Consumer Complaint: My Mortgage is currently serviced by Select Portfolio Servicing , Inc. ( " SPS '' ). SPS took over servicing of my mortgage from XXXX in XXXX of XXXX. All payments prior to XXXX of XXXX were made to XXXX, in full and on time. SPS is now trying to extort money from me, claiming that I have to also pay them for XXXX of XXXX, even though they didnt service my loan at that time. Naturally, I have already made that payment to XXXX. This has been an issue since the 4th quarter of XXXX. It took a couple of months for billing to get sorted out between the 2 companies and for SPS to begin sending me statements. After receiving 2 or 3 statements that inappropriately referenced the XX/XX/XXXX payment, I became concerned that the error was not going to be fixed without intervention. Therefore, I called SPS about XXXX of XXXX, perhaps XXXX of XXXX, and told them that I had already paid the XXXX payment and they needed to correct their records. At the time I spoke to SPS I had not yet conducted my own research to determine why the error had occurred, so I did not yet realize that SPS was trying to extort money from me that I didn't owe them. All I knew is that I had made all payments properly, on time and in full. The woman I spoke to was very nasty. She said that they were the ultimate decider of what had to be paid and if they decided they wanted me to have to pay the XXXX payment again, I would have to pay it again. She claimed that they would do an investigation and get back to me but that I should just make the payment again. I never heard any result of any investigation, so I am of the opinion that the nasty woman never set any investigation in process. After a month or so I realized that SPS was not going to fix the issue. Therefore, I contacted my mortgage company and told them that my money had been stolen by their servicer and asked them to please look into the crime and force SPS fix the issue. As with the servicer, I never heard anything back from the mortgage company. I am fairly certain no one even looked into the issue. I then did my own research and found that rather than a theft of my money by SPS it was an extortion attempt by SPS. Their efforts continue to this day and they are getting more and more aggressive. They are falsely reporting to credit bureaus that my mortgage is in arrears and they have denied me benefits and perks that are only available to people whose mortgages are in good standing. They are now stating that my mortgage is in default and are threatening to foreclose if I don't pay their extortion demands. As you are aware, this is not the first time one of this mortgage company 's service providers has criminally taken money from me. A prior servicer misappropriated 2 monthly payments that I sent by EFT and then used that as an excuse to assess servicing abuses against my account. You chose to do nothing, and the mortgage company chose to do nothing. I fought for nearly 10 years to get someone to do the right thing, and ended up paying over {$10000.00} plus almost 10 years of compounded interest out of my own pocked to correct the disaster that they made of my mortgage account. For that reason I feel this is an intentional attempt to extort money from me as they have learned from past experience that they will not be held accountable for even their negligence, much less for intentional criminal actions designed to steal from their customers. I deserve to be helped this time. I can't keep funding these terrible businesses that can not perform even the most basic functions required of them to be in business and that knowingly and criminally take money from their customer that is not owed.

Consumer Complaint: I had applied for a mortgage modification with Select Portfolio Servicing on XX/XX/2019. At the same time I was seeking information from two different banks as to whether I may be able to qualify for a refinance on my loan. There were some things i needed to pay off on my part to boost my credit rating in order to qualify and this took a couple of months. I stayed in touch with Select Portfolio to let them know what I was doing so as not to let them think I didn't want the modification. I needed that to stand in case the bank loans didn't work out. During the time I had forgotten to send my hardship letter as part of the mod request. I had until XX/XX/XXXX to get it to them. In a phone call to many Select Portfolio reps I was told that they would extend the time for me to get the hardship letter in since I wanted to see if the Bank loans would work out first. One representative even told me that they actually had one on file from a previous request and that they could use that. Eventually it was taking me more time to get my credit score where I needed it to be before the Banks I was seeking a refinance with would consider doing it. So I got my hardship letter prepared to send to Select Portfolio. I called and spoke to a representative on XX/XX/XXXX to get information on where I should send my hardship letter and was told that the modification was cancelled due to the hardship letter not getting there on time. I had previously spoken to a rep about it that XXXX XX/XX/XXXX who told it would be fine if I got it in on Monday. No warning that the modification request would be cancelled by then. I was misinformed by multiple representatives and i find that unacceptable. I am still trying to work with 2 banks to refinance but have a foreclosure date two weeks away on XXXX XXXX. I have disputed this decision by select portfolio directly with there Ombudsman Dept. and have gotten back no response from them and with a foreclosure date set in two weeks. I believe this foreclosure date should be postponed and I should be aloud to reapply for a Modification.

Consumer Complaint: XXXX XXXX XXXX sold my loan to SP Servicing in XX/XX/XXXX of this year. I received a loan modification in 2016 from XXXX XXXX XXXX due to a bad loan from XXXX XXXX XXXX. XXXX XXXX XXXX never FLAGGED MY ACCOUNT on none the Credit Bureaus as Modified Loan. But I NOTICED today once SPS finally began to report on my credit after waiting 3 months MY MORTGAGE ACCOUNT HAS BEEN FLAGGED AS A LOAN MODIFICATION. SPS did not do the modification they brought the loan. Further more without me or my husband even knowing now to report that way and bring down our Credit Score FLAGGING our Mortgage Account as a Modified Loan is totally unfair. We went thru that already years ago. To go thru it again with this company is totally unfair!

Consumer Complaint: Select Portfolio Servicing supposedly took over the Servicing of a purported mortgage in my name around XX/XX/XXXX. Select Portfolio Servicing ( SPS ) misled me by telling me I had to miss three consecutive monthly mortgage payments to be eligible for a loan modification after my monthly payments more than doubled and the housing crisis caused the value of my home to plummet to less than the amount I purchased the home for. Despite numerous applications for a loan modification, demands to see the wet ink note under MA law, attempts to resume monthly payments, Appeals, and more, I was put through such a nightmare of constantly submitting, resubmitting documents, dual tracking, unfair debt collection practices, and an unlawful foreclosure auction held on XX/XX/XXXX.on my property. SPS is a debt collector unable to foreclose on property. They are not licensed in MA, They have foreclosed on numerous properties in MA and are still in the process of foreclosing on other properties. They represented themselves to me as a servicer for a purported mortgage in my name held by XXXX XXXX, yet XXXX XXXX, XXXX. has no records of me. My original mortgage was two subprime mortgages with XXXX XXXX XXXX 100 % of the purchase price of the property with adjustable rate mortgages. One, with a balloon payment, which was not explained to me. XXXX XXXX XXXX XXXX went out of business around XX/XX/XXXX. Supposedly, my mortgage was transferred to XXXX XXXX, as trustee for XXXX XXXX XXXX, as mortgage backed securities XXXX without my consent. The recordings at my local Registry of Deeds on the transfer of assignments are signed fraudulently by known robosigners and are self-serving. These records are now being used against me in a Court of Law to obtain possession of my home and evict me. I am a XXXX widow trying to defend myself in a Summary Process eviction attempt. The XXXX and intentional infliction of XXXX XXXX thats been inflicted on me by Select Portfolio Servicing has created severe health problems for me causing me to miss Court deadlines and hearings. There are numerous issues of law involved including contract law, unfair debt collection practices, illegal securitization, illegal foreclosure and fraud.

Consumer Complaint: I filed a complaint against select portfolio servicing case # XXXX. My loan # is XXXX. What I am looking for is not a trustees deed. It is clear that it is a fraudulent. What I am looking for is the change in trustee documents. That should have been sent from XXXX XXXXXXXX XXXX to XXXX XXXX to make him trustee and sent to me letting me know of the change in trustee. XXXX XXXX XXXX says they never did the transfer of trustee because they were never trusttee. They open a file but it time d out because they never received the documents in the time limit set out by IRS. This says there was never a mortgage created. I know that was no Notary nor would I sign my name as XXXX XXXX. That is not what is On my divers license. So that means the documents are fraudulent. How these banks got these documents I have no idea. if they had a problem it was with XXXX not me. Please provide me with a certified copy so I can verify it with XXXX. As XXXX XXXX XXXX says they never issued the conveyance any of a transfer of trustee.This why I have no liens on my property. XXXX XXXX has committed fraud along with sps, XXXX and many others. Your Trustee Deed is a fraudulent. These people did a fraudulent foreclosure they wrote a fake writ to have remove from my property an all my property stolen

Consumer Complaint: I am requesting the assistance from CFPB to assist me with mortgage related issues I've been dealing for several year with my mortgage lender SPS. I am a few years past due and underwent a financial change that caused me to fall behind. I submitted a loss mitigation application package to SPS on XX/XX/XXXX. As of XX/XX/XXXX, SPS stated they had received all documents but were refusing to review me for assistance because their computer system had a Code ( SPSA restriction ) and per the agent I spoke to XXXX xt XXXX this code is at the request of the Investor not to allow any Trial modifications to happen. I requested for SPS to release the investor information so that I may call them to find out why they are restricting me from applying for help. In the last 7 years I have submitted for Loss Mitigation options at least 3 -4 times per year each time to get denied for several reasons usually SPS making up lies. In XX/XX/XXXX I applied for assistance from SPS to lower my interest rate but SPS placed me on a repayment plan that almost doubled my mortgage payment for the next 12 months and after those 12 months of payments I had to pay SPS a balloon of {$60000.00} in one shot which I told them I couldn't afford this but they insisted if I did not comply they would foreclose on my home, being told this I tried to make a few payments but eventually I could no longer afford this amount. Before I stopped making these payments, I called SPS to provide this information and they advised me if I could not afford it to stop making the payments and apply for mortgage assistance again. Keep in mind my financial did not support affordability for this repayment plan options. The rate I obtained on this loan is at 12.125 % on a single-family residence. I feel I was given a predatory interest rate since at the time I obtained this loan rates for the current market were at 5.25 % at its highest. SPS at this point are stating they have offered me several options but refuse to show me proof in writing, I have requested for them to provide the loan assistance options they claim they offered but they refuse. I have also asked to speak to a SPOC or manager never to get a call back. I feel that SPS is violation of several mortgage lending laws and per the reviews online I see I'm not the only one experiencing this issue. I ask for the CFPB to look into predatory lending, Failure to perform, Negligence, Violation of HRBOR, Tila & RESPA law. I am not alleging I don't owe this debt I am simply asking for SPS to help me reduce my rate so that I can continue to make payments on my loan. I have attached the loss mitigation application I've sent them for review so you can see I have provided all items needed to be evaluated and approved for assistance. Please help. Consumer Complaint: On XX/XX/XXXX Select Portfolio Services offered me a repayment plan with the following details : {$3300.00} for 6 months and {$70000.00} balloon payment. The 1st payment will be due on XX/XX/19. This information was provided by two representative of Select Portfolio Services, XXXX XXXX and XXXX XXXX who represented themselves as 'Supervisors '. However during this time that I was under review for a Hardship program, Select Portfolio Services was pursuing a foreclosure date of XX/XX/XXXX. I understand this is a violation of Federal Dual Tracking law that a lender can not pursue foreclosure while reviewing a homeowner for a loan workout program. Because Select Portfolio Services was illegally pursuing foreclosure for the next day, I was forced to file bankruptcy to save my home. Now they are telling me the repayment plan has been cancelled because of the bankruptcy. The bankruptcy I wouldn't have had to file if Select Portfolio Services hadn't violated Dual Tracking law. Select Portfolio Services currently has a sale date on my home for XX/XX/XXXX even though I am protected by Bankruptcy. They sent me a letter stating the home was protected by a 'Stay ' but have a sale date anyway. I understand this violates US Bankruptcy law as well as the Fair Debt Collection Practices Act. We were told this by Select Portfolio Services representatives XXXX XXXX on XX/XX/19, XXXX XXXX on XX/XX/19, and XXXX XXXX on XX/XX/19, all of whom represented themselves as supervisors. They refused to recognize there was an illegal sale date and simply told me they would look into it and get back to me. I never received a call from anyone at Select Portfolio Services.
