Another employee intercepted the call and would not put my request forward. She informed me that my XXXX application was incomplete. I informed that that was impossible since I was approved for a short sell months ago. In fact, I was calling in order to up date SPS on the short sell activity. After waiting 19 minutes XXXX XXXX XXXX came on the phone. She as well spoke in a disjointed manner is haste before viewing and assessing the situation. She stated the previous employee is correct you need to provide more information. Information for what I said, I completed the XXXX application months go. She relied you need to provide more information on the short sale. The previous contact said nothing about the short sale nor did XXXX until I brought it into the conversation.. The continuity of picking up from the previous communication and rude arrogance of the phone contacts is deplorable. Please intervene and help. Sincerely, XXXX XXXX

Consumer Complaint: Dear Representative, As indicated below, my credit score recently took a XXXX point hit due to a false report by Select Portfolio Servicing, a Utah-based mortgage company. SPS failed to complete a simple autodraft, which none of my other mortgage companies had any problem completing after I suffered identity theft due to a stolen cell phone. SPS had no problem drafting payment in XXXX 2016 but in XXXX of 2016, when I was was out of the country on a fellowship working on refugee issues, they failed to draft my XXXX mortgage payment. I did n't make it back to my home of record until early XXXX and did not receive any notice that any problem existed until XXXX XXXX, 2016. SPS failed to advise me of the issue with the autodraft until the following month. The day I learned of the issue I called them and paid by phone on the same day ( which was less than 30 days after the regular payment date for the mortgage ). During the call, the SPS representative assured me there would be no adverse impact on my credit score and no reports would go out to agencies. A few weeks ago, I logged into my XXXX website, which offers credit score monitoring, and noticed my credit score had dropped nearly XXXX points. I called immediately and learned the sole cause of this was the false report by SPS ; which the SPS representative assured me would not happen when I made the payment by phone on XXXX XXXX, 2016. I want my credit score returned immediately to its prior level of XXXX to XXXX. Fair is fair. This was SPS 's error. I can accept that they made a mistake but there is no justification for deceit. Particularly against a person who has not missed a payment on the mortgage for this property since I bought it over a decade ago. I made payments every month on my property, without fail, while people around me were declaring bankruptcy. I do n't do that. Now, because some slimy person stole my phone and accessed the former autodraft account for my mortgages, I had to change autodraft accounts. SPS was notified of the new payment account at the same time my other mortgage companies ( XXXX XXXX and XXXX ) were. Yet only SPS failed to update the autodraft account in a timely manner. Moreover, SPS failed not notify me of the problem in a timely manner, took my payment by phone the same day I was notified within 25 days of the due date, assured me there was no issue and no adverse reports would go out to any credit agency, and then betrayed my trust and made a false report which damaged my credit score, financial credibility, and reputation. When I asked them to remedy the issue, they were rude, inflexible, and immune to logic. Never mind I 've never missed a payment in the decade I 've owned the property. Never mind the fact that they failed to complete the autodraft after having no problem drafting the payment the previous month and indicating that the draft would occur. Never mind the fact that I was out of the country and had no notice of the issue. Never mind that the day I learned of the issue, I made payment by phone and was assured there would be no report to credit reporting agencies. Never mind that as payment was not late until the XXXX according to their own representative, and I made payment by phone on the XXXX of the following month, the payment was in no way 30 days late. Never mind the fact that the only reason I had to change autodraft accounts many months earlier was because my cell phone was stolen and banking information was compromised. SPS, to whom my mortgage was sold, and with whom I never had privity of contract, took joy in trying to unjustly destroy my credit. That is simply unconscionable. I 've given them the opportunity to make it right. Instead they have been completely unreasonable.

Consumer Complaint: This is a follow up dispute in response to the companies response to complaint # XXXX The first thing I want to bring up is that in my discussions with SPS over the past 3 years, I have been told the same thing that " we are in the process of rescinding the sale/foreclosure '' or that the foreclosure '' NEVER was completed ''. So that is nothing new. Secondly, their response does not address the damage to the property that occurred under their control, and as a result of said damage, combined with the market, the value is much less than the XXXX deal offered in their reply. The property was sold at foreclosure for {$110000.00}. They also fail to acknowledge the fact that, until they restore the property to my name I CAN NOT/WILL NOT sign any legal documents relating to the property

Consumer Complaint: After years loan modification has damaged our credit, we have been stressed out, and we got XXXX time trail modification. We paid XXXX XXXX XXXX modification from XX/XX/XXXX- through XX/XX/XXXX with all hope and Affordability modification but after all payment SELECT PORTFOLIO SERVICING INC collected approximately {$34000.00}. We have not received affordable modification and, we believed they are violated the California law because they collected the money after 5 years expired statue limitation, my Account due date start XX/XX/XXXX. We did not receive an offer for the modification ; They did not increase the term, did not forgiveness,, did not principal reduction, and did not lower any payments. The SPS collected the money after California statue expired we have requested again after one year we received a new trial modification on XX/XX/XXXX and we have have to pay 3 month trail modification again, they will not increase the term, not give us forgiveness, not give us a principal reduction, or give us lower payments. Select portfolio servicing collect the money by new trick and never reduce the Affordability modification.

Consumer Complaint: My mortgage servicing company, Select Portfolio Servicing, received my payment on XXXX XXXX, 2016 electronically from my bank. Funds were applied to my conventional mortgage on XXXX XXXX, 2016 XXXX day after electronic receipt, although they were applied incorrectly. The payment submitted was {$28000.00}, of which {$3200.00} was for the regular payment and the remainder for principal reduction ; for this it was noted as " other payment '' on their web site, the only option available. The payment applied was {$3200.00} for the scheduled payment and {$5000.00} in principal reduction ; the remaining {$20000.00} was noted in the payment since it was a single electronic payment but the amount does not show in the accounting of the mortgage. In particular, the mortgage principal shows a reduction of {$5000.00} only. Several calls have been made, with the most recent saying it will take XXXX5 business days to apply this ; unfortunately, this is contrary to Federal law requiring payments be applied on the day received. Their mishandling has incurred extra interest charges since the principal was not reduced. Additionally, they changed the next payment date, apparently with a policy to pay up to two months ahead with extra payments instead of applying to principal ; this was not provided in any documents or truth in lending, and results in the customer paying higher interest for the loan which is disturbing when Select Portfolio Servicing , Inc. already maintains an escrow account with has more than a months payment in it.

I signed a Loan modification agreement with XXXX XXXX XXXX XXXX with the first date of lien on XXXX XXXX, XXXX and the modification of the mortgage effective XXXX XXXX, XXXX ; this document was signed by XXXX. I had to file for Chapter XXXX on XXXX/XXXX/XXXX with a release date on XXXX/XXXX/XXXX. My mortgage payments have been going to the servicer XXXX for U.S. Bank and I have asked to refinance or recast the balance. XXXX said they are not a bank and are not able to refinance the loan. I have written to U.S. Bank Corporate office to discuss the the aforementioned HAMP recast and other perks and have not heard back.

Consumer Complaint: My mortage was sold from XXXX to SPS Servicing in XXXX XXXX. The original mortage was done in XXXX and at that time the escrow only included the taxes and I the homeowner always paid the insurance out of my own pocket. Well 12 years after the original mortage this new company SPS decided to pay my insurance company even though the declarations pages clearly state Insured pays this is not a demand for payment, they raised my payment. When I contacted them they and told them the issue, they stated the had the right of escrow. In the meantime my insurance company refunded me the mortage company payment and I called the mortage company and made a lump sum payment of {$2300.00} to my escrow account for their mistake and to cover the " shortage '', but my payment was never adjusted and the are still wanting me to pay the insurance amounts and also my insurance company is still debiting my account for the money too. I have tried numerous times to get this issue resolved and I never get any response other than they have the right to escrow.. I am now facing foreclosure because I am not making the full payment because in reality I do not owe what they stated and my escrow account actually has a credit amount in it, but they are still saying I owe back escrow payments but in reality I do not because my payment was never adjusted to reflect the lump sum payment I had already made. I have been dealing with this for almost 16 months now and they still continue to not evaluate my escrow, and now I recently switched insurance companies and they did it again where they paid the insurance when they received a declaration page clearly stating Insured pays. Also, the new insurance dropped approximately {$100.00} a month in cost, but the payment does not reflect this drop in rates and still say I owe {$300.00} in escrow a month when the math does n't add up and if I did pay them what they say I owe eventually they would owe me money. I am not a legal expert but this in my opinion is mortage fraud and is causing me much heartache over something that is the company 's fault and lack of understanding or ability to do simple math.

Consumer Complaint: I would like file a complaint against SPS and XXXX. We have been going back and forth with both banks since XXXX 2016 to gain approval for the short sale of our home. We have a qualified buyer willing to pay full asking price for our home and we have yet to hear back from them. They are requesting multiple forms of the same paperwork, dragging their feet and delaying the process. We have done everything on our end to ensure the home does not go into foreclosure by getting any and all requested paperwork in in a timely manner and will be filing a request for mediation to avoid going to foreclosure.

Consumer Complaint: I am working on a short sale through HAFA short sale program. The loan servicer has a very inflated value for the subject home. The buyer paid for a full appraisal to dispute the short sale lenders value. The short sale lender is NOT taking the buyers appraisal into consideration due to the status of the comparable - some comps are bank owned or in some form of financial distress / since the subject is a short sale - I feel that these comparable homes are suitable.
