Consumer Complaint: I am writing to file a complaint against LVNV Funding for violating the Fair Debt Collection Practices Act ( FDCPA ). 15 U.S.C. 1692 et seq. LVNV Funding has been contacting me repeatedly about a debt that I do not believe is valid. They have called me at work, at home, and on my cell phone. They have also sent me threatening letters. I believe that LVNV Funding is violating the FDCPA by engaging in the following practices : Calling me at inconvenient times, specifically at work. 15 U.S.C. 1692d ( 5 ). Sending me threatening letters. 15 U.S.C. 1692e ( 10 ). Trying to collect a debt that I do not believe is valid. 15 U.S.C. 1692g ( a ) ( 1 ). Consumer Complaint: Subject : Unauthorized Third-Party Communication and Cease and Desist Notice Dear Sir/Madam, I am writing to address the unauthorized third-party communication I have been receiving from LVNV Funding regarding an alleged debt originating from 12 XXXX XXXX XXXX XXXX. It has come to my attention that LVNV Funding is in possession of my personal information without my consent or authorization. I demand that all communication from your organization cease immediately, unless you are contacting me to discuss a remedy for the violations committed. I want to make it clear that LVNV Funding, as an unauthorized third party, has no lawful right to possess or disseminate my personal information. I have not provided any consent for your organization to access or utilize my personal data in any way. This unauthorized acquisition and use of my information violate my privacy rights and potentially expose me to unauthorized disclosure of sensitive information. Therefore, I demand that LVNV Funding immediately ceases all communication with me, including but not limited to phone calls, letters, and emails. Unless you are contacting me to discuss a resolution for the violations committed, any further communication will be considered a violation of my rights under federal and state laws. Additionally, I require LVNV Funding to provide written confirmation that you will no longer engage in any communication or attempt to collect any alleged debt from me. Failure to comply with this cease and desist notice will result in legal action to protect my rights and seek appropriate remedies. Should you wish to contact me to discuss a remedy for the violations committed, please ensure that such communication is in writing. I recently discovered that there is a fraudulent account listed on my credit report, which is being reported by LVNV Funding. The account details are as follows : Account Number : XXXX Account Type : Collection Account Status : Derogatory Date Opened : XX/XX/XXXX Balance : {$680.00} Payment Status : Collection/Chargeoff Last Reported : XX/XX/XXXX I have been a victim of identity theft, and I did not open or authorize this account. I hereby request that you launch a thorough investigation into this matter and take the necessary steps to rectify the fraudulent account on my credit report. I have already taken the following steps to address this issue : I have filed a police report with [ XXXX XXXX XXXX XXXX ] and have attached a copy of the report for your reference. I have contacted LVNV Funding directly and requested that they close the fraudulent account. However, I have not received any satisfactory response or confirmation of closure. In accordance with the Fair Credit Reporting Act ( FCRA ), I request the following actions : Conduct a comprehensive investigation into the fraudulent account and the associated information. Consumer Complaint: XXXX XXXX sold a car loan that was on my credit before the retention date was up, which was only a few months away before they sold it. I asked through written notification and electronic through all three credit bureaus, asking XXXX XXXX to send through Certified mail a verification letter showing the address and the original signature which never happened, they then sold the account to which I did the same thing sending LVNV Funding LLC written notice that I needed verification that these accounts are mine. I have continued to dispute this account since it has been to the new company with no avail. Each time they just verify the account through the credit bureaus automatic verification system and never sent me the information Im asking for I need these accounts deleted from all three of my credit bureaus immediately because I have disputed them time overtime overtime which each time be in 30 days I can no longer wait 30 days in these accounts need to be removed from my account immediately.

While, XXXX XXXX followed suit and deleted the account LVNV Funding decided to rereport the debt. Despite the fact i informed them this isnt my account im asking for a removal of this account.
