Consumer Complaint: I am extremely upset of the way Select Portfolio Servicing has handle my loan for the pass years. My hardship started since XXXX/XXXX/2015 due to loss of income when my wife and I have lost our jobs, I presented a complete modification packed to SPS to be review for a modification and all the required documents. However ; I have not been help instead SPS keeps prolonging my case making me fall more behind. I was recently approve only for a repayment plan for the amount of {$3900.00}. this is not affordable because my mortgage payment was for the amount of {$1900.00} before I started to fall behind, if I was not able to make my regular mortgage payments before I dont understand why SPS will give me a high repayment plan. I have Appeal numerous times the denied reasons however I am always forced to reapply. I am tired of the excuses they keep giving me in order to prolong my case. My intentions are to keep my house with an affordable mortgage payments. Based on my investors guidelines I should be able to be provided an affordable mortgage payment since my home is severely under water. I have open a complain with my attorney General XXXX XXXX for all the fraudulent and deceptive practices SPS is using in order to deny an affordable trial payment.

Consumer Complaint: I first applied for a loan modification over 4 years ago. I went over my financial situation on the phone and was told I was eligible but would have to go through the formal process. My nightmare began. We had fallen into financial hardship as I had been layed off and my husband was battling XXXX. I sent in all of the documents requested but was denied for lack of documentation. I applied again. This has gone on for over four years making it now almost impossible for me to qualify for a modification. I do n't believe they ever had any intention of giving me a modification ; just dragging it out until they could foreclose on my home. Every time I applied, I sent in all of the necessary documents. They would just try to come up with other documents that were needed. At XXXX point, we got hung up on my proving I was now on XXXX. Per their instructions, I took copies of front and back of my check, sent them my payment history from SS and my benefit verification letter. They told me they wanted a copy of the cancelled check. This would come from the US Treasury and I was told by them that it was impossible to send to me. I told SPS and they kept stating they needed proof I cashed the checks. I asked them " what do you think I do with them??? '' to which they had no response. They denied me, again, due to missing documentation. I 've researched this company immensely and they have so many similar complaints against them, I ca n't believe they 've been allowed to get away with it. I should also add that SPS refused to accept any mortgage payments from me once I began applying for a modification. I offered them {$50000.00} and to keep the mortgage payments where they were and I would start paying again monthly in XXXX, 2016. They refused.

Consumer Complaint: I have been trying to work with SPS for over a year in trying to save my home from Foreclose. I continue to do everything that they ask of me, yet I am still getting the run-a-round. It took me from XX/XX/XXXX - XX/XX/XXXX, after sending the same documents over-and-over again, to finally get SPS to confirm they have a complete application and that they would need 30 days to review, that was back in XX/XX/XXXX! But now, SPS is claiming that they need more information, they claim that my son 's contributions have not been verified! How can this be? It 's been verified 2 prior times ... why does it need to be verified again. Also, my relationship manager, XXXX XXXX, who is suppose to be my single point of contact is NEVER available, and when I call I always get someone else! Today we spoke with XXXX XXXX at ext XXXX who was rude, unhelpful, condescending and combative. We asked that we speak with a manager or supervisor and she refused only to give us a separate number to call.

Consumer Complaint: SPS 1st TD : XXXX XXXX TD : XXXX XXXX XXXX XXXX XXXX XXXX CA XXXX A short sale was started XXXX/XXXX/17 with SPS. In calling for updates we reached XXXX. She stated that the investor will not allow a short sale and the only option for the homeowners to avoid foreclosure is a deed in lieu. We informed them that deed-in-lieus do not work when there is a 2nd TD on the property. XXXX insisted that the second will participate in a deed in lieu and has refused to tell us the name of the investor. SPS is lying to us. SPS is refusing to tell us the name of the investor. SPS is only a servicer and they are defrauding their investor and the borrower by insisting that a deed-in-lieu is even a possibility.

Consumer Complaint: In XXXX 2016, SPS Select Portfolio Servicing sent out modification paperwork to be completed. My father filled out the forms the first time and when he called back to make sure it was received they told him it was wrong and had to resend. I stepped in to assist my father. I asked to speak to a supervisor so I can get the accurate information on how to fill out this modification form. Since then we have been advised to redo the paperwork or that there is missing documents ( they never told us that we need it ). After seven times of redo the paperwork, the bank sends a letter that we need to redo the modification. For the past 4 months we have done everything the bank needed from us and asked to speak to a supervisors multiple times but no one can give us a definite answer. No one knows anything and their is no one higher than the supervisors, which are useless. Our payments are high but we pay on time every month. we are asking for this modification to help us with the monthly payments that is all we are asking for. I feel like the bank is not trying to help us at all.

Consumer Complaint: RE- XXXX XXXX To whom it may concern, I am horrified of SPS , and here is why : In or around XXXX XXXX SPS allegedly bought our loan from XXXX on or around XXXX XXXX, XXXX I received a letter from XXXX XXXX XXXX stating that my loan was in foreclosure SPS had my loan for less than 20 days prior to sending my loan to the foreclosure department I filed a complaint against the servicer with CPFB and also highlighted the fact that they never gave us a welcome letter, a mortgage coupon nor did they offer any alternative programs as required by law Within their response SPS stated that XXXX XXXX was hired by the previous servicer and they stopped a foreclosure that was never supposed to take place ( PLEASE SEE ATTACHED ) Unbeknownst to me SPS sent documents through the CPFB portal and never mailed said documents to my house SPS also stated that the reason that they did not offer any alternative programs is because they do not have a phone number when in fact I have had the same landline for over 20 years As I reviewed the documents I noticed that the payment history/accounting details they provided were only for the fiscal years of XXXX-present SPS to the best of my knowledge based off the documents sent have no accounting history or details from XXXX to XXXX. So how do they feel the accounting is proper when 6 years of details regarding my account are undocumented or missing from accounting. SPS also cancelled my homeowners insurance and told my insurance rep that the house was foreclosed on in XXXX ( PLEASE SEE ATTACHED ) when in fact a foreclosure never took place in XXXX or XXXX I also became aware as of yesterday that XXXX XXXX XXXX XXXX XXXX XXXX does not own my loan XXXX XXXX XXXX owns my loan however XXXX XXXX is advertising that the XXXX XXXX XXXX XXXX XXXX owns the loan Please also note that the mailing address on file is an unauthorized mailing address and was taken off my mailing list over 2 years ago SPS and XXXX XXXX, have not followed the laws regarding accounting, the fair debt collections practices act, privacy act, GA foreclosure codes rules & procedure HAMP, RESPA, XXXX and I am sure many other state and federal laws Lastly in XXXX we were involved in a Class Action Law Suit which stated that XXXX did not have any relationship with me to offer a loan modification pull my credit and or attempt to foreclose SPS is not a listed creditor on my credit profile as a mortgage servicer and shortly after the class action notice XXXX stop reporting to my credit report as well.

Consumer Complaint: I have a loan for my home with SPS serviceing my wife has been out of work due to a XXXX and XXXX my job is the only income. irequested help from SPS they sent me the paper work and sent it in in XX/XX/XXXX here it is XX/XX/XXXX and they tell me that they turned it down because they did not get the documents. they said I could submit the again with I did and I confirmed that thay di get them. Consumer Complaint: XXXX XXXX is listed as a petitioner for the XXXX AS TRUSTEE SURF XXXX XXXX in a order for foreclosure of my property at sale for XXXX XXXX. ADDITIONALLY I SEE NOTHING LINKING XXXX TO XXXX AS A DEBT COLLECTOR. XXXX XXXX is a employee of a debt collector firm and is not associated with XXXX or XXXX. THE DEBT WAS disputed in XXXX. Servicing transfers give XXXX no right to pursue foreclosure. XXXX never reported this alleged loan to its shareholders for 8 years until XXXX sued me. XXXX is pursuing foreclosure for XXXX AS TRUSTEE of SURF XXXX XXXX,. there are several very illegal issues here and I face losing my homestead due to the lack of consumer protection in the non judicial foreclosure process in XXXX county. THE deed of trust is void due to the failure .assignment into a securitization trust occurred after the trust 's closing date so any subsequent alleged transfers were void and done to harass me and to try to perfect something that did not exist. FIRST - The debt was discharged in XXXX and XXXX - then a " servicer '' was granted relief from BK and in their petition attached there i no record of XXXX at all because it did not exist. the assignment recorded in XXXX may pass texas law for late file claim but it was done to fraud the court. It did not exist in a prior XXXX copy of note received in XXXX. THIS is discharged debt and void deed. The failure to take action through XXXX servicing transfers and 9 yrs is an extreme abuse as none of the servicers could provide a payment history of any kind. Back when XXXX had " servicing right they acknowledged there were no records from XXXX on any payments yet could not explain any change in loan amount of principal to the amount they claimed. the SEC cutoff date for submission to the trust was XXXX XXXX. NOW 10 years later a debt buyer is attempting to associate himself with a valid claim and has violated FDCPA rules against attempting to collerct a debt from me with dozens of statements claiming I owe past due payments. By failing to provide proof of claim. by executing a fraud assignment with XXXX XXXX XXXX when neither was a party to any alleged note and by continued property inspections of the home i live in for 20 years. They have reported to credit agencies a deficiency when none exists.
