There is a {$550.00} advance that was disbursed to pay association dues that were delinquent prior to my mortgage assumption. They reported the advance being delinquent and I've been set up on a monthly pay plan to reimburse Select Port Folio for the advance. This incorrect reporting for the advance is reflecting the mortgage being delinquent has affected my credit rating.

Consumer Complaint: I want to express my frustration working with Select Portfolio Servicing as so its called, in working on a Loan Modification on my subject property located in XXXX, New York. I'm very certain that Select Portfolio are receiving many lawsuits due to mismanagement of files, and also misdirecting clients and forcing some clients to loose their house to foreclosure due to not understanding the the situation of the client. My complaint has been going on with Select Portfolio for a while. It started in XXXX with the simple request of a Loan Modification due to I was facing a Hardship and could no longer afford to pay the mortgage of my house. All the time through the process, they kept requesting the same documentation over and over again with no results. They claim most of the time that documents were not received or mishandled. All the time we tried contacting the bank for an update of our process, there was a different representative, not only did they not know what was going on with the case and file, but they could not even find any updates nor any documentation regarding my file. Most of the time they kept telling me that there were no current updates and that the account specialist will follow up with me regarding the file, which they never did.It is not my fault that i felt behind on my mortgage and have caused this large debt to be accrued. I have done everything in my part as they have requested, until this date no resolutions has been reached. I finally was able to execute a complete package, and have the correct income to qualify for not only my mortgage, but for the Loan Modification as well.I was able to rent part of my property and collect a rental income of {$2500.00} on a monthly basis..All I'm looking or is for HELP. Now, SPS has placed a sales date on my property for XX/XX/XXXX. I dont understand why they would have placed a Sales date, when I have been complying with the Loan Modification and request of documentation to save my house. You have all required documentation with updated information for a review, and you do not want to open a template for a review of a loan modification for a possible solutions, all you want is to sell my house on a foreclosure auction unless we can reinstate. If I was able to reinstate the loan, I would not be asking you for help when I really need it. I believe you have executed : dual tracking '' on my case. If I was in the process of a Loan Modification, foreclosure should have been placed on hold until the review is completed. You are against the Law at the moment for not opening my case for a Loan Modification, and forcing me to foreclosure. I believe its just not fair that you can't give me the opportunity to have the file be review for a Loan Modification, to give me the opportunity that I can show you I can afford my house, and have a win win situation not only for myself as your client, but for the investor of this loan. They claim they been requesting documentation since XXXX, as a new review, the XXXX Income Tax Return was requested, how can this be requested from the year XXXX. They are mishandling my file to not provide me the opportunity to save my house. They keep saying that I was missing for a while with no response, and I informed them before this was to a XXXX XXXX that forced me into a XXXX XXXX for nearly 2 years. I have proof of all medical records that has caused this. All I want is the opportunity to suspend the foreclosure, until a review is completed, please don't based the new application against documents from so called " XXXX review ''. We are in XXXX, a new package was sent 'd, and you have not even taken in consideration the changes in circumstances that has allowed me to try to save my house.

If they are a debt collector, then my alleged debt has already been paid when it was transferred over to them and I would like for my file with them to reflect that. I WAS TOLD THAT WAS FINE BY CSR AT SPS. I FINALLY RECEIVED XXXX INSURANCE PAYMENTS ON XX/XX/2018, AND DEPOSITED IN MY BANK. I WENT ONLINE TO MAKE PAYMENT XX/XX/2018 TO SPS, AND WAS BLOCKED, CALLED SPS TO FIND OUT WHY AND WAS TOLD MY LOAN WAS IN FORECLOSURE! AND THEY WOULD NO LONGER ACCEPT PAYMENTS. I RECEIVED IN THE MAIL THAT DAY, THE FORECLOSURE PAPERWORK FROM THEIR ATTORNEYS. THE ONLY REMEDY WAS TO REINSTATE LOAN BY XX/XX/2018, FOR {$6100.00} ; IMMEDIATELY OVER-NIGHTED LOAN MOD/ASSISTANCE PAPERWORK TO SPS AND THEIR ATTORNEYS REQUESTING REPAYMENT PLAN ESTABLISHED ON XX/XX/18 PHONE CALL BE HONORED.

Consumer Complaint: This home was refinance by Obama home modification several years ago. The home now has several problems due to poor workmanship of the remodeling that was finance by this loan. The builder and the original mortgage financier went out of business during the XXXX housing crash. The builder and the original mortgage financier took advantage for my elderly mother by stripping all the equity out of her home and putting her in a 30 year adjustable interest rate loan when my mother only income was Social Security. Only a predatory would that advantage of an elderly person trying to improve the condition of their home. My mother has died ( XX/XX/XXXX ). SPS -Select Portfolio Servicing has been notified. I have requested a loan forgiveness. I have tried to make payment arrangements. I had power of attorney of my mother during the last three years of her life. I have spoken with SPS several times before my mother death and after my mother deaths. Now SPS is refusing to speak with me since I don't have court order executor of estate which I can not afford. On the XX/XX/XXXX a SPS representative left a door hanger on the front door for my mother whom SPS knows is dead ( decease ) requesting for her to call. I update all contact information two year ago and again last year when my mother died before I sent them a death certificate. When I call SPS, reps will not speak with me. Sometime they will most times they don't. I was making payment by the telephone last year and earlier this year until SPS started charging {$15.00} to process a payment by telephone. The staff at SPS can be very evil, vindictive, and unhelpful. I have a case worker by the name of XXXX XXXX whom I have only spoken to once last year. He never has returned my call or do any follow-up. Up until XX/XX/XXXX, I could call the automatic line to get account information with my mother 's account number, last four of SSI number, and zip code. Now SPS has added and telelphone number that is invalid so now I have no access to account infomation and SPS reps are now even more refusing to speak with me. I sincerely believe SPS- Select Portfolio Servicing is intentionally trying to foreclose on this home. It is my understanding the Obama 's home modification protects SPS and SPS will get paid off regardless of foreclosing.

XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX. In XXXX of XXXX I received documents from SPS which referenced a deferred Principal amount of {$16000.00}. I inquired twice about this information only to receive a document that didn't reference the issue at all. I have never been informed of any " deferred principal '' or of any documents that I have signed. I am currently in the process of Filing a Bankruptcy Chapter XXXX to protect my home as it is my primary residence and this " deferred principal '' is causing additionally financial hardships. I believe this issue to fall under the umbrella of predatory lending practices and am requesting that it be investigated. Thank you,

Consumer Complaint: XXXX XXXX LETTER OF EXPLAINATION I purchased my house in XXXX. I have had 3 Mortgage Modifications since XXXX. The 1st modification was for 2 years through XXXX XXXX XXXX XXXX ( see attached ). In XXXX, I requested a permanent modification through the investors " XXXX XXXX XXXX. '' The interest only would start at 3 % for 2 years and 3.5 % for 3 yrs. After the 3 years, PRINCIPLE AND INTEREST would be added to my monthly payments. I attempted to resolve this issue BEFORE THE 3.5 % would start in XXXX and in XXXX and thereafter the MODIFICATION would revert back to the ORIGINAL LOAN AGREEMENT. I was somewhat successful, I received a letter from XXXX XXXXXXXX XXXX date XX/XX/XXXX stating that " YOUR RATE AND PAYMENT IS SCHEDULED TO REMAIN THE SAME UNTIL THE FINAL PAYMENT DATE, WHICH IS YOUR MTURITY DATE ON XX/XX/XXXX. '' Because I was not given the correct information, I filed a complaint with XXXX XXXX XXXX and the Consumer Financial Protection Bureau ( original letters attached ). I received the modification in XX/XX/XXXX ( documents attached ). The XXXX modification was an addendum to the XXXX modification because the XXXX modification did not state that the modification was for the life of the loan, it only stated that it would be an interest only modification for 5 years and thereafter I would have to start paying principle and interest. That is the reason I contacted the Consumer Financial Protection Bureau and the XXXX office for help. During my contact with these offices I received a letter from XXXX XXXX XXXX dated XX/XX/XXXX stating that my loan will remain the same until the life of the loan. In XX/XX/XXXX, Bank XXXX XXXX acct # XXXX sold my loan to Select Portfolio Servicing acct # XXXX, they forwarded the most recent modification documents but LEFT OUT THE IMPORTANT LETTER THAT STATES 3.5 % until the life of the loan ends in XX/XX/XXXX. I am very disappointed as I continue to get the " runaround '' or misinterpreting of documents from these banks. I spoke to Select Portfolio Servicing several times and they reassured me that they would honor the Modification. On XX/XX/XXXX, I received a letter ( attached ) informing me that the interest rate would be going up to 4.25 % which would make my payments go up from interest only {$770.00} ( I always send more ) to interest and principle {$1600.00} starting XX/XX/XXXX. I have spoken to them but no one has answers. Furthermore, they will not honor the letter from XXXX XXXX XXXX as it has a date of XX/XX/XXXX and the most recent modification is dated XXXX and the same verbiage as the XXXX modification. I have proof that SPS Mortgage company cashed my payment on XX/XX/XXXX and they are refusing to credit my and are charging me interest on that missed payment. 2. they have disclosed personal information and have invaded my privacy by discussing my mortgage with my insurance company, when I specifically told them in writing only discuss the insurance payment release only, I have proof of that I received a voice message from my insurance agent that SPS said I have filed bankrupty and that why the delay and that was none of there business to discussed my personal information. My house caught a fire XX/XX/XXXX and they are holding the balance of my funds that they received from my insurance company to fix my house. SPS is creating hardship for my husband and myself who are disable, we need are money now to continue fixing our house they are holding it so they can collect interest on it as long as they can. they took two month to release the first draw, when all obligations had been met. I have made numerous calls and they refuse to let me speak to anybody other then who answers the phone. Please help me resolve this matters

Issue: Applying for a mortgage or refinancing an existing mortgage

Consumer Complaint: On XX/XX/XXXX I was threaten to sign a fraudulent mortgage loan that was a predatory loan scheme that was with deception, misleading information, deceit that was with threats, because everything a broker name XXXX promised was with misrepresentation, lies to force me to sign the fraudulent note with four fake attorneys who did conduct the threats for a XXXX the claim bank/lender. I was told my mortgage payment was to be lower than my XXXX XXXX XXXX Equity Line of Credit mortgage loan from XXXX XXXX that I have been with since XX/XX/XXXX where my Equity line loan payments was aright around {$680.00}. I was with a mortgage Equity Line Credit of {$140.00}, XXXX from XX/XX/XXXX to a XX/XX/XXXX over 18 months of this payment where the balance was approx {$140000.00} that went to a {$170000.00} with the fraudulent loan with a {$1300.00} affordable unlawful fraudulent force to pay where I was under duress and threats from fake attorneys claiming there is attorney fees and brokers fee and other debt payout to get over {$30000.00} plus added that was indeed fraud. I refused to sign but was threaten that it was too late they have already pay off XXXX XXXX and yes this sound odd but this was my first home and I was lost and knew nothing on what to do they forced me to sign and so start the fraudulent mortgage. The next part is a XXXX never got the to pick up the loan they went bankrupt so my loan that should have went back to XXXX XXXX did not because these fraudsters who already theft, steal money off my Equity line by fraudulently skimming off my Equity line of Credit in disguise of over {$30000.00} so I was left out in the mortgage pool no one funding but paying still with a fraudulent created note and mortgage where months later a servicer name Select Portfolio Servicing start sending mail fraud that I must now start paying them ( question here is who are these thieves ) when they had no bank or investor until I had to file for protection XX/XX/XXXX and in XX/XX/XXXX SPS fraudulently claim a XXXX XXXX XXXX XXXX is my claim bank when a XXXX had no lawful rights to assign and because of that they created a second mortgage on the same XXXX note fraudulently also using the same XXXX Id to pretend and continue the fraud claiming to be the first when a second mortgage can not be with the same note or XXXX identification without changing the note completely and changing the XXXX Id they kept the pretense to keep forcing me to pay because such unlawful it will and is fraud. My filing for Bankruptcy in XXXX for protection never happen I was never protected they never prove they own the note even when I was paying the Bankruptcy court the fraudulent claim of escrow shortage and still paying them forced past due escrow and unfavorable affordable mortgage with even living breath hard earn real money that was with a SPS fraudulently claims. I was paying also the claim past due that was all lies, and I had no choice from the bankruptcy court that they needed to go to jail because communication was to be with the bankruptcy court trustee and attorneys who I know find out was in the alliance a XXXX attorney firm when another attorney after all explain to me that I was being defraud. I fired that attorney on my Chapter XXXX and had no choice but to file a Chapter XXXX for further protection where my property under the protection 522 law is with and for exemption that is federal and states., It was where I was hoping that the Court will request all endorsement for note ownership only to be left alone no one cared because today bankruptcy courts are all in this alliance so I was still left with the unlawful forced to pay even after Bankruptcy Discharge of mortgage where the note if no real bank, or investor if there was a fraudulent second note to impaired the first all transaction is VOID, INVALID. I was only to be told the amount of discharge mortgage went up when if anything else this was to be a negotiable discharge for Fair Market deductions and all bankruptcy computerization calculations where with no collateral or equity left to pay the frauds all is VOID. But I am to pay the same fraudulent discharge mortgage with no help whatsoever from law keepers and a note that is indeed void and frauds that never got caught and today the court and title office is with alliances, government officials and all court in fear of breaking the alliances will not help, so I am left with paying money laundering to a fake bank/lender for now over 11 years still fighting the courts from the lower court to the federal courts to now hoping the Supreme Court of Georgia see this is a big ponzi scheme to defraud home owners, the real banks, the government and defraud the United States. I am in a world pool that is I am being defraud, a XXXX XXXX XXXX XXXX with the use of fake servicers SPS a XXXX Superior Court tile office, Judges, attorneys, Sheriffs, Polices, insurance agents, title tax appraisals agents, maybe the FBI, just about all law keepers today is with this alliance to not have anyone expose this huge ciaos of economy destruction mortgage fraud scheme and I am a victim of this fraud in the United States and someone has to put a stop I am a single mother who is with this getting dismiss from every court not wanting to help me, and today I am paying as a tenant in my own home where there is wrongful filing for foreclosure a fake XXXX XXXX with fraudulent amounts and no matter what documents I submit as proof an attorney comes to court with fake, misleading and their assign judge in the alliance to play the game of befriends unlawful cover-up scheme to defraud me even threaten me to be put in jail for 10 days taking too much of the cover-up in a XXXX Magistrate fake court room malicious intentions performances in front of XXXX of my children witness me being threaten that I did not prove the property is mine when my name is at the XXXX XXXX XXXX paying property tax since tax year XXXX and I still live there never abandon my property ans still paying the fraud under duress and threats, HELP! HELP!! HELP!!! HELP!!!!! this XXXX XXXX XXXX XXXX, with SPS attorneys, judges, superior title office of XXXX are FRAUDS. It is time I get some real lawful Help I am being deprived of my Constitutional rights the due process of laws are my Constitutional Law Rights. I am still unlawfully force to pay thieves, criminals, fraudsters all this alliances must stop for me the predatory lending is going on 16 years with the amount of payments made under threats through fraud and my Georgia Exemption of over {$20000.00} I have paid my home off and today still is force to pay fraud because no one wants to break the law keepers alliances of the mortgage fraud in this country cal USA.
