It then went into collections, and another company started calling my phone at least once a day to retrieve the debt. I had no agreement with this other company, LVNV funding, LLC. They then sent me a date for court. I sent them a letter to validate the debt that I was owed, and did not receive anything within 7 days. In the meantime I did not go to the court date, as I found work and couldn't afford to take the day off, as I was new at the company. I know have a court ordered judgment

Consumer Complaint: For the past one to two years, I have disputed and attempted to validate and verify the alleged debts ( account numbers XXXX, XXXX, XXXX ) that Resurgent/LVNV has listed on my XXXX, XXXX, and XXXX credit reports. I have sent multiple requests and Resurgent/LVNV has never sent any items that validate or verify the alleged debts. They have not produced a contract containing my signature. They have not produced any proof that I have made a payment in any dollar amount towards any of these alleged debts. They have not produced any proof that I made any payment arrangements ( verbal or written ) with Resurgent/LVNV. They have not sent a letter from the original creditor expressing written ownership rights of Resurgent/LVNV and my identity. The accounts in question remain on my credit reports despite them never having been verified by the credit bureaus and Resurgent LVNV never producing documents showing that these alleged debts are valid.

Consumer Complaint: This company is in violation of the consumer law. My personal information was sold in illegally used bye a third party. According to the consumer law, you are in violation. Code 15 usc 1692j states It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information. Except as otherwise provided in this subchapter, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title. A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option.

Consumer Complaint: I contacted Resurgent Cap Services on XX/XX/2023 via Certified Mail to dispute the amount they claim I owe as well as asking for verification of debt because I believe it to be wrong. I was not given the information I requested within the required time frame to validate the debt. Again, I believe the amount they claim to be wrong and after explaining and disputing for this reason they continued to contact me by phone to collect the debt as well as sending me additional bills in different company names such as, XXXX XXXX XXXX XXXX. I have copies of verification of debt request, debt validation letter, as well as copies of certified mail receipts. I also have copies of the bills I was sent in different names and copies of calls that were made to my phone after I had disputed and requested proof of debt.
