I have participated in foreclosure mediation a year ago. The process was a sham. I have a XXXX in XXXX and XXXX in XXXX XXXX. I took the training for XXXX and observed the process of creating XXXX program and was not allowed in but a student of mine was. I knew that would happen, based on the nature of the mediation system lacking in cultural diversity. It is to much to go into here but to sum it up, banks rule the process and everyone has dance to the tune the Banks play. I found that this new CFPB is the final remaining thing I can do to try and save my home. My interest rate has been 8.99 % since XX/XX/XXXX and even though I have requested relief over the years from this inflated interest rate nothing has been done to provide a fair interest rate at a time when interest rates are a historic low. I lost a lot during the economic downturn, my ex wife died, I became a single parent. I had a XXXX XX/XX/XXXX. I got a on call job at XXXX as XXXX. I am trying to keep my XXXX going which I have had for 15 years. I have worked throughout the world XXXX in the field of XXXX. I am requesting assistance in remaining in my home. I am a XXXX year old XXXX man and it was difficult getting to this point. But here I am with a XXXX year old daughter and dog, and we are able to make it in XXXX after 25 years here I have support system. If I can get a fair loan modification with a fixed Interest rate I should be able to avoid foreclosure. I have tried to submit requested documentation via XXXX as told to and I keep getting the same documentation over and over requesting something I had submitted before. I think it is not a good process how they can just deceptively correpond and drag out my time before foreclosure sale date. I am requesting assistance from the CFPB. They are requesting what a tax request form, a social security award letter my taxes all have been sent in addition to the application for HAMPP modification with all supporting documentation regarding paystubs, bank statements, hardship letter, rental agreements. I am at the end of the line here. I am happy I found this new office of CFPB.

Consumer Complaint: I have a lawsuit against SPS Inc. ( Select Portfolio Servicing ) for predatory lending, I have been trying to get a fair loan modification and have been unsuccessful. In XX/XX/XXXX I submitted XXXX requests for loan modification TO SPS and was turned down each time. Then I hired an attorney who found fraudulent conduct on the part of XXXX ( original lender ), XXXX and SPS ( who now services the loan. When my lawyer filed the lawsuit, I suddenly received a trial loan modification from SPS, but it was very vague and was not a good deal. And I refused it. I had already suffered at the hands of XXXX with many lies and fraudulent behavior. In XX/XX/XXXX I was in foreclosure and XXXX told me if I could start making payments each month plus extra to catch up my past due payments, I would be okay. In a 5 month period I paid XXXX {$17000.00}. On the 6th month when I went in to make my payment, I was told they could not accept my payment because I was in foreclosure. I was in total shock! From that point on I did not trust anything they told me. Then my loan was " sold '' to SPS. When I called they said they were servicing the loan for XXXX. I did not accept the SPS modification as I did not trust them. There was nothing guaranteeing they would adjust my interest or principal. There were all kinds of late fees, etc added onto my loan balance. SPS. I was paying a lawyer every month to work this out for me ... but to no avail. My house is now scheduled for Trustee Sale on XX/XX/XXXX. I DO NOT want to lose my home. I am at a loss and do n't know what to do. PLEASE HELP ME!

Consumer Complaint: On XX/XX/XXXX I rescinded a loan " modification '' that was done by XXXX XXXX that was really a cashout refinance, because XXXX paid off my former first mortgage that was with XXXX XXXX without my knowledge or consent, and included these funds in the modification without disclosing it in any way. The loan has since been transferred to Select Portfolio Services, and I have filed numerous complaints against SPS, as well as a complaint against XXXX, which has not been answered yet. The modification was done in XX/XX/XXXX, which is well within the 3 year recision time allowed since there was no documentation of the additional funds ( no XXXX Statement or anything ) and no right of rescision given to me since it was a cashout refinance and not a straight modification, and I sent notice of rescision on XX/XX/XXXX. SPS refused to rescind the loan claiming there was no record of XXXX being paid off. I have ordered a copy of the wire transfer from XXXX to XXXX, which I will forward to the CFPB as soon as I receive it, as well as the payoff letter with XXXX 's fax number on it. The payoff request was done by phone on XXXX 's automated system, or I would also get a copy of the payoff request. SPS has done no research into the payoff to XXXX, which they should have full access to as the servicer of the loan, but has only kept claiming that there were no funds to XXXX.

Consumer Complaint: My loan has been in some sort of weird status for over 7 years. There are several issues here. One, in dealing with SPS, they have claimed to be 'working ' with me for many years, however no matter how many documents I send to them they respond by saying they always need more documents, even the ones I have sent repeatedly, and it goes nowhere. The main problem is the loan itself, and how I can go about disputing the entire loan. If I can not work out this issue, where they constantly call saying I am deliquent, or saying they have turned it over to a lawyer, or that I am facing foreclosure or I need to sign short sale paperwork, then I need to fight back against them.

My wife and I are attempting to get a loan modification on our mortgage. We completed a trial modification and made all payments on time. When they sent us a final offer, it included the principle balance which was {$360000.00} plus an {$80000.00} balloon payment that covers interest that accrued when I was unemployed. The house is currently worth {$300.00}. I told them that we would accept an offer to pay {$360000.00} with no balloon payment. I believe this is fair as it is XXXX % above market value.
