Consumer Complaint: Resurgent is refusing to acknowledge that accounts XXXX and XXXX were opened as fraud. I did not open these accounts. A credit card statement isn't proof that I own the accounts. When these accounts were originally opened my XXXX year old son was the one that opened these accounts in my name without my knowledge. Therefore, I'm not XXXX my son. He's fixing to be XXXX and realizes the mistake he made. At the EOD I'm not responsible for these accounts nor did I ever use them cards. If I need to get an attorney I will in order to get these accounts closed.

Consumer Complaint: XXXX XXXX XXXX speaks to unfair and deceptive practices both RC/RESURGENT RECEIVABL and LVNV FUNDING and XXXX XXXX are on my report damaging my report reporting without my consent on multiple bureaus. They are in violation of the privacy act of 1974. Youre misrepresenting our relationship as if we have a contractual agreement. Ive never signed an agreement with any of the mentioned three companies And It needs to be removed. The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. Looking through all the complaints for these companies you are willfully destroying peoples lives and preventing them from obtaining credit and its not right. Your reporting late payments on collection accounts that people havent agreed to, your reporting balances and transaction history on reports which is illegal! Youre a for profit company whom understands the more debt the more mistakes the more you report the more money you make and youre taking advantage of 1000s of Americans. Below in the attachments you will see the violations and how willfully they non comply to the FDCPA, because they dont care to as you can see one photo states meets FCRA REQUIREMENTS which lets me know there was no real investigation done.. collections are governed by the FDCPA.

Under the Fair Debt collection Practices Act ( FDCPA ), I have the right to request validation of the debt you say I owe you. I am requesting proof that I am indeed the party you are asking to pay this debt, and there is some contractualobligation that is binding on me to pay this debt. This is NOT a request for verification or proof of my mailing address, but a request forVALIDATION made pursuant to 15 USC 1692g Sec. 809 ( b ) of the FDCPA. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you. Consumer Complaint: 2021 I was having medical issues with a XXXX XXXX XXXX and had problem making payments due to being out of work. XXXX XXXX offered a reduced amount that I couldnt afford. In return I asked for a reduced amount but paid in a monthly payment plan, to which the bank agreed. They wrote off the debt, closed my account and my access to it, and collected two months of payment. Then the bank stopped collecting my payments and wanted the charge off debt paid in full, not taking account of the payments Ive made. After reporting to XXXX, their claim was that my payments did not meet their original offer to which I never had agreed to. Every time Ive asked to have emailed or mailed copies of all the documents associated to my account and agreements Ive made, the bank refused. Ive called and emailed and still received nothing. Now after couple of years, they sold the debt to a collection agency, even though my debt has been wiped off my credit report and they never contacted me after my complaint to XXXX So now I cant get any documents from the bank and they refuse to communicate with me

My findings have determined that there are definitive violations of federal laws, specifically under the Fair Credit Reporting Act ( FCRA ). These violations are as follows : 1. **Inaccurate Date of Account Opening ( Definite Violation of FCRA 1681s-2 ( a ) ) : ** The account opening date is listed as XXXX This is factually incorrect, violating FCRA 1681s-2 ( a ), which requires furnishers of information to report accurate data. Inaccurate opening dates directly affect credit scoring and the duration of the account 's appearance on the credit report. 2. **Missing Original Balance ( Clear Violation of FCRA 1681s-2 ( a ) ) : ** The report fails to display the 'Original balance '. This omission contravenes FCRA 1681s-2 ( a ), which mandates the reporting of complete and accurate information. The absence of such crucial data misrepresents the debt 's nature and extent. 3. **Unlawful Debt Re-aging ( Violation of FCRA 1681c ) : ** The 'Date opened ' and the record until XXXX XXXX suggest an illegal re-aging of the debt. Consumer Complaint: An unauthorized auto-renewel for XXXX XXXX XXXX XXXX was charged to my XXXX XXXX account. Having a XXXX balance on this account, I wasn't aware of the charge until I received a past due notice. I called and spoke with XXXX XXXX and explained the situation. I paid for the " time used '' on the XXXX yr plan to date, and no longer had access to this XXXX service plan, but in the meantime it was turned over to XXXX XXXX I have gone round and round with XXXX, with actual reference numbers of phone calls and charges that I paid to XXXX XXXX and they will not drop this. This has been going on since 2019. XXXX told me " at this point, its about principal ''. I agree with them whole-heartedly, as I do not owe them any money because they stopped my service when I paid for the time used. Now it has been turned over to Resurgent Acquisitions where I can not actually speak to a real person. I do not know what else to do.
