Consumer Complaint: To whom it may concern, We already filed a complaint for this loan however the response given was completely beating around the bush and the concern was never addressed. A loss mitigation submission was submitted for review to Select Portfolio Services on XX/XX/XXXX. On XX/XX/XXXX we were told the file had been denied due to excessive forbearance as well as the client exhausted all of her loss mitigation options as it was stated she used the maximum amount of modifications the investor allows. I have made several requests through the ombudsman for copies of the three modifications the lender claims she has received. These requests have been requested since XX/XX/XXXX and several calls have been made and each time we were told the modifications would be sent to us. As of now, a copy of the modifications the lender stated this client has had and as of XX/XX/XXXX I have only received 1 modification from XXXX. The issue I have with this is the terms of the XXXX modification do not match her current terms which would make any amounts due from XXXX moving forward incorrect and also would change the way the file should have been reviewed for loss mitigation. Also stating the client has had 3 or more modifications when the servicer can only produce one is dangerous because the investor is being misled to believe they have given three modifications. This client has a legitimate hardship and has the ability to make a modified payment. At this time I am requesting the following. A hold be placed on the sale date for XX/XX/XXXX. I am again requesting a copies and proof of all loan modifications the client has received since the loan was taken out. I am also requesting a new loss mitigation review be done based on the corrected numbers and balance as previously stated the number and terms from the modification that is on file does not match current terms.This client has owned her home since XXXX and wants to save her home along with her children who love their home. This client can afford a newly reinstated restructured mortgage. However they do not have the correct balance or terms for this loan as they claimed there are multiple mods and there are not and have yet to provide the proof.

Consumer Complaint: My Loan Number is XXXX. I got behind in my mortgage payment back in XXXX but have really been trying to catch up the four payments that I had missed. My last payment was on XX/XX/XXXX which just brought my past due for XXXX. I was told and directed to put in for mortgage assistance. but because I had put in for this. SPS Servicing would not accept any payments for any reason. which I had 2 payments that would have brought me within 2months of being past due. Now since this has happen I haven't made any payment Now I'm 5 months behind and my loan has been referred to an attorney. I have been in my home for 22 years and don't want to lose it. On XX/XX/XXXX I had XXXX XXXX and explain to the company I was Out of work but would be getting short term XXXX from My insurance company at work and would make as many payments as I could to catch the loan back up.

Consumer Complaint: Since XX/XX/2019, a complete package has been sent to SPS to apply to the Short Sale. From that moment on every time we call, SPS states the file is complete, there is a missing document or the submitted documents are not reflected in their system. We have confirmed emails and faxes that they received the requested documents. Essentially, they continue to play the game of we have what we need to move forward then we call the following week and they state they are missing a document which we resend. They then confirm receipt followed by another week passing and we call and they state they are missing the same document which they just confirmed receipt. On XX/XX/2019 the bank informed me that the Short Sale was approved and that we should wait for the approval letter. On XX/XX/XXXX they reported that the letter was not ready and that we should continue waiting. On XX/XX/XXXX, they started again requesting documents and the request XXXX with corrections, which I never understood because everything was supposedly already approved. On XX/XX/XXXX, SPS sent me a letter asking for documents again, some of them did not apply to my file and others had already been sent. Nonetheless all requested documents were resubmitted on XX/XX/XXXX. On XX/XX/XXXX, SPS stated that nothing more was needed and everything was again complete for review. However, on XX/XX/XXXX, SPS stated that I had to resend documents that they had since XX/XX/2019. Although there is no sale date schedule, this process with the bank is being too exhausting both mentally and physically for me and my family. The game they are playing is not right and not fair. They can't continue to tell me it's approved then state it's not, then state it's approved again. I will lose the buyer soon and need Help. Please stop this short sale Yo-Yo. If they continue this behavior, I will lose my home.

Consumer Complaint: In XX/XX/2001 a court ordered Select Portfolio Services that I be removed from the mortgage XXXX XXXX XXXX XXXX, NJ due to divorce and the other party XXXX XXXX was to be the only one soley responsible for the mortgage. Select Portfolio Services replied that they don't take orders from a judge and that I would remain on the mortgage. I have since filed several appeals with Select Portfolio Services requesting that I be removed from the mortgage at XXXX XXXX XXXX XXXX, NJ XXXX each one resulting in Select Portfolio Stating that I will remain on the mortgage until the home is sold or refinanced with another company. During this time XXXX XXXX missed 20 mortgage payments, went into preforeclosure twice ruining my credit rating and increasing the amount owed on the home to {$170000.00} which was allowed by Select Portfolio Services. XXXX XXXX was also allowed to sign into a foreberance agreement where they allowed XXXX XXXX to refinance within Select Portfolio Services without my signature or without my consent. I explained that if I'm the primary on the mortgage this should not have been allowed. They explained to me that all they need is one signature and they can continue to offer any of these agreements they want despite the court order. This has been a 19 year ongoing situation. I have done all that I can legal do to correct this issue and I'm asking for assistance from CFPB with this issue. I will do whatever I can to help with the resolution of this issue by CFPB. We were misrepresented by the mortgage broker and by XXXX XXXX when this loan was originated. We have reviewed our loan with specialist in the industry and there was fraud on documents from the mortgage broker to the banks and forgery on loan documents and disclosures. Since this loan was originated this loan has been passed along from XXXX XXXX, to XXXX XXXX and now Sps mortgage inc. We also have checked with title specilist and Sps does not hold legal title on our home properly to foreclose on our home since title recording on purchase date and from all the loan transfers from bank to bank .The title chain is broken and not correct. We are victims of predatory lending and now we are stuck with a toxic loan, Due to all these greedy large banks and corporations trying to maximize profits on homeowners that got these toxic loans. We want to hold these corporations accountable for the problems you have caused to our family. We have tried to work with sps over and over to fix our toxic loan and it just seams to fall on deaf ears. We will continue to defend our home until there is a fix on our mortgage. Consumer Complaint: My mortgage is $XXXX and was transferred to Select Portfolio Servicing, Inc @ 8 months ago. I always split my mortgage into 2 payments $XXXX.I kept receiving calls from them and did not understand why! Customer service said 1/2 of my payment was returned.For the month of XX/XX/XXXX, I have attached copies of my payments paid by XXXX XXXX, including statements circled and showing my payments deducted. I reached out to XXXX XXXX and was informed that my payment did not return. Which I already knew because the funds were deducted. XXXX at XXXX , and I both reached out to the bank returns processing department and they also verified that the check did not return and I have attached copies of checks.Select Portfolio said the last check dated XX/XX/2019 was returned by my financial institution and mailed me a letter stating that they reversed the payment. (Attached)They did not want to accept what I kept saying.Finally I contacted customer service and got some sensible and was told to send copies of XX/XX/XXXX payments and statements. (Attached)The last call I received was XX/XX/XXXX. Select Portfolio have not fixed the mistake they made and I've been calling everyday. My mortgage is still outstanding. My credit report has Been notified that I'm passes 30 days late and my credit score has decreased.Today is XX/XX/XXXX. Select Portfolio have not fixed my account. They have requested my proof twice and I have faxed it over but everytime I call, I get the same bull. We are waiting for the credit department to fix it. I am awfully upset and already tired of this call center and plan to refinance soon as they fix my account. I want away from this place as fast as possible. Everybody working but no one know what's going on.I have enclosed copies of my mortgage payments for XX/XX/XXXX.$XXXXcleared XX/XX/XXXX (see statement)$XXXX cleared XX/XX/XXXX (see statement).Please assist by making this call center, not a real bank, post my payments correctly and accordingly and fix my credit report back immediately. Its does not take this long to adjust an account. My bank said they have no ideal, why they sent me that letter because they did not return that check and both checks were infact paid and there has been a mistake on their part. Somehow somewhere, someone has my $XXXX which was paid by my bank. I gave more than enough time for the cashier department to fix it especially after they said they received all the proof.
