Portfolio Recovery Associates has provided information with XXXX XXXX XXXX and XXXX XXXX According to 15 U.S. Code 1692c - Communication in connection with debt collection ( a ) Communication with the consumer generally Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt. This company has been reporting false claims of consumers owing them money illegally.CFPB Orders Repeat Offender Portfolio Recovery Associates to Pay More Than {$24.00} XXXX for Continued Illegal Debt Collection Practices and Consumer Reporting Violations. The Consumer Financial Protection Bureau ( CFPB ) took action today against Portfolio Recovery Associates, one of the largest debt collectors in the nation, for violating a XX/XX/2015 CFPB order and engaging in other violations of law. The CFPB filed a proposed order today that, if entered by the court, would require Portfolio Recovery Associates to pay more than {$12.00} XXXX to consumers harmed by its illegal debt collection practices, in addition to a {$12.00} XXXX penalty that would be deposited into the CFPBs victims relief fund. Portfolio Recovery Associates violated theXX/XX/2015 order by collecting on unsubstantiated debt, collecting on debt without providing required documentation and disclosures to consumers, suing or threatening legal action against consumers without offering or possessing required documentation, and suing to collect on debt outside the statute of limitations. Portfolio Recovery Associates also failed to properly investigate and resolve consumer disputes about the company 's credit reporting. Todays action is one of many actions the CFPB has recently taken to hold repeat offenders accountable. After getting caught red-handed in XX/XX/2015, Portfolio Recovery Associates continued violating the law through intimidation, deception, and illegal debt collection tactics and lawsuits, said CFPB Director XXXX XXXX XXXX CFPB orders are not suggestions, and companies can not ignore them simply because they are large or dominant in the market. Consumer Complaint: I have been disputing this account with Portfolio Recovery for awhile now. I have sent debt validation and never got a response and I have disputed directly with the consumer reporting agencies and all they say was the account was verified but never showed any proof. For starters the reporting with the consumer reporting agencies is inaccurate.. So you mean to tell me that every time I have dispute this account you verified different information to each consumer reporting agency?? Sounds like a violation to me. Because everyone knows that anything reporting must be 100 % accurately and since each consumer reporting agency is reporting something different I know thats not right. Second, I never received a contract with me and XXXX XXXX or me XXXX XXXX and Portfolio Recovery. I never received an itemized statement from the XXXX XXXX account. I never received anything showing that Portfolio has the right to collect this debt. Now, I am demanding this account to be deleted from my consumer reports due to inaccurate reporting and Portfolio Recoverys violation of the FDCPA/

Consumer Complaint: To whom it may concern I sent a dispute letter to XXXX on XX/XX/XXXX via certified mail with a return receipt. Informing them about a XXXX XXXX account reporting inaccurate information on my credit report. XXXX XXXX was reporting a / XXXX account on my credit report that they sold to portfolio recovery associates LLC back on XX/XX/XXXX. Today XX/XX/XXXX I received a letter from portfolio recovery associates LLC stating that this account should have been deleted. XXXX refused to delete this account and constantly violated my consumer rights and just sending me generated responses letter. I need this matter resolved immediately because their the only credit agency that wont remove this & its causing me damage to my consumer report. I never gave XXXX written consent or permissible purposes to report any account on my consumer report.

I would ask who they are and why they were calling, but they wouldnt disclose any information about their company. They wanted me to confirm personal information before telling me who they were. They were rude and disrespectful when I asked why they used fake numbers. I had to confirm with the credit card company this was a legitimate debt that I owed. I have never had such an issue with a credit management company.

I want to see signed documents showing that I owe them money on their letter head saying I owe them anything, I have never borrowed any money from them nor done any type of business with them. Now they are saying I owe them money I have never borrowed any money from them, made any promises to them about {$2600.00}. Never signed any documents with them, I want to see documents that they say I borrow money from them owe them money with my signature on documents saying I owe them money or got some kind of credit with them. Show me documents with my signature saying I owe them money. They can't show me documents saying I owe them anything. Show me documents with their letter head and my signature saying I borrowed from them or done any type of business with them. This is all fraud.

Their conduct demonstrates a blatant refusal to adhere to both federal and state laws governing their operations. Moreover, they have repeatedly contacted my previous phone number, even after I explicitly instructed them to stop doing so. In a further intrusive and unsettling move, they obtained my new phone number from a list, seemingly with the intent to continue their harassment. To counteract their disruptive behavior, I have taken the precaution of blocking several of the numbers they employ for spoofed calls. Consumer Complaint: Portfolio Recovery Associates filed a lawsuit against me in XXXX State Court in XXXX of XXXX, without contacting me. When I found out about the lawsuit in early XXXX, I submitted a request to produce documentation and evidence supporting their claim, and I notified them that there had been a dispute filed by me against XXXX XXXX in the XXXX timeframe regarding " over-limit '' fees charged as a result of late fees that raised the balance above their own limit - in direct violation of the congressional CARD Act of XXXX. Portfolio Recovery Associates refused to provide the documentation I requested, and as a result XXXX State District Court Judge XXXX XXXX dismissed their lawsuit in XXXX of this year, XXXX. I submitted a recent dispute to XXXX when I found that the XXXX accounts were still listed as negative items in my credit report, but Portfolio Recovery Associates has denied the dispute, and continues to have a negative impact on my credit report, which has now resulted in continued damage and a rejected mortgage loan application. I now know that PRA has a history of doing similar damage to other individuals, that has resulted in action on the part of the CFPB in XXXX and early this year. If I would have known that earlier I would have contacted CFPB before the most recent action against Portfolio Recovery Associates.
