Consumer Complaint: My previous mortgage holder, XXXX XXXX XXXX, did not accept a modification agreement, sent to me by themselves, which I returned on time ( in provided overnight delivery XXXX envelope ), 2 copies with my signature on both of them> I left one copy to my self. I paid 7 months Trial period payments of ( $ XXXX ) and 10 months of modification payments, as it was on agreement signed by me, but after all, XXXX XXXX XXXX attempted to foreclose on my property numerous of times. After I filed a complaint in a Missouri Small claims court, XXXX XXXX XXXX transferred the case to Federal Court and tried to dismiss it. Thet, in the middle of litigation XXXX XXXX sold my mortgage to SPS, inc. ( Select Portfolio Servicing ), which repeats the lies of XXXX XXXX XXXX, by saying that I paid only 3 months of TPP ( trial period payments ) and XXXX XXXX XXXX did not approve the modification. Both of them are disregarding my 17 months of payments, by mentioning only 3 of them!!! They lie in Federal and State Court rooms, under the oats they take! This is a capitol offence and forgery all in one! I want the truth to win over the lies of these mortgage holders! I am defending not the walls of my property, but my dignity and my right to defend myself against any crooked bank or organization, that ruined 10 years of my life and made me XXXX XXXX XXXX XXXX and very XXXX person. They took me from enjoying my family and my children for 10 years and still doing this up untill today. In fact, tomorrow SPS, inc will attempt another foreclosure of my property. I will be fighting against this once again.

Consumer Complaint: Im writing on behalf of my elderly/XXXX mother and father in law. In XXXX, XXXX ( XXXX ) was the servicer/ bank that held their mortgage. Due to major medical issues the kept my father in law from returning to the work force, and trying to avoid foreclosure they applied for a modification on the loan. XXXX, through a government program that was released in XXXX, granted the loan hardship/modification and fees etc were waived. They were to have a set mortgage payment every month without changing- something they could afford on their small fixed income. Since XX/XX/XXXX my Father in law is no longer in the picture. My mother in law took over the finances at the household and we were assuming she was doing fine. A couple months ago my mother in law came to us in a panic. She was about the lose the house and all her bills were or were about to be delinquent. After looking into we saw that at some point the loan servicer changed from XXXX and the new servicer SPS was charging her almost double then the modification agreement had stated. Plus they tacked on fees of close to 60k that was added with little to no explanation. I have called on MULTIPLE occasions asking for a copy of the modification agreement that was transferred from XXXX to SPS.I ahve also asked on multiple occasions for an explanation/ breakdown of added money. Through multiple recorded phone calls they have refused to provide either. They have supposedly looked everywhere for the modification agreement and it cant be found. Also they are refusing to send any type of explanation as to the money they have tacked on. We are looking to refinance the loan but the underwriters at XXXX XXXX will not move forward without the modification agreement or breakdown of the added funds. My ssenior/XXXX mother in law will foreclose and face homelessness if this is not provided and taken care of right away.

Consumer Complaint: My wife and I believe that we have been and are being discriminated against because of our XXXX and the XXXX of our skin. We have been trying to get a loan modification from Select Portfolio Servicing ( SPS ) for over a year. However, we also believe that SPS would rather foreclose on our home and collect government funds rather than help consumers with legitimate hardships. We requested a loan modification due to a family medical emergency, which led to a financial hardship. We stayed in contact the whole time with SPS and it was always the same response they didnt receive all of the document. Earlier in our quest to save our home, SPS offered us the option to Short-Sale our home. We hired a realtor to represent us ( as a third party ), completing and submitted all required documents to SPS, and put the house on the market for Short-Sale, and SPS refused to honor their option to allow us to Short-Sale our home. Next, we filed several complaints against SPS. After reviewing our valid complaints, and our account, SPS disingenuously offered/recommended that we re-apply for a loan modification. We re-applied for an SPS loan modification, and submitted all required documentation in a timely manner. In our request for mortgage assistance, we asked SPS to consider a. extending the maturity date of our SPS loan # XXXX beyond calendar year XXXX ; b. place missed payments at the back of loan ; c. keep the current fixed interest rate or lower ; d. keep monthly mortgage payments of not more than current monthly payments per month. SPS refused to consider modifying our loan, but instead offered a repayment plan requiring that we make monthly payments of {$15000.00} per month. We wrote a letter of appeal informing SPS that we could not afford to pay monthly mortgage payments in the amount of {$15000.00} a month, and reminded SPS that we initiated our original loan modification request due to a medical hardship which led to a financial hardship. And now that our medical hardship has been resolved, we under no circumstances are not able to afford to pay a monthly mortgage payment of {$15000.00} a month. SPS responded by rescinding their loan modification offer because we were unable afford to pay SPS {$15000.00} monthly mortgage payments. SPSs loan modification program is a disingenuous bait and switch for sure. I have never seen any kind of trickery like this ever, and it can not possibly be legal. We are seeking legal representation. We believe SPS has wanted to foreclose on our home all along. SPS did not even offer Short-Sale or bringing the account current as options. We believe SPS had no intentions of helping us and would rather foreclose on our home. SPS should not be allowed to deny our requests for mortgage assistance simply because of XXXX and the XXXX of our skin. My wife is also a XXXX XXXX survivor and I am a retired, XXXX veteran and I honorably served this great country for 22-years. We would for SPS upper management to review this file and letter that they sent to us. Please do not allow SPS to continue their discriminating practices against us and help us save our home from being foreclosed on by this XXXX, predatory lender, Select Portfolio Servicing.

Consumer Complaint: I am referring to a prior complaint that I have had to Select Portfolio Servicing which I outlined in my prior complaint to them Reference # XXXX in which I have disputed my account with SPS which began with a modification done by XXXX on our mortgage since a modification XXXX did on our mortgage account in XX/XX/XXXX. SPS responded to CFPB that SPS needs specific information regarding those payments I believe have not been accounted for. I have submitted documentation to them subsequent to the complaint I submitted to CFPB in the form of bank statements showing payments made to XXXX in XX/XX/XXXX, to XXXX in XX/XX/XXXX and XX/XX/XXXX and the XXXX Payment Transaction History which substantiates my payments to them and not credited to my account and clearly shows the excessive capitalization for accrued interest and escrow charges made on my mortgage account since XX/XX/XXXX by XXXX, XXXX, and now SPS I wish to reiterate that the fact that I signed a mortgage modification does not nullify or excuse bank errors made on my mortgage account since XX/XX/XXXX. SPS recently responded with a letter dated XX/XX/XXXX a copy of which is enclosed in which SPS responded to my inquiries of XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX regarding the missing payments. In this letter SPS clearly states in answer to my inquiry that XXXX Bank responded to my concerns in their letter to me dated XX/XX/XXXX, which is completely in error. I sent SPS copies of payments made in XX/XX/XXXX which clearly show that we made payments through XX/XX/XXXX. XXXX has stated in their letter that we made payments through XX/XX/XXXX. which is a bank error. # As I stated in my complaint # XXXX, XXXX did not credit us with a replacement cashier 's check sent on XX/XX/XXXX and charged our account with that payment of {$6400.00} plus {$3000.00} in corporate advance and interest fees. This increased the modification agreement by {$27000.00} and the revised modification agreement they sent to be returned on XX/XX/XXXX, required that we send a cashier 's check for {$3000.00}. This represents a complete bank error on their part which I have disputed since XX/XX/XXXX as stated above. And now SPS is excusing this error by sending a copy of the XXXX letter dated XX/XX/XXXX. The bank errors on my mortgage account started there as I have written in my former complaint # XXXX to CFPB submitted on XX/XX/XXXX. Please see enclosed documents Also SPS has offered me a repayment plan on my mortgage which I can not meet in the amount of {$6100.00} per month which is twice the amount of my current mortgage payment. This offer was made without their obtaining or requesting current income information from me. I understand it is illegal for a lender to offer a mortgage payment to a borrower without substantiating their ability to repay the mortgage. This amount is excessive for me to pay based on my current income. I consider their repayment plan to be unconscionable and unfair. If I can not meet that repayment plan I fear SPS will begin foreclosure proceedings against my property.

Consumer Complaint: My account was transferred from XXXX XXXX to SPS in XXXX XXXX. Due to unforeseen circumstances, I requested a deferral for the months of XXXX - XX/XX/XXXX, with the first payment set for XX/XX/XXXX on automatic draft. This request was fulfilled and I was informed by the agent that I would not have a late fee reported for the months of XXXX, but yet I had a late fee reported to the credit bureau. This late report with a new mortgage company is impacting my ability to refinance my primary mortgage and consolidate my loans/bills. It is also impacting my FICO credit score of which I am working diligently to improve. I would like the report removed and a letter in writing from the company so that I can continue to repair my credit and improve my score.
