my Note and Deeds ' Ledger of accounting showing my alleged debt on their books, showing who paid what for my loan, when, where up to current calculations since the inception of this loan. To date, I have not received this information, let alone a Note and Deed pertaining to my property which I have given the loan number for. Instead I received documents on a completely different address/property! Yet, SPS claims they have provided sufficient information?

Consumer Complaint: I am a good customer. No late payments, no issues. I called XX/XX/XXXX to pay my XX/XX/XXXX mortgage payment of {$1300.00}. I received no notice of an increase. It is a fixed mortgage. I've lived here for XXXX years. Mortgage payments should be getting smaller, not larger. On XX/XX/XXXX, Select Portfolio Servicing informed me that my payment is now {$1500.00} - an increase of {$200.00} per month. I asked why, and after speaking with XXXX levels of support and spending the entire day trying to get to the bottom of this, a supervisor finally explained : XXXX. My taxes increased by {$180.00} for the year XXXX. My insurance increased by {$450.00} for the year ( which has since been corrected. I called my insurance company & that was a mistake. My insurance is actually lower than it was ) XXXX. That's a total of {$640.00} in increased escrow for the next XXXX months. Last year, my escrow increased by {$420.00} & I paid it in a lump sum to avoid increasing my monthly mortgage payment. I told SPS I would do the same with the {$640.00}. XXXX. SPS said they were charging me {$640.00} PLUS and additional {$1100.00} for extra CUSHION, just in case!

I also left two voice messages with the escalation department with no return call asking for a status on the loan modification and suppression of credit reporting. I followed up with emails in addition to speaking with loss mitigation. The most recent request in lieu of a loan modification, I inquired about the Cares Act Forbearance as I had not taken a deferment with them.
