Consumer Complaint: Despite multiple CFPB complaints citing REAL laws, cease and desist orders, and identity theft reports, This company continues to email me and send me mail for a debt that is NOT MINE. I have proven per previous complains that the debt is not mine and that they are in violation of my rights as a consumer. The accounts are to be removed immediately and i want restitution for the damaged caused to my credit, being in non-compliance, and for the mental and financial stress this has put on myself and my family. My home currently has no heat and i have XXXX kids to take care of because i am unable to access credit that is rightfully mine thanks to the inaccurate reporting and NON-COMPLIANCE of this company. Negligence of the law is no excuse for your actions. Find the previous CFPB complaints. I'm not doing any more of your work for you.

Consumer Complaint: I recieved a letter from LVNV Funding aka RESURGENT regarding an XXXXXXXX XXXX XXXX account and I sent in a dispute letter to them on XX/XX/2023 stating this proposed debt was originally disputed with the original creditor. I sent them this within the 30 days validation of debt notice. On XX/XX/2023, LVNV Funding listed this disputed debt on my credit bureaus with an open balance. Under the FDCPA which governs collection this is a violation of my rights as they can not report this to a consumers credit under a dispute. I want this removed from my personal credit file. I have attached my original letter that was sent to them within 30 days of first notice along with an attached screen shot of my credit bureau showing the collection account and balance

They also violate my rights according to the Privacy Act of 1974 and HIPAA Laws. This discrepancy results in inaccurate reporting of the account in question.

Consumer Complaint: This letter is in reply to your letter dated XX/XX/2023, in response to my complaint dated XX/XX/2023. In my letter dated XX/XX/2023, I disputed the {$850.00} debt that you are attempting to collect. Additionally, I requested verification of the alleged debt pursuant to my rights under the FDCPA. With respect to my verification request under the FDCPA, I requested a copy of a signed contract. Additionally, I requested that you cease and desist all collection activity, including credit reporting. That is, I requested that you delete any and all reporting made to any consumer reporting agencies. You have failed to address my very specific legal requests and are in clear violation of the FDCPA. First, you failed to obtain and send verification of the alleged debt by not mailing me a contract. Instead of sending me a signed contract or agreement as requested, you forwarded copies of monthly credit card statements. Credit Card statements are not a contract or agreement and are nonresponsive to my verification request. Under the FDCPA, it is unfair or unconscionable to attempt to collect an alleged debt in any amount that is not expressly authorized by an agreement creating the debt or permitted by Law. Furthermore, the credit card statements do not verify nor confirm my personal information. Specifically, my social security number. I received a debt validation letter from the original alleged creditor, XXXX XXXX and as indicated in the attached debt validation letter the social number associated with the alleged debt is NOT my social security number ( last 4 ). I have attached a copy of your initial response, as well as the letter from the original creditor.
