Consumer Complaint: We lost our job between XX/XX/XXXX - XX/XX/XXXX. Immediately then mortgage company Select Portfolio Servicing was informed. After finding new jobs we applied for Request for Mortgage Assistance/Loan Modification. We were considered for modification on XX/XX/XXXX. Since then it became vicious cycle. Relationship Manager XXXX/XXXX was assigned to us, who could never be reached for last 9 months. Their contact information # XXXX Ext XXXX took us to a pool of representatives. Over 9 months we spoke to more than XXXX different representatives ( never got the same one ) to bring closure to the Request for Mortgage Assistance. I would request CFPB to call the above phone number as mentioned in Select Portfolio Servicing to validate our claim. Every representative has different opinion on the query. Each time they had to go through the entire case file. There was n't one Relationship Manager assigned, whom we could communicate though the letters from Select Portfolio Servicing indicated one point contact. Throughout the process we were misled, despite our genuine, relentless hard work to resolve the matter with maximum turnaround time of 24 hours from our side. We are trying very hard to pay-off the delinquent debt in an amicable manner through Loan Modification or Payment Plan, so that we are back on track. Since XX/XX/XXXX we provided all the required documents 4 to 5 times ; Tax Documents, Latest salary, Expenses, Income, Letter of Hardship, RMA form, employment verification, kept receiving several confirmation letters from SPS Portfolio Servicing that they have received all our documents. It was shocking that along with that SPS Portfolio Servicing also kept asking same information again and again on a pretext that they can not find documents ( There is a possibility of computer issue ). We fail to understand how SPS Servicing can confirm the receipt of documents and concurrently can not find documents. Last nine months this vicious cycle of communication went on and on and we kept calling and providing necessary document. It is evident SPS Servicing information gathering system has issues. Despite all our efforts SPS Portfolio Servicing files complaint for foreclosure to the court. XX/XX/XXXX our loan was transferred to XXXX, After relentlessly working with Select Portfolio Servicing for past 9 months, we escalated the issue to Select Portfolio Servicing Complaint Department and finally our file was marked as completed within 48 hours on XX/XX/XXXX. Now the same issue started with Shellpointe mortgage. Already 2 weeks have passed I have placed few calls described below : First week of XXXX - I was told my loan is not yet in the system XX/XX/XXXX, they did not have any status on my modification. Informed me about assigning a point contact XXXX @ ext : XXXX and he will contact me within 24 hrs. No one contacted me as promised XX/XX/XXXX, I called since no one called me back and left message with XXXX at ext XXXX. I also told the same thing within 24 hrs someone will contact me and no one did. Twenty days have passed and I do not know the status of my file with XXXX Mortgage. I am scare of loosing my home though currently I am making good money and wanted to get back in track.

Consumer Complaint: Thanks for your response and update regarding Select Portfolio Servicing ( SPS ), my servicing company. I really tried to modify this loan but SPS is difficult in assisting me. They promised to help me with a modification but they have not kept their word. The fact of the matter is I loss my job through no fault of mine. I have XXXX XXXX and I am XXXX years old. I have been experiencing more challenges to find a decent paying job versus when I was younger with less qualification. I even contacted my Congress Woman and she has been diligent in seeking assistance! I have always taken my responsibilities seriously especially my mortgage to name one. The reason I am behind these payments is because I loss my job on XXXX occasions. SPS accepted my unemployment and said they will work to modify my loan when I found a job, they did not indicate the pay range that will be contingent on my modification. They denied last year due to the debt to income ratio but it they modify to make the payment affordable the ratio will adjust. It was about making home affordable last year. I have been working as of last year and making my mortgage payments but they instantly came to me to cure the loan of approx. {$11000.00} plus, granted I am scheduling mortgage payment as much as 3 in advance. Regarding the modification I sent the corrections they requested per your letter and as of now they have all documentations per their requests. The last request was a clarification if I am going to submit taxes for XX/XX/XXXX. Why will I evade my taxes when I have been consistent!! I sent XX/XX/XXXX and XX/XX/XXXX taxes since last month. I called to affirm their clarification. According to them as of XX/XX/XXXX they have all the requirements. They are threatening to take legal action as of XX/XX/XXXX if I do not cure the default amount. I have not received the letter yet but the rep. read that to me Please help me, I do n't want to lose my home!! There has to be light at the end of the tunnel!! Thanks! XXXX

I know we are being overcharged, Since XXXX every year, the Mortgage has increase. We have A fixed Interest Rate. The reason was Taxes and Insurance Increase every year. I disagree! I can prove that we are being overcharged. Probably since Select Portfolio had Mortgage. I Contacted them in XXXX XXXX. When we receive A Letter that our Mortgage was increasing again. I told them and put it in Writing, we will pay our own Escrow. As of XXXX XXXX. And that 's what we have done. Now XXXX XXXX. They trying to say we owe them XXXX and our Mortgage Increase to XXXX. I Refuse to pay them Escrow. Because I knew they were Robbing us, I just had to prove it and I did. XXXX I Paid only Loan and Interest for the whole year. We pay our own Taxes and Insurance. The Company has been robbing us since the Mortgage have been sold to them. The Payment for XXXX Increase to {$1500.00}. That was including Escrow. Principal {$440.00} Plus Interest of {$540.00} Total of XXXX. I Pay XXXX Every Month on time. For XXXX. Put XXXX on the side for Taxes and Insurance. Still does n't equal out to what this Company reason are for keep Increasing every year. I need Help I 'm not convince that the Loan Balance is Correct either. Consumer Complaint: " This complaint and been filed with the OCC as well ''. I have issues raised in my previous complaints that have not been appropriately addressed. Please consider this XXXX complaint as a detailed enumeration of my loan file serviced at Select Portfoliio Servicing, ( SPS ) Loan # XXXX. My mortgage loan was referred into the foreclosure process in XXXX and remains seriously delinquent to date. XXXX foreclosure action of my property, is not consistent with the lending statues, regulations and other policies that should 've been applied. Furthermore, XXXX XXXX did not conduct an Independent Foreclosure Review ( IFR ) on my loan file, which I should have been part of. Neither did XXXX supervise nor oversee the loan servicing companies e.g. XXXX XXXX XXXX, who also serviced my loan between XXXX to XXXX unknowingly to me, according to my title records, XXXX XXXX has been the trustee and beneficiary of my mortgage loan. Around XXXX XXXX XXXX, I received a XXXX check of {$300.00} on behalf of my servicer at that time XXXX XXXX XXXX. XXXX XXXX XXXX had a settlement in XXXX, so they informed me that the IFR was never conducted even though I had brought my loan file defects to their attention. Shortly thereafter, in XXXX XXXX, I received a phone call from Select Portfolio Servicing Inc. ( SPS ) I discussed my concerns with the rep and I was told someone will follow up with me, which never happened. XXXX XXXX has failed to provide ownership of signed endorsements, recorded assignments and other obligatory documents. The negligence of my loan file has gone on for so long. XXXX goal is to foreclose on my primary residence, while their harmful errors and malpractices get swept under the rugs. A foreclosure sale date has been scheduled for XXXX/XXXX/XXXX ( XXXX XXXX XXXX TS # XXXX ) I'am currently in a stable financial position and can afford to make mortgage payments on time if enabled an opportunity for a loan modification, deferment, or any other affordable home retention option. ( see application and my review results ) My financial package was recently reviewed by SPS for home retention options, shortly thereafter it was denied with no recourse as reflected in the denial letter attached. When I reached out to the ombudsman team, they just parrot back to their loss mitigation 's response, which was so obvious that they do not have access to my loan file fo them to conduct an independent investigation. One SPS rep also verbally informed me that XXXX just denied it and they do n't have to give any explanations. SPS is also illegally servicing my distressed loan file under the present situation with XXXX XXXX. SPS 's incompetencies is causing me farther more financial harm. Most troubling, neither the servicer ( SPS ) nor the investor ( XXXX XXXX ) is following the legal guidelines in their loss mitigation /foreclosure review processes. I 'm seeking a resolution to the malfeasance actions of XXXX XXXX and its third party contractor companies. I intend to keep My home for my family, even though its 100 % underwater as SPS appraisal and tax assessor records may reflect.

Consumer Complaint: Chapter XXXX Bankruptcy due to Mortgage Fraud, XXXX XXXX XXXX forced into Ch.XXXX to prevent illegal foreclosure. Ch XXXX paid in full in Texas - XXXX XXXX. BK closed XXXX XXXX. Beginning XXXX XXXX, Trustee ordered the payments be made directly to Select Portfolio Servicing. Every payment was made on time. However, SPS refused to take my account status and reporting out of bankruptcy status and refuses to report my excellent credit history to all XXXX credit bureaus, preventing me from refinancing at a lower interest rate. I was transferred to SPS while in a loan MOD with XXXX, who were the ones that illegally foreclosed on me while loan was being transferred from XXXX XXXX, another key player in the Mortgage Fraud Scandal in XXXX. I have been confirmed a party in this scandal by US Treasury and was part of the Federal Investigation into XXXX. I have been identified at least once in Class Action Suit with XXXX. I was originally compromised with XXXX, then XXXX through their collection company XXXX to XXXX to SPS. I want my credit cleared and I want to have nothing to do with SPS ever again. Per legal counsel, the laws will no longer protect me to file a suit against these predators, because they are protected by XXXX XXXX Conspirators and they own crooked politicians and federal courts/judges. However, I can use the consumer credit organizations to correct my credit report and get out from under these predators that would like nothing more than to take away my home from me now that I am no longer protected by Chapter XXXX. It was also brought to my attention from legal counsel scouring my loan documents that the interest rate that I am being charged is .08 % too high and I have no idea how long that has been going on. Any type of research you do on SPS will show you that they are financial predators and they break the law everyday. I want them to correct my credit history and to release my loan. I also want to be compensated for the overages in interest they have stolen from me. I also want to add that they refused a MOD to me after painless requests and documentation was sent to them over and over again by a professional MOD non profit agency. They lied and said that I did not qualify and changed the figures that I sent them, preventing me from obtaining a much lower interest rate that I qualified from the US Government. This was after I went through the entire MOD process with XXXX and I was, against my will - transferred to SPS and PROMISED that SPS would process the MOD they had started but they never completed it or had any intention of completing it. After over a year of being in MOD limbo, I just gave up. Which is a pattern of how they operate. I suggest you refer to Select Portfolio Servicing Fraud XXXX page to see the victims of their crimes, new people join it daily and post the same story as mine. Why would the Federal Government let this happen?
