Consumer Complaint: Over 180 days ago I wrote Resurgent Receivable in good faith by asking them to provide proof I owe an alleged debt to them as I have no contract or account with them nor did they have permissible purpose. I asked for a forward flow agreement between Resurgent and XXXX XXXX, files from the record keeper and aggregate value of loans purchased with purchase amounts. None of the demanded proof has been provided yet. I have fully investigated my rights in this matter. Under the doctrine of estoppel by silence, Engelhardt v Gravens ( Mo ) 281 SW 715, 719, I may presume that no proof of the alleged debt, nor therefore any such debt, in fact exists. Absent of such proof, you must terminate this collection attempt, and correct any erroneous reports of this debt as items may not appear on my credit report if they can not be supported by any evidence.

Consumer Complaint: This complaint is regarding account information below that has not been investigated and no information given. Its been over 2 months with no information given to me regarding these accounts. I have no knowledge of these companies and they shouldnt be reporting as I never gave permission for the reporting per Section 1681a -I sent correspondence to the Credit Bureaus regarding this. I was never notified in writing per 15 U.S.C 1692ag prior to accounts being on my credit report, within 5 days. Moreover, these accounts violate debt collections, abusive and unfair practices per section 1692f ( 1 ) adding additional amounts.

Consumer Complaint: I have never opened/been associated with an account with the alleged bank in which the collection agency CACH LLC has place my name and social security into their database. After doing my own research the dates where I had opened any type of accounts doesn't even match up with the date the collection agency has reported, so it seems the alleged account was re-aged because at that time I was XXXX XXXX XXXX to XXXX, which further leads me to believe it was a fraudulent account. I have never received a debt validation letter, never received a phone call, I never even seen the original creditor throughout any of my credit reports ever. Ive disputed this account several times seeing all sorts of issues for inaccuracies. I've seen this collection agency not update the status since XXXX which is weird because I've disputed, conflicting DOLA across credit bureaus ; something is just strange about this account. I've noticed that less than a year remaining this illegal collection will be removed from my credit report, so im not so concerned about it affecting me long term because I haven't had the need to use my credit so much, however I've decided to educate myself and clean up my credit report from any errors and possible identify thefts. This company has NOT verified or validated this debt and every time I dispute it, the false debt remains on my credit report as if it was validated but yet the last status date is from 5 years ago. Could someone please help because now I am annoyed. Where and who is the original creditor? when was this account opened? what account type is it? did someone falsify my signature? was there even a signature needed? why are there so many inaccuracies cross-bureaus? how did they verify this date to assume it was mine?

Consumer Complaint: In accordance with the Fair Credit Reporting, everything has to be 100 % accurate on my credit report. The Credit bureaus stated my account was properly investigation but how is that possible if the open date is inaccurate, the date last active is inaccurate, and date last reported is not accurate. This ground for removal. They also violated the law because according to : 15 U.S.C 1681 section 602 A States I have the right to privacy. 15 U.S.C. 1681 Section 604 A Section 2. It also states a consumer reporting agency can not furnish a account without my written instructions. The credit bureaus never did a proper investigation according to the FCRA. Listed accounts : The term investigative consumer report means a consumer report or portion thereof in which information on a consumers character, general reputation, personal characteristics, or mode of living is obtained through personal interviews with neighbors, friends, or acquainted or who may have knowledge concerning any such items of information. They did not do this!! Also, they have violated my rights even more. In accordance with the Fair Credit Reporting everything has to be 100 % accurate on my credit report. The credit bureaus stated my account was properly investigated but how is that? If the open date inaccurate, the date last activity is inaccurate, amount inaccurate, and date last reported inaccurate. This is a violation and grounds for immediate removal.

This is against the law for collection agencies to not only report false information, inaccurate information, inaccurate Missed payments, fraudulent information when buying these accounts affecting someones life. But reopening Charged Off, Deteted Accounts, with Misinformed missed payment history.
