Consumer Complaint: Please see attached verified complaint, indorsed by seven ( 7 ) people demanding investigation of all the people involved in embezzling my and the estate monies of about $ XXXX to unknown accounts and to Select Portfolio Servicing ( " SPS '' ) after my objections to the proof of claim was on file several days before chapter XXXX trustee embezzling my and the state monies and after both the debtor and i : had objected to the alleged arrearage of about {$450000.00} almost XXXX weeks before our monies was embezzled and stolen by the chapter XXXX trustee XXXX XXXX and its culprits. i : contacted Senator XXXX 's office, they suggested that i : file my complaint with CFPB and give them authorization to act as a liason. THIS IS A MATTER OF NATIONAL SECURITY. The Case No. is XXXX, XXXX XXXX, XXXX XXXX Bankruptcy Court, California Below is a summary of the undisputed facts and misconduct committed : 1. On or about XX/XX/XXXX, the escrow on subject property : XXXX XXXX XXXX, City of XXXX, State of California closed -- Exhibit " A '' ; And, 2. The proof of claim on subject property was also filed in court on or about XX/XX/XXXX -- Exhibit " B '' ; And, 3. On or about XX/XX/XXXX, both XXXX and XXXX objected to the alleged arrearage -- Exhibit " C '' ; And, 4. On or about XX/XX/XXXX, XXXX objected to the proof of claim filed in court on XX/XX/XXXX -- Exhibit " D '' ; And, XXXX. On or about XX/XX/XXXX, 15 days after the close of escrow of XX/XX/XXXX, the alleged arrearage of {$320000.00} was embezzled out of the Chapter XXXX Trustee 's account when XXXX 's Objection to Proof of Claim XXXX was filed in court of records on XX/XX/XXXX, nine days before this literal theft of XXXX and estate 's monies was perfected ; And, 6. Chapter XXXX Trustee misappropriated XXXX and estate 's monies when it instructed the escrow officer to pay {$840000.00} of XXXX 's and estate monies to strangers to the alleged transactions 14 days after the escrow closed. The escrow closed on XX/XX/XXXX, XXXX XXXX trustee claims to have instructed the escrow officer to pay XXXX 's and the estate 's monies to Select Portfolio Servicing ( " SPS '' ), 14 days after the close of escrow and eight days after XXXX 's objection to the proof of claim XXXX was filed in court of records on XX/XX/XXXX, Exhibit -- '' D '' ; And, 7. The Custodian of Records at XXXX XXXX declared that it can not find several checks for the disbursements that Chapter XXXX trustee claims it had paid, related to XXXX 's and Estate 's sold private property, in essence Chapter XXXX trustee stole XXXX 's and estate 's monies, using courts ( Bankruptcy and BAP ) ; And, 8. Chapter XXXX Trustee XXXX XXXX, while the objection to Proof of Claim XXXX was on records -- Exhibit " D '', and while both Debtor and XXXX had objected to the alleged arrearage -- Exhibit " C '', and after the escrow had closed on XX/XX/XXXX -- Exhibit " A '', caused to launder and embezzle about {>= $1,000,000} of Estate and XXXX 's monies to Select Portfolio Servicing and also to several unknown accounts ; And, 9. On or about XX/XX/XXXX, XXXX send a subpoena to XXXX XXXX, Chapter XXXX trustee demanding that Chapter XXXX trustee return the writ by XXXX XXXX on XX/XX/XXXX -- Exhibit " E '' ; And, 10. On or about XX/XX/XXXX, XXXX send a subpoena to XXXX XXXX, Chapter XXXX trustee 's Bank demanding that Chapter XXXX trustee 's bank return the writ by XXXX XXXX on XX/XX/XXXX -- Exhibit " E '' ; And, 11. Chapter XXXX trustee, on or about XX/XX/XXXX, attempted to conceal information and refused to return the writ as required in violation of 18 US Code 2071 -- Exhibit " F '' ; And, 12. Over a series of communications from XX/XX/XXXX through XX/XX/XXXX, XXXX XXXX, XXXX XXXX trustee 's Bank responded to XXXX stating on the records that there are no other information that XXXX XXXX Trustee could supply since they had no idea what happened to XXXX 's and the estate 's monies which were in control of the Chapter XXXX trustee after the close of escrow on XX/XX/XXXX -- Exhibit " G ''. The Chapter XXXX trustee 's bank indicated to XXXX the following : " Good Morning, XXXX these tickets were created by XXXX XXXX XXXX. There are no other details in the system that we can provided to you. '' Exhibit " G '', emphasis added ; And, XXXX. The records obtained from Chapter XXXX Trustee 's bank proves, beyond any shadow of any doubt, that portions of XXXX 's and estate monies of about {$350000.00} have been laundered to unknown accounts -- Exhibit " G '' ; And, 14. The records obtained from Chapter XXXX Trustee Bank, beyond any shadow of any doubt, proves that all of the estate and XXXX 's monies were laundered to unknown accounts and to Select Portfolio Servicing, when not only the escrow had closed several days prior to this misconduct but also both Debtor and XXXX had objected to the alleged arrearage on XX/XX/XXXX, and XXXX had objected to proof of claim XXXX on XX/XX/XXXX ; And, XXXX. On or about XX/XX/XXXX, upon research and based on belief and information, even though the escrow had closed on XX/XX/XXXX, unknown entities which appear to be Select Portfolio Servicing sold the same closed alleged loan to other entities on or about XX/XX/XXXX. This evidence was obtained from XXXX which shows that as of the date that the same security was resold, there is a net loss of {$120000.00} owed on the subject closed alleged loan account -- Exhibit " H '' ; And, 16. During an evidentiary hearing, Chapter XXXX trustee 's representative, attorney XXXX XXXX ( XXXX '' ) lied to the judge stating if the estate 's and XXXX 's monies would not have been disbursed [ to whoever Chapter XXXX trustee disbursed XXXX 's and estate monies to ], the escrow would not have closed [ even though the disbursement were made on or about XX/XX/XXXX and on or about XX/XX/XXXX and the escrow had already been closed on XX/XX/XXXX ], XXXX falsely and fraudulently stated, Exhibit " I '' : " And from that amount, we demanded a sufficient amount to pay just the arrearage portion, and what we do is, our process for escrow is that we demand sufficient funds to pay everything in full, and then we send a check back to escrow representing that arrearage portion which is the 300 some thousand dollars that XXXX XXXX is talking about. That check, our check, for XXXX some XXXX dollars plus the remaining balance are sent to Select Portfolio to close escrow. So they take two of those checks simultaneously to close escrow. If they didnt have the 300 some thousand dollars in arrears, our check, they cant close escrow. They wont have enough. They wont have enough money. '' Exhibit " I '', emphasis added, And, 17. The information that was obtained which are part of court records, show that an un admitted attorney to USDC charged and got paid ~ {$70000.00} of XXXX and estate 's monies, in clear criminal violation of Cal. Penal Code 6126 ( a ) among others ; And, 18. These misconduct are criminal violation of law which has severely economically and criminally damaged XXXX ; And, 19. Consumer Complaint: Select Portfolio Servicing , Inc . Loss Drafts Department XXXX. XXXX XXXX XXXX, OH XXXX I am getting the runaround from the Loss Drafts Department at Select Portfolio Servicing. We had a fire back in XX/XX/XXXX. The total amount of the claim was {$160000.00}. The first two payments were made relatively quickly. The last payment was delayed a bit but not too bad. I requested the final inspection on XX/XX/XXXX. This is the inspection that shows the insurance related work has been completed. I was told that someone would contact me within 6 business days to schedule the final inspection. It is XX/XX/XXXX and I have still not been contacted. I spoke with SPS as well as the company who handles disbursements and the inspection scheduling, XXXX, and was assured I would be contacted. In the meantime, the work is done. They are sitting on {$25000.00} which is owed to the contractor, and I shudder to think how long it will take for them to send me the check for the hold back depreciation, once the insurance company sends that to SPS. It is now XX/XX/XXXX, 1920 business days have passed, and I have yet to be contacted by anyone. I was told on Tuesday, XX/XX/XXXX, that I would be contacted within 72 hours. It didnt happen. This is outrageous. The work on my house is complete. Im getting invoiced by the contractor and I am waiting 20 business days on top of XXXX knows how many more days after that to have the funds released after the inspection has been completed.

Consumer Complaint: My home was damaged by Hurricane Harvey and Select Portfolio Servicing ( SPS ) has received significant insurance proceeds. The home has been completely restored in better condition than before storm ... all funded from my personal resources. All documents have been provided to include adjusters reports, contract for repairs, lien waivers, contract ( paid in full ), etc. County appraisal documents were submitted showing the value of the land alone is 3X the small amount owed. Inspections have been performed with with inaccurate completion representation and even with those inaccuracies the corresponding money is still not being released. The repairs are 100 % complete noted in recorded phone calls from weeks ago and still SPS delays in scheduling an inspection I assume for the sole purpose of delaying release of MY money. In addition to CFPB I am utilizing every contact known to me to initiate a Congressional Inquiry into SPS Servicing practices which will hopefully uncover a pattern of deceit and fraud. Attached are demands for inspection and release of money. The initial check to reimburse me for repairs took months to receive. I worry about those that don't have the resources to fund the repairs out-of-pocket. Additionally, I have attached a Qualified Written Response sent over 6 weeks ago for answers to very specific questions related to the servicing of my loan that SPS obviously chooses to ignore. I have received neither the confirmation of receipt letter ( 5 day requirement ) nor response ( 30 day requirement ). How is it these non-financial institutions can simply ignore legislative mandated regulatory requirements?

Things got resolved but I felt I was getting played based on XXXX 's reputation. ( maybe we have someone not paying attention? ) Last XXXX they forced placed a flood policy on me. I ignored it knowing their reputation and was not paying for dual coverage.I have not paid the premium. I finally got tired of them asking for the premium and sent them my XXXX page. Not good enough. Apparently since this was new construction the legal address does not match the physical address. No big deal they say " It is required by XXXX. After all these years no creditor has challenged this. So .... The insurance company says the agent has to change it and the agent told me to call the insurance company. Again no big deal as we been carrying flood insurance since we purchased the house. Again, I feel like is XXXX looks for borrowers to extort money from ; somebody not paying attention. They have gotten better ; the call center employees sound more convincing and professional : but when asked XXXX several people ) to review my policy ( XXXX page ) ; almost all XXXX insurance experts XXXX had no access to it ; XXXX a couple did XXXX when they all should. Now I'm asking for a deferment and I'm feeling I will get the run around. I've been down this path before.! I am now being told by SPS that there is nothing they can do because the sale date is too close. My sale date is scheduled for XX/XX/2018. I am a US Veteran and no one from SPS ever reached out to me to offer me any assistance. I have never been assigned a designated point of contact and the excuse that there is not enough time to review the information I sent on XX/XX/2018 is absurd and a violation to my rights. SPS has always given me the run around and now I am forced with no other options.

Consumer Complaint: My loan which was serviced by Select Portfolio Servicing, was closed when I refinanced my house on XX/XX/2018. I was advised that legally they had to get my escrow refund to me within 20 days. It is now XX/XX/2018 and I still do not have my refund. I have called twice to inquire about the refund and was advised that they sent the check to be cut and processed on the XX/XX/XXXX and that it would take 7-10 more business days on top of that to receive the check. I have received other correspondence from them that did not take that long and mail from anywhere in the US does not take 7-10 business days. I received a notice that my loan was closed but not that I was receiving a refund or how much it would be. I called again today and asked for an overnighted check and was advised that she would 'notate '' my request but that it would most likely take another 30 days. I feel that if I did not consistently inquire, this payment would never have been made to me. Also they had not way of sending me confirmation that the check was actually cut or sent. Also, she could not send me a confirmation that it would be coming this time again. Maybe this just was a one off error, but the whole process seemed like a scam to try to keep peoples overpayment of escrow money.

I submitted my complete application for mortgage assistance about 2 months. I keep following up and I speak to many people seems that no one knows whats going on. They've been give me the run around transferring me all over the place. Finally today, they told me theres no time to review and that I hand a sale date set for XX/XX/2018. As you can see, I've been bounced around given wrong information not just by rep but by managers. They then said that my case was handled wrong and that he was sorry but that my house will go for sale. I explain that I have a family and that we are going to be in the street but he did show any sympathy towards my situation. I stated to him that I do not want to lose my home that's all we have and that I will be thrown out with my family and no place to stay. I don't understand why they would ignore my application all this time. I am currently back on my feet and ready to pay my mortgage all I'm asking is a fair review and for my sale date be postponed so they can get a chance to review my package and review my current situation with no excuses. If this does not go anywhere I am going to seek legal advice to see if I can sue my mortgage company. Please, help me I do not want to be thrown out on the street with my family. Consumer Complaint: Under FEMA guidelines for mortgage assistance moratorium, I was entitled to, and applied for, a 3 month mortgage forebearance due to Hurricane Irmas effects in my state of Florida. I spoke with an SPS rep in XX/XX/XXXX about the forebearance and was given word to stop payments and to call again in mid XX/XX/XXXX for further information. I did not make mortgage payments for the months of XX/XX/XXXX through XX/XX/XXXX. In XX/XX/XXXX SPS informed me that I would be responsible to repay those three months as a balloon payment in XX/XX/XXXX. The balloon payment obviously defeated the spirit and purpose of the moratorium, was not a reasonable solution, and was therefore not acceptable, so SPS offered a modification plan as another option, which I accepted. I filled out the required paperwork, and followed all instructions. By XX/XX/XXXX, however, I still had received no instruction from SPS as to how much to pay, so I sent in a check for the prior amount I had been paying on the original mortgage ( deposited by SPS XX/XX/XXXX - {$470.00} ). Note : This check is the reason why, I think, that I was later reported in XX/XX/XXXX as a 60 day delinquency ( see below ) instead of 90 days. Later that month I learned that the modification plan had reduced the monthly payment, so the next check I sent was for the new amount ( deposited XX/XX/XXXX - {$390.00} ). I made the following payments in subsequent months : XX/XX/XXXX {$390.00} XX/XX/XXXX {$390.00} XX/XX/XXXX {$390.00} XX/XX/XXXX {$390.00} These are SPS deposit dates. All of these payments have been sent ( and deposited by SPS ) on a timely basis, yet SPS reported to the credit bureaus in XX/XX/XXXXthat I was 60 days delinquent, which remains a serious blotch on my credit rating. Their " dispute advocacy team '' - i.e., the people directly responsible for these decisions - do not allow personal contact through phone calls, and handle everything through anonymous letters.
