In his letter, he infers he sued me on behalf of PNC bank, this is false. I, first filed lawful suit against a XXXX XXXX XXXX dba PRESIDENT FOR PNC BANK NA, on XX/XX/2023, after 2 years sending numerous unrebutted, non-responded debt validation affidavits. My successful process of service affidavit delivery to XXXX on XX/XX/2023, for which XXXX XXXX is the lawyer who responded to my lawsuit .... EXHIBIT A : Service to XXXX XX/XX/2023 .... XXXX XXXX provided no answers to any of my claims, for deceptive debt practices and debt validation and instead had them dismissed in the Chancery venue action .... [ Deceptive Omission Perjury, XXXX XXXX ( HE ) failed to prove-debt within 15 days of receiving filing on CFPB as of XX/XX/2023. HE, by replying accepted to respond under the penalty of perjury. Non-disclosure, HE failed to provide the contract HE claims default evidence deeming the court intervention. Thus, perjury failing disclosure holder of certified original blue wet-ink signature Mortgage and note claiming in dispute because they dont have any contracts ]. HE/PNC ( They ) were not signatories to the original agreement. They can not satisfy the basic requirement of contract law that a plaintiff suing on a written contract must produce a signed contract proving HE is entitled to relief. Qualifies as a real party of interest, HE fails to mention the note the main issue of the CFPB investigation as to it being altered after closing without disclosure it being the source of the money funds used to payoff the property, it missing. The note and mortgage are inseparable ; the former as essential, the latter as an incident. Consumer Complaint: i had a bank account number : XXXX with pnc with about {$1000.00} in it, and for the last few months i have not been receiving my banking statements, and apparently pnc started charging me a $ 25 monthly fee just for having the bank account open. PNC has refused to waive the fees, and has charged me {$200.00} for doing nothing at al to even service the account. That is just an insane amount of money to take from someone to just have an open bank account, especially since i was never given notice about these fees

Consumer Complaint: I received funding to bring my loan current under a reinstatement agreement through the Equitable Retention Mortgage Assistance Program and a grant for {$95000.00} from the Homeowner Assistance Fund program, PHH received these payments from these programs on XX/XX/23. I have contacted my servicer weekly to ensure these funds were applied appropriately and they have not done so. As of XX/XX/23, PNC has not applied the funds appropriately. Further, they have threatened foreclosure action. They have been causing me difficulty for years as in not processing my payments correctly which has caused me a great deal of stress. I want something to be done to ensure this does not happen again to myself or to anyone else.

Consumer Complaint: As per the FCRA, I am entitled to a True and correct credit report, something I havent had for years since the Credit Bureaus have Repeatedly Failed to Correct the items or simply have not responded at all. I am becoming more and more disadvantaged as a XXXX person due to this. I have been deprived the opportunity to fully utilize or benefit from my true credit. Which is Unfair to me. I reached out to PNC Bank in the beginning of the Pandemic to let them know that my consulting contract was terminated for events scheduled for over a year due to the Pandemic Lockdowns. All Convention Centers Cancelled Events. I have Lates Reporting Throughout XXXX, XXXX, XXXX, XXXX Also. The Company Denied me assistance during the pandemic numerous times, but they seem to have reported to the CFPB in prior Complaint that they aided me with numerous forbearances and even supplied me assistance from XXXX. Which none of this was ever given to me during my Financial Crisis in the Pandemic. I had XXXX on XXXX occassions due to my children and mandatory quarantines. I was denied assistance during those time periods as well. Cares act gave the Creditor the Opportunity to Modify the Loan and Provide Assistance. The Creditor didnt do that. The Creditor also failed to Remedy Fraud which was found in my loan documents ( Payment was inflated almost {$200.00} after the automobile was delivered to my home ). I have submitted all documents in credit disputes with XXXX. XXXX and XXXX providing documents and Police and FTC reports confirming XXXX and XXXX. In addition to that was the Late Payments Reported During the Pandemic when I notified them Early XX/XX/XXXX and Continued to call and update my status being affected by the pandemic and they CONTINUED to not provide Assistance and Mark the Lates on my credit when I had no income and was on lockdown during the pandemic and my consulting events were cancelled well over a year which the creditor was made aware of numerous times. PNC Bank did not follow the laws Provided by the Pandemics Cares Act During the Covid-19 Pandemic. Calls can be subpoenaed where I repeatedly reported they were not compliant with the cares act during the Pandemic.

I have several cards that were lost not just this one and I'm still working to get my money back from all of my other cards. Please see attached police report and transactions in question. I have reported to PNC in XXXX as soon I noticed those transactions. I did not get the transactions highlighted credited back. I have reported them as fraudulent but they were never taken off my account or they have been rebilled. Please note the last valid transaction on this card should be on. XX/XX/XXXX XXXX XXXX XXXX CA {$1.00} ( monthly auto bill ) EVERYTHING after XX/XX/XXXX is fraudulent ( See highlighted PDF for the fraudulent charges ). Please help me reopen the case if there is still one pending. I haven't heard back from anyone from PNC so please email me and call me if possible. I am still in between moving and work traveling so rarely home. Pattern of spending is totally out of my character too. As well as I see a lot of those charges are in Florida! I was nowhere near FL when this happened.

How does consumer protection work?? Check Balances go up & down, many financial transactions are not processed the moment the transaction occur. Deposits, Transfers TAKE upwards to 24 hours or more to process. The electronic balance that is viewed online IS NOT the real balance, it's easy to overdraft, and if there are multiple transactions then feels are multiplied.

When BBVA turned into PNC, I was not able to access my account via the mobile app. So I decided to pay off the credit card and close the account. I paid off my credit card in XX/XX/XXXX. As told by one of their representatives, the account should have been closed after that payment. According to the representative I spoke with on XX/XX/XXXX, the account was closed but there is still a balance of {$10.00} that I was not informed of. I would like the company to waive that amount and close the account/claim for good.

Consumer Complaint: I went to the PNC bank on XX/XX/XXXX to deposit a check into my business account. The check was post dated for XX/XX/XXXX and therefore the teller instructed me that I can not deposit the check. I returned to the bank on XX/XX/XXXX and deposited the check along with another check into my Business account because it is a business account I am not able to cash checks I have to deposit them. XXXX days later on XX/XX/XXXX the bank deducted the amount of the check which was {$330.00} from my account and claimed it had already been deposited previously in XXXX but that was false. I have spoken with the branch manager, who filed the dispute on my behalf and the bank, denied the dispute with no reason provided. They are trying to claim that I cashed the check that day on XX/XX/XXXX but that does not make sense because it is a business account and that goes against their policy and the check was posted dated. There is no record of that happening in the accounts. I am filing this dispute because they are completely negligent, incompetent & careless In how they have handled this situation. I intend to take this to arbitration and or small Claims court. PNC blatantly stole money from account with no claims evidence or proof to justify there actions
