Consumer Complaint: On XX/XX/XXXX we contacted PHH mortgage due to taxes not being in full and the funds needing to be sent overnight. Our checking account with XXXX bank had been garnished and negative {$1200.00}. The full amount deducted was {$1300.00}. We contacted XXXX XXXX XXXX department to find out what was going on and then contacted the mortgage company requesting for the funds in the amount of {$1200.00} be overnighted to XXXXXXXX XXXX XXXX department. The first representative we spoke to tried to say that they had no one we could speak to so that it could be expedited. We insisted on speaking to someone to further assist. We were transferred to the escalation line and spoke to XXXX, explaining that the full amount of the taxes were not paid and additional funds were due for the taxes that were now showing delinquent. We emailed the tax bill that XXXX XXXX XXXX department provided to us dated XX/XX/XXXX. We were told by XXXX it should take one to two business days. The next morning we checked the accounts and the other checking account with XXXX had been garnished and was showing negative {$1200.00} on XX/XX/XXXX as the funds in the amount of {$1200.00} for XXXX XXXX XXXX department was being deducted. We called PHH again and told them that our other account has now been hit. We expressed again how important it was to have the funds expedited. XXXX XXXX said they sent PHH the full tax bill of {$2300.00} in XX/XX/XXXX. I did have the homestead excemption that unfortunately was removed as XXXX XXXX stated they did not receive my form to keep it. They said they sent 2 more tax bills that we did not receive that showed the remaining amount of {$1200.00} as PHH did pay {$1100.00} per the first bill they received in XX/XX/XXXX. We have explained this to PHH multiple times. They keep saying the taxes need to be verified. Two tax bills have been emailed to them. My daughter works for XXXX. This needs to be rectified as the taxes are escrowed and we have been negatively impacted by this. We called again on XX/XX/XXXX and were told they are waiting to hear from XXXX as they already paid the taxes and the taxes are showing as being delinquent. We know this, we sent them that info. The taxes need to be paid immediately as we have expressed. Please help. We have XXXX negative checking accounts and items that would have been paid have been returned. Thank you, XXXX XXXX

Consumer Complaint: Summary of my case : I. I refinanced my mortgage loan on XX/XX/XXXX. The mortgage monthly payment was 74 % of my monthly net pay. II. The closing took place on XX/XX/XXXX, but the alleged lenders attorney, XXXX XXXX, backdated the closing documents to XX/XX/XXXX, a week earlier, which completely eliminated my 3 days Right to Cancel. It was not until a year later that I discovered that TILA allows for a 3 year extension of the Right to Cancel and that the backdating, eliminating my 3 days to cancel, was a TILA violation. III. After 1 year and 3 months I could not keep up with the monthly payments. IV. The alleged lender filed foreclosure complaint. V. In Verified Answer on XX/XX/XXXX, I rescinded the refinanced mortgage loan. VI. The alleged lender ignored my rescission and continued foreclosure. VII. If they had followed the steps in TILA 1635 after my timely and valid notice of rescission, reversal to the status quo would have been easier. VIII. On XX/XX/XXXX, Judge denies their motion for Summary Judgement. IX. On XX/XX/XXXX, Judge denies their motion for Summary Judgement. X. On XX/XX/XXXX, a new Judge grants them Summary Judgement. XI. On XX/XX/XXXX, the new Judge granted them Foreclosure and Sale. XII. What I have that proves that we didnt close on XX/XX/XXXX is a HUD Settlement Statement that was signed by me and dated XX/XX/XXXX. Note that this was 4 days after the alleged closing date. Please see my attached formal written complaint to the CFPB and attachments A through J for the details of my case.

WHO KEPT ALL MY MORTGAGE PAYMENTS? VERY STRANGE. Please stop phh for foreclosing on me this XX/XX/XXXX. They sent notice of sale for foreclosure and I had a light XXXX and my XXXX hasn't stopped beating fast palpitating, yet. PLEASE STOP ILLEGAL FORECLOSURE. I would appreciate it if you will open my case, because phh mortgage services has no proof I didn't pay for 18 years. If this were true all those approximately 15 mortgage companies that flipped my house would have foreclosed on me years ago but XXXX I'm still in my home because mortgage companies banks told me many of my loan mortgage payments were lost, stolen or applied to other homeowners accounts. I mailed volumes of my payment receipts mortgage and all those companies said they would make copies mail back to me but when I inquired all companies said due to changing hands reorganizing workers loss movers threw away boxes of customers receipts including mine ; thus phh has NO proof I didn't pay. XXXX I paid. Company had class action suit. XXXX XXXX, Ocwen loan, XXXX XXXX XXXX all had charges from government. WHERE'S MY MONEY? Additionally, phh mortgage took over my loan around XXXX and are charging me with payments from XXXX to XXXX. This is wrong doings fraud misrepresentation. Please have my title deed issued to me. These companies banks are lying to steal my lovely home. PLEASE STOP ILLEGAL XX/XX/XXXX home sale ASAP. My heart hurts.

I had tried to reach someone at the XXXX but there is no live human being to speak to because PHH hired a third party company to do all the work through an automated system that doesnt even work. now i am submitting this complaint because PHH decided that they charge me {$300.00} and more for flood coverge when i already have it. it was renewed by my condo since XXXX. But PHH and this third party company is so incompetent, that they have thoroughly stressed me out and are now fraudulently charging me to flood insurance to which i already have. Please investigate this situation and charge the people responsible for this fraudulent attempt

Consumer Complaint: PHH has committed multiple errors. There is no dispute that the owners own the home. There is no dispute that PHH does not have title to the property. There is no dispute that the borrower filed a XXXX before the notice of sale as issued. There is no dispute that in Florida a notice of sale is required to complete a sale. There is no dispute that Florida is a judicial state. PHH is misclassifying the status of the property as XXXX when there is not dispute that XXXX is still in the name of the borrowers. Therefore this property can not be XXXX until the borrower loses title. PHH is causing the borrowers harm as well as injuries and preventing them from completing loss mitigation. The borrowers have a buyer who is willing to make an offer and PHH is preventing the resolution of the alleged debt. PHH has violated 12 cfr 1024.41 and 12 cfr 1024.35 ( b ) ( 11 ). PHH is therefore dual tracking by frustrating the loss mitigation process and moving forward on the foreclosure at the same time.

Consumer Complaint: XXXX ( first year paying taxes through escrow ), loan servicer sent us a refund check for the remaining balance in our escrow rather than pay the county we owed taxes to. Then, the taxes came out of the account and put us into a " shortage ''. XXXX Received our escrow analysis from XXXX claiming we were in a " shortage '' and that our payments would be increased from {$2200.00} to {$2300.00}. That would be an additional {$92.00} for the next 36 months to cover the shortage of {$3300.00}. XXXX XXXX XX/XX/XXXX Escrow Analysis arrives stating we are now short {$3700.00} ( MORE than last year 's shortage ) and our monthly payment will increase by {$150.00} a month for the next 24 months beginning XX/XX/XXXX. Brought our bill from {$2300.00} to {$2400.00}. XXXX XXXX received an email of the escrow analysis ( although we had received the one in the mail in XXXX ). The email contains a video presentation stating we are now {$5600.00} short in escrow and beginning XX/XX/XXXX our mortgage will be increasing to {$2600.00}. I reviewed our mortgage payment statement online. {$1000.00} a month goes into escrow. Our taxes every year are less than {$10000.00}. So if we are paying {$12000.00} into escrow a year, and taxes are only {$10000.00} ( which they haven't been that high yet ) ... why are we coming up SHORT? We are paying at least {$2000.00} extra into escrow. Why is our escrow shortage continuing to accrue a negative balance? And why does our mortgage continue to increase, although we are already paying to cover the shortage? Please help! We are paying what they asked of us to cover the shortage AND our taxes... where is our escrow money going? How can they keep raising our payment by hundreds of dollars when they did the analysis and established the money needed to pay off the shortage and we are gladly paying it? I am happy to provide all my Escrow Analysis documents from the first year we lived here. I can provide any information you need.

I had a valid policy for homeowner 's insurance through XXXX XXXX, and PHH decided that PHH would to pay it. That is a problem for me, because PHH will charge me more money than XXXX XXXX did if I paid it on my own. Now, the insurance company says that they can't talk to me, that I have to talk to the mortgage company. The mortgage company says that I need to call my XXXX XXXXXXXX Trustee, who has nothing to do with the issue of the mortgage company taking over my homeowner 's insurance policy without my request, and without talking to me.

Consumer Complaint: To whom this may concern, I am requesting assistance and oversight regarding the processing of my homeowner assistance application # XXXX ; my wife filed the application on XX/XX/XXXX With Texas HAF. PHH has refuses to process our homeowner assistance application unless we sign up for a family transfer package. I have declined PHHs family transfer package several times verbally and in writing, however PHH Insist there isnt anything else they can do. On XX/XX/XXXX I signed a third-party authorization form and submitted it to Texas HAF , who forwarded the authorization to the loan servicer PHH. On XX/XX/XXXX PHH informed me that they : 1. Havent received the third-party authorization form. 2.do not communicate with the Tx HAF directly 3. They require 30 business days to review the information. On XX/XX/XXXX Texas HAF is waiting on the loan servicer to respond. PHH Extended processing procedures are currently causing damage and hardship on my family. The assistance Tx HAF is currently offering would enable me to get in good standing and maintain the original payments. It has been 178 days since the submission of the application and PHH is now demanding i add my wife to the account by submitting and completing PHHs family transfer package application.
