Consumer Complaint: I have had many problems with Select Portfolio Services which bought the servicing rights in XX/XX/XXXX. Since that time, I have had an ongoing dispute with SPS regarding past due payments not credited and accrued interest and excessive escrow charges. SPS has never resolved this issue to date even though I have submitted documents and bank statements to prove this dispute. My problem with them now is that I have been making payments on the mortgage since XX/XX/XXXX and that was during a Covid-19 Forbearance which SPS was offering to borrowers beginning in XXXX and ending XX/XX/XXXX. I was not required to make payments but I did proceed to make payments and have continued to do so sinceXX/XX/XXXX. I filed a RMA Request for Mortgage Assistance in XX/XX/XXXX to which SPS responded stating that the only option they are offering is a deed in lieu of foreclosure. I responded disputing their offer. I am a senior citizen of XXXX years and my home is my only asset and I can not afford to lose my home. They have other options they can offer to me especially that I have been making payments on the mortgage account in good faith. Therefore I sent a dispute letter to SPS in response to their denial of mortgage assistance to me and their offer of a deed in lieu of foreclosure. I paid {$30000.00} to SPS on XX/XX/XXXX after requesting SPS to give me a repayment plan for my mortgage arrearages of which I am disputing the amount. SPS then sent me a repayment plan with a monthly payment of {$6900.00} more than twice the amount of my mortgage payment of XXXX. I told the Ombudsman Department IU could not afford this payment and requested a monthly payment I could afford such as {$4200.00} per month. SPS refused to grant my request and in XXXX, XXXX sent me a notice of default on my mortgage. Then with the advent of Covid, SPS offered me the above mentioned Forbearance agreement according to which I was not required to make payments. Despite this I did make monthly payments and have continued to do so since XX/XX/XXXX. I have been trying to raise funds to pay down the arrearage they are claiming of approximately {$98000.00} However I am disputing this because according to their pay off demand, the total in arrearage is {$72000.00} for interest and escrow arrearage. However they are claiming {>= $1,000,000} according to the current mortgage statement. Just yesterday XX/XX/XXXX, I received a call from SPS that my mortgage has been referred to an attorney for legal action. This is despite my making monthly payments. This is despite my relying upon the Forbearance Plan dated XX/XX/XXXX upon which am relying. I understand SPS referred my account to an attorney for legal action on XX/XX/XXXX three weeks after sending me the Forbearance Agreement a copy of which is enclosed. When I spoke with a SPS representative yesterday, I was told that the XX/XX/XXXX forbearance was sent in error and that SPS is retracting the letter. I am disputing this action as being unfair business practice and illegal because I was relying upon this Forbearance Agreement and have been making good faith payments on my account until I can come to an agreement with SPS on a home retention option. In addition, SPS wrote a letter dated XX/XX/XXXX, subsequent to their referring my account to an attorney on XX/XX/XXXX, inviting me to submit a RMA Request for Mortgage Assistance a copy of which is enclosed and to which I will respond to them by sending SPS an application for mortgage assistance. RMA/

Consumer Complaint: After the CARES Act, I filed for mortgage forbearance for 6 months ( XX/XX/XXXX ) from my service provider. That was a problem because I was initially told I did not have a federally backed mortgage, which was untrue, because my mortgage is backed by XXXX XXXX. Eventually, I received that 6-month forbearance after much back and forth, phone calls, etc. Servicer : Select Portfolio Servicing Inc. Loan Account Number : XXXX Select Portfolio Servicing , Inc . XXXX XXXX XXXX XXXX XXXX XXXX, UT XXXX Account Payment Select Portfolio Servicing , Inc . Attn : XXXX XXXX XXXX. XXXX XXXX XXXX XXXX XXXX, UT XXXX XXXX XXXX, Customer Relationship Manager, ( XXXX ) XXXX Ext : XXXX XXXX What is happening now : I requested by letter to my provider twice, XXXX XXXX and XXXX XXXX, XXXX ( as well as verbally on the phone ) to add an additional 6-month forbearance which the CARES Act provides me. On XXXX XXXX, instead of responding to that additional 6-month forbearance request, they sent me an " Assistance Decision Review Notice '' as part of a Loss Mitigation Program Decision stating that I now had a new payment and payment date starting XXXX XXXX, XXXX. The letter stating " Congratulations! You have qualified for and we are pleased to offer you a SPS Trial Modification. This program is intended to help you avoid foreclosure or other legal action. '' On XXXX XXXX, I sent an email to my relationship manager, XXXX XXXX ( XXXX ) as well as submitted multiple letters online re-stating my request for additional 6-month forbearance. It is not time to discuss what happens when the forbearance ends. My plan was to add the add the payments not made to the back end of my mortgage. The mortgage 's current principal balance is currently {$26000.00}. What I want : I want my servicer to adhere to CARES Act rules by permitting my request for an additional 6 months of forbearance. Consumer Complaint: My husband died XX/XX/2020. Lost a great amount of monthly income, approx {$4000.00}. XXXX XXXX XXXX with current " mortgagee ''. This company is in a " TRUST '', only modifications, no refi 's. Company is Select Portfolio Servicing. All docs were submitted via email attachments on timely basis ( dated ). On 1 document I received ( XXXX ) states my SS $ was HIGHER than direct deposit. I called, was advised once ALL payments made, a review of account AND income would be made. Loan mod proceeded with TEMPORARY monthly amount as I was advised. NO missed payments. Payments were entered ahead of schedule with confirm #. Upon completion of TEMPORARY payments, received NEW agreement with SAME AMOUNT DUE AS TEMP. No changes. One Rep told me the TEMP IS the NEW monthly amount. Numerous calls made ( documented-CSR name/EXT./time of call ) as to WHY an added 125 % onto my income? Had my Attorney ( paid him {$350.00} for 1 phone call to SPS Acct. Rep/no info ) SHE had NO answer. Finally got answer from another CSR. ALL clients are subject to this 125 % tacked onto GROSS income. This is fraud, in my opinion, as I do not make that amount of money. They are attempting to obtain more money from me. I DID NOT sign papers, received numerous calls after stating I was not accepting why docs NOT received. I am back on monthly auto draft with higher monthly amount. I feel I was not treated respectfully, especially by my Account Rep. Most of the CSR 's tried to help, but they had no answer. How do I proceed?

Consumer Complaint: I was on a trial modification with SPS back when covid hit. THey extended everyones payment dates and for a few months. I was able to make 2 of the 3 payments under this modification ( they always do a trial modification before a full modification ). I was not able to make the 3rd payment. It was due in XXXX. I was not able to make the payment in XXXX and I am not able to make this payment now. This is all due to covid. My daughter had a friend that was exposed to XXXX, so she had to quarantine for 2 weeks. As a result of this we had to as well. My wife was then later had a coworked exposed and then she had to quarantine and so did we all. I also had a coworker exposed to XXXX and most of my company had to go home and quarantine for 2 weeks. We never contracted covid, but this 6 weeks has put us in a spot. I contacted SPS and went over all of this with them, and they did not offer any help or even try to see about pushing the payment out further. We can make the payment, just not now ( I offered to set this up for XXXX and they did not accept it. ). We are paying on our utilities to keep everything on. When you miss 6 weeks of work, it is hard.

Consumer Complaint: My mortgage was sold while on a forbearance government program to SPS mortgage company. SPS initially failed to honor my forbearance program and a complaint was filed with the XXXX to get them to honor it. Fast forward to XX/XX/XXXX I get a call from a representative from SPS who tells me my mortgage was caught up until XX/XX/2020 from my forbearance program and that money was sent in by my county to cover the missed mortgage payments and that I could end my forbearance since my account was caught up. They took me off the forbearance program reversed the payments and then reported to my credit agencies as me being late. Basically they committed fraud and lied to get me To end my forbearance program :

Consumer Complaint: I was XXXX with XXXX on XX/XX/XXXX. I was in quarantine and I lose my job for three months. After I start working part time job. I can't pay my mortgage for : XXXX, XXXX, XXXX, XXXX and XXXX of 2020 I was enrolled in Covid -19 Payment Relief Program. On XX/XX/XXXX of 2020 Select Portfolio Servicing Inc. offer me a Trial modification Plan. was all payments successfully made. On XX/XX/XXXX they asking me for Flood coverage insurance Policy I summeted to them same thay. I called them next day to make sure if they received and they said yes we got it. Just wait we will call you if we need any additional information. I called back on XX/XX/XXXX and they said .... You need to summite to us a proof of your Flood Insurance Coverage. I faxed to them same day. I call back in couple days to make sure how is going my modification. They said everything is ok, we will call you. I call back on XX/XX/2020 they told me This case is CLOSED because you never submitted a proof of Flood Insurance Policy AFTER that they said the Insurance Coverage is not enough. My insurance agent called them and they see the coverage is enough is greater than loan amount. The mortgage Company told me they will review. On XX/XX/2020 I called them and they said this case is close. This company give me a hard time and I don't know what to do now. They denied my modification before I start. They have a plan to follow up and do your dirty business. Every time I call they have different stories. They are not transparent.

Consumer Complaint: It's XX/XX/2020. I have not received my XXXX Statement and My Payment is due on the XXXX. I did not receive my XXXX Statement until XXXX. I contacted SPS about previous late statements before XXXX. The Statements are still pushing the Payment Date real close. All I get for an answer is it's the Post Office. This is not my first complaint. In My previous complaint I addressed the late statements. They are still coming very late. God Bless, XXXX is wondering where the protection is.

Consumer Complaint: Select Portfolio Servicing erroneously processed a mortgage payment twice, which caused my checking account to be overdrawn. I called in to have it rectified. They told me to contact my bank. I called my bank and disputed the charge. The bank refunded my funds to my account and waived overdraft fee. Two weeks later. Select Portfolio put the charge through again, causing me to be overdrawn again. I contacted Select Portfolio to find out what happened. I was initially told. For return checks they automatically put it through twice. I responded, there was no additional payment posted to my account. How could this be ( my bank paid you. ) After speaking to a supervisor I was told the actual reason they submitted another payment request ( in the form of an electronic payment, though I DID NOT AUTHORIZE ONE ) was to offset a check they were going to send me. I explained the problem was previously rectified and there was no need to send a check. I was told it was already processed and once their corporate office sends them the check, they would mail it to me. Basically they illegally obtained funds from my checking account by submitting an unauthorized electronic payment request to cover their error.
