Consumer Complaint: XXXX, XXXX every other week for the month of XXXXXXXX XXXX thru XXXXXXXX XXXX, I was told Ten different answers regarding applying the {$1500.00} to my ESCROW account ; I was told several different answers each time I called, from it wasn't applied, I was short for my house payment, I sent the check to the wrong department, yes we have your house payment on automatic withdrawal from my Credit union account. We sent my Home Insurance Policy in ( 6 ) times, XXXX XXXX ( my insurance carrier ) sent the policy to you all four ( 4 ) times and we were told over and over again you all did not receive the policy. Three agent tried to really assist me and told me they would make the proper adjustment. Until Thursday, XX/XX/XXXX a young lady gave me a detailed explanation on my account. One young man was Intentionally RUDE. In addition, I'm on automatic withdrawal from my Bank account the XXXX of every month, however, you're not applying the funds until the XXXX of the month and charging me a late fee ; when it was your company that stated it's not late until after the XXXX of the month. So why am I being charged a late fee? Please be advised that my Insurance ( homeowners ) is on automatic withdrawal from my financial institution. I've told you all this since XXXX, XXXX Please leave my ESCROW and pay my taxes ; I will PAY MY HOMEOWNERS INSURANCE. The mental anguish I've gone thru for the last three months is CRAZY. I am a valued customer.

Consumer Complaint: The property was sold on XX/XX/2023. They were paid the final closing amount and the property sell was recorded at the register of XXXX office by attorney XXXX XXXX in XXXX, NC. XXXX XXXX continues to send me debt collection information. I have informed them the property was sold on XX/XX/2023 and they were paid in full. The sell of the property was recorded by XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX on XX/XX/2023 and select Portfolio was sent the closing payment. However, they still have not updated their records and I am now getting letters from XXXX XXXX XXXX, PA stating I owe them {$82000.00} for the mortgage of the property. Select Portfolio has been sent the final paperwork proving the sell of the property along with the final payment to pay off the mortgage XX/XX/2023. However, they are refusing to close out the mortgage debt and sending it to an attorney for additional fees and debt collection. I am completely fed up with them because once again they refuse to handle the account properly. Select Portfolio should lose their right to hold mortgage loans. They are absolutely horrible.

Consumer Complaint: To Whom It May Concern : I received the attached letter from SPS today. I am baffled and befuddled how this company can not correct the Escrow account? The letter sent is still INCORRECT. They have changed my property taxes to {$9000.00} and my property taxes are {$18000.00} PER YEAR? This is beyond frustrating. SPS is going to make us loose our home? And to top it off. I have been writing letters to them to correct the escrow account to reflect the correct annual property tax amount since XX/XX/XXXX an entire year. I have attached the property tax bill from XXXX XXXX XXXX and it clearly states {$9100.00} is due XX/XX/XXXX and {$9100.00} is due XX/XX/XXXX. This totals, {$18000.00} First and foremost the {$9000.00} amount is short {$390.00}? Second, based on this escrow analysis my escrow account will continue to be SHORT. By XX/XX/XXXX it will be short again. By XX/XX/XXXX it will be short again ..... Based on my complaint it is my contention that SPS should be liable to pay any shortage as they will not calculate my monthly escrow account correctly? I should not have to pay an additional shortage amount every month for the duration of this loan. IT NEEDS TO BE CORRECTED. IT IS NOT CORRECT. Is there anyway I can get a new servicing company because SPS is going to make me and my husband lose our dream home over property taxes? If, the property taxed are {$9100.00} two times for the year? HOW CAN MY ESCROW BE SET AT {$9000.00}? PLEASE EXPLAIN THIS TO ME? IT DOES NOT MAKE SENSE? FURTHER I AM REQUESTING THAT SPS BE RESPONSIBLE FOR ANY SHORTAGES AS THEY ARE NOT CORRECTING MY ESCROW ACCOUNT WHICH THEY ARE BOUND TO DO BY LAW. XXXX XXXX

Consumer Complaint: I am beyond upset that the SPS and or/ the investor of my loan has completely blown off any assistance in modifying my loan. It's blatantly wrong and unethical for SPS and/or the investor not to try to help work through the unfortunate setback that caused me to fall behind on my mortgage. The law firm that is assisting me submitted a complete loss mitigation application for me on XX/XX/2023. On XX/XX/2023, 2 days later, a denial letter was sent out. The letter gave no explanation of why it was denied for a loan modification. It just stated that I was denied due to not meeting investor guidelines. When my law firm asked SPS for the specific investor guidelines, they said they don't have them and don't know what they are which is completely unacceptable. It is obvious that the investor and/or SPS had zero intention of reviewing me for options to be able to keep my home. I was told by my law firm that when someone is denied for a loan modification or other options, there are reasons that are outlined in the denial letter, which is not the case here. They said there are certain things like too many previous loan modifications, debt to income ratio is too high, etc. None of these are true for me. I have a very large surplus of income now and have zero issues with making my payments going forward. I just need help getting the loan current through a loan modification. There is no reason I should not be approved for this option. I need to know all of the guidelines that the investor is using that is preventing me from getting the help that I need to get the loan current. I can afford my mortgage with no issues even if the interest rate were to increase to fair market rate. Thank you.

Consumer Complaint: On XX/XX/XXXX and XX/XX/XXXX I submitted payments for our XXXX property taxes, which were duplicates of the ones submitted by our mortgage servicer XXXXXXXX XXXX and then later SPS. The payments submitted by the mortgage servicer were refunded to the mortgage servicer by the county ( confirmed via email inquiry with XXXX ( XX/XX/XXXX ). After allowing for the transition period ( our mortgage servicer was transferred, not by choice ) and review by our servicer SPS, they claimed to have issued a check for the amount due to be refunded. We have opened 6 separate tasks which have lead to three separate escrow analysis all of which determined varying amounts we are due ( most recent XXXX : {$12000.00}. ). They claimed to have mailed checks multiple times, and then have remarkably been able to void them when we called to say they were not received. We requested they be sent via either certified mail, electronic transfer ( multiple options provided ), XXXX XXXX all were rejected. We have reviewed and confirmed our mailing address ( the same address which we always receive our monthly mortgage statements ) which is the same as the property in question. They have closed the tasks opened without resolving the issue and have provided no plans or strategies to resolve this issue. As it stands, they have held our funds for 8 months, and not seemingly in good faith.

Consumer Complaint: Select Portfolio Performance Servicing accepted my application for mortgage modification, a process I started XXXX XXXX. They repeatedly denied accepting documents they asked me to submit. I have since learned that my mortgage is part of an auction by XXXX XXXX for non-performance loans. My current mortgage agreement was constructed by my attorney while I was taking XXXX. I told him the final modification arrangement was not what we discussed before I signed but I was unable to prove it so I signed, with the expectation that when I recovered I could get a new modification with more favorable terms. My current mortgage only allows me to pay a percentage of the original loan plus the original loan, with principal and interest applied only to the percentage of the original loan, with the original loan amount ballooning. I am financially able to pay a modification of this mortgage. I have never been late in the 8 years since it was modified. Right now the way my mortgage is structured I cant get it refinanced because the property value is less than the outstanding balance. The Remedy I seek is to be removed from the NPL ( non performance loans ) pool so that I can refinance my loan. Select Portfolio Performance Servicing has not been acting in good faith but has demonstrated they are withholding giving me a fair underwriting determination for refinancing, that I have more than sufficient assets to support. What documentation do you require from me to assist you in reviewing my claim?

Consumer Complaint: on the XXXX of XXXX i got a call from a real estate investor wanting to buy my property, he said my house was scheduled to sell on the XXXX of the same month. the next day i contacted the mortgage company and they said they sent me a letter which I still have not received, they said they posted the documents on my from door, but nothing was attached to the front door. and I have XXXX ' tall gates .nobody can even get to my front door unless i allow them to.. I never got served nor did i get a certified letter nothing.. They won't modify my loan, so I applied for mortgage relief via government website and they are in the process of modifying the loan and the mortgage company told me twice that they won't postpone the sale date. I called the attorney and submitted a request to postpone, so i did explain the whole situation and submitted proof of my application with ca mortgage relief .org and the lawyer stated that they forwarded the email to the lender " for review ''. the lender says the attorney can postpone the sale, but then the attorney forwarded it to the lender as if they make the decision. I have $ XXXX plus of equity on this huge property and I feel as though the lender is wanting to be the owner of this property..

Consumer Complaint: As usual, Select Portfolio Services is up to shenanigans on my mortgage XXXX. I sent a {$2900.00} payment on Saturday, XX/XX/XXXX to their overnight address, which they received at XXXXXXXX XXXX on XX/XX/XXXX. I have proof from the USPS in the attached document ( Slide XXXX ). The U.S.P.S. confirmed the package was received on XX/XX/XXXX at XXXXXXXX XXXX. ( Slide XXXX ). So, THEY SHOULD HAVE POSTED IT XX/XX/XXXX. THEY did not. They are waiting for some reason. I pray to XXXX it posts XX/XX/XXXX and is back-dated to XX/XX/XXXX. This is unacceptable. I want the payment back-dated to XX/XX/XXXX, which is the day they received it. As I understand it, they HAVE TO DO THIS! IT IS THE LAW! This is a very important payment for me. The payment, by posting on XX/XX/XXXX, would mean that my mortgage was CURRENT as of XX/XX/XXXX and XX/XX/XXXX, with my next payment not due until XX/XX/XXXX. This is important because by making my mortgage current on XX/XX/XXXX, it resets the foreclosure clock that all mortgage lenders run. I know this because I was a XXXX XXXX at XXXX XXXX XXXXXXXX. But what I believe THEY are doing is trying to drag the posting of my payment into XXXX so you can claim I was never on time and keep the foreclosure clock right where it is! It is a DISPICABLE tactic! and they must be stopped. You can see in my attachment that the payment is posting effective XX/XX/XXXX ( slide XXXX ). This is one day late as they dragged their feet on posting the payment. You must fix this! Further, I want a SIGNED letter from SPS stating my mortgage was current on XX/XX/XXXX, and XX/XX/XXXX, with my next payment due XX/XX/XXXX. So, in the future, WHEN SPS tries to pull a fast one, I can throw their own acknowledgement letter back at them. I want this payment back-dated to XX/XX/XXXX XXXX, XX/XX/XXXX!
