Issue: Struggling to pay mortgage

Consumer Complaint: We started this process in 2009, we were offered a loan modification and we took it because it would make our payments cheaper through XXXX XXXX XXXX. We accepted the loan modification and made all trial mortgage payments as they requested. After making all of the mortgage trial payments, while we were waiting to get our agreement concerning the proposed modification they sent us a letter stating that we did not qualify for a loan modification. Every time we tried to speak to someone about our loan we had to wait for the XXXX and if by chance we did get to speak to anyone, the next time we were told to call there was a new person assigned to our account that knew absolutely nothing about our mortgage and if in fact we had submitted a new modification package it had to be reviewed. We have been offered stream line modifications in the past but following the advise of our attorney we did not accept them because they were such high payments. The hardship that we encountered has past and we are willing and want to make mortgage payments. The other issue is that they gave us a valuation of our home and it is {$370000.00}. and we owe a total of over {$750000.00}. We never knew the interest rate we were being charged we don't know if we have an adjustable rate mortgage????? We can make a good faith down payment as well as make regular payments. They sent us a statement with a XXXX Payment for {$3700.00} and then for XXXX the payment is {$4700.00}. It appears to adjust every three months. If we took the streamline modification would it adjust every three months? On the statement they have charges and other fees listed as {$6200.00}, then Charges/fees this period {$1800.00}? We are trying to make sense of all of this because we really want and need to save our home. We are asking for your help.Please.

Consumer Complaint: Hello, I contacted this agency earlier this year to assist me in getting my 2017 school taxes paid after my old mortgage servicer, XXXX of Virginia failed to do so. In working with my new servicer, Select Portfolio Servicing , Inc of Utah this was finally accomplished as SPS paid them. I recently received an escrow account analysis from SPS. They are claiming that when they received my account from XXXX the escrow account was short. They have raised my mortgage payment XXXX a month. After two phone calls with SPS totaling 90 minutes they are acknowledging that the shortage came from them have to pay the school taxes that XXXX didn't pay. Essentially I'm being made to pay those school taxes twice. I asked SPS why they don't go after XXXX for those monies. I was told " that's not what they do. '' I was also told that this is an " unfortunate situation '' How can I be responsible for the taxes XXXX didn't pay when I paid my mortgage every month and those taxes were part of my payment? More concerning is where are the monies that should have been used to pay my taxes if XXXX didn't use them to pay my 2017 school taxes. Maybe this should be looked at by the State Attorney General 's office. I look forward to your response. Thank you.

Consumer Complaint: I sent a debt validation letter for SPS to respond to on XX/XX/2018. SPS refused to respond to the letter, and they put my house in foreclosure. CFPB and the federal law states that the lender must respond to the debt validation within 30 days of receiving the letter. I want SPS to follow the law and respond to this letter. The letter was via certified mail and I have a return receipt of the letter. Please send this letter to SPS and please give me a response back as soon as possible.

Consumer Complaint: I am writing this letter as my last resort to save my home from foreclosure. I have applied for a Loan Modification with my current servicer Select Portfolio Servicing for the last couple months, but I have not been able to work anything out with them and I am falling further and further behind. The reason I fell behind on my mortgage were due to reasons beyond my control. Due to medical conditions I had to have an operation, which forced me to go on Social Security. Not only that but there was a rupture and I had to replace the entire plumbing system for my home. Lastly, I had to evict a few tenants that were not paying me rent and were causing lots of trouble. Things are looking way better now and I am in a better position to assume my responsibility. I receive Social Security income and I receive XXXX XXXX jobs on the side ; also, some of my family rents with me now and helps me with rental income. I want to pay what is past due on my mortgage, but I can not afford to pay a lump sum of the past due amount. I feel a loan modification would be feasible for me at this moment and would definitely help me stay in my home. Ive applied over 15 times for a loan modification with SPS, in hopes of saving my home however they have turned down every application I have submitted. The most recent denial I received was on XX/XX/2018 and SPS stated I was not approved because they were not able to reduce my principal and interest payment, but even the payment I had before I can still afford ; its the past due amount I cant pay all at once. SPS stated my income was not required nor considered as part of their evaluation, but how do they know if I can afford my mortgage payment if theyre not reviewing my income? This is why I am turning to you for help, in hopes of receiving valuable information that will help me move forward and save my home from foreclosure. I have tried everything and even re-applied for another loan modification review on XX/XX/2018, however SPS refused to create a new review and the worst part is that they scheduled a foreclosure sale for XX/XX/2018. I have only received 1 modification in the past and that was a few years back, but I should be entitled to another modification. Please look into this and help me keep my home. Thank you,

Consumer Complaint: My lender being SPS and my Investor being XXXX Bank refuse to assist me in keeping my home today. I have applied many times with what income i have between me and my wife and both the lender and the investor want to blame one or the other. The investor tells my lender for the reason to deny is cause it is a " business decision ''. This is NOT in any means a way to let a homeowner loose there home based on a " business decision ''. Per my lender on there website they have you enter your loan # and they let you know what form is needed and for my loan # was only a 2 page form and no other documents are requested, just these 2 pages of request for mortgage assistance forms. When i sent these forms per there request they will not even open my file to review it for nothing. I have and had a very strong hardship for the reasons i came delinquent. I can prove the hardship if needed but im never get this far with SPS. They just deny the file with no review at all.

Consumer Complaint: Select Portfolio Servicing bought my mortgage from XXXX, which was the Mortgage holder at the time. It was a couple years after I filed chapter XXXX bankruptcy. I did not include my home in the bankruptcy and submitted the courts documentation, the same documentation I am uploading here, showing that it was not included. I am not sure how many years ago that was. They continued to report it as part of the bankruptcy. It has now been 10 years after the filing, and it has fallen off my record per Federal Law. They are still reporting the house was part of a bankruptcy. I tried to get a loan, and Select Portfolio told them either on the phone and/or submitted documentation to the loan agent, telling them that the home was part of a bankruptcy. I am FED UP of this misrepresentation and now they are not only misrepresenting me still, they refuse to change it and they are messing with my future..

Consumer Complaint: I had a rentel property with Select Portfolio servicing Inc, property address is XXXX XXXX XXXX XXXX Pa XXXX which was surrendered during a bankruptcy E filed on XX/XX/XXXX I assumed that everything was over as i never recieved any correspondence from SPS, including any tax bills or sewer bills after the discharge of my bankruptcy on XX/XX/XXXX In XX/XX/XXXX, while pre qualifing for a personal home loan, SPS appeared as an open mortgage in my name. I contact my attorney and she charged me XXXX to do a quick deed back to SPS. On XX/XX/XXXX i was served with a law suit from SPS filing an action of quiet title saying SPS had not had interest in the mortgage. I have XXXX from SPS with the address of the property for the year the bankruptsy was filed. Now they are saying that i had no right to convey deed to them. This is a ridiculous, frivolous law suit from a fraudulent company, they need to be stopped and this suit needs to be dismissed.

After three months with them she realize that they were applying her monthly payment to interest only rather than to principle, escrow and interest. When she call to inquire of the situation the told her they didn't see what her problem was. She had to call on several occasion, speak to multiple people before it was resolve. After speaking with few friends about her experience it turns out two of them had face the same situation where one had to have it resolve in court.
