Consumer Complaint: I received mail correspondence from PHH Mortgage Services on XX/XX/2019 enclosed with a notice regarding 'what does a company do with your personal information? ' On the lead mailing addressee sheet that was enclosed with the notice there is a 3rd party name in the addressee in addition to my name and my wife 's name. On XX/XX/2019 I attempted to resolve this issue with PHH Mortgage Services escalation department in the XXXX and XXXX XXXX, NJ as to why the 3rd party name is in the addressee for the documents sent to us. I have been put on hold for over an hour and a half with the PHH escalation department in XXXX XXXX, NJ only to have to leave my phone number to have them call me back. I have received no call from PHH to explain why there is a 3rd party name on the addressed documents. The 3rd party name on the addressee document is a known acquaintance to my wife and myself.

Consumer Complaint: THIS IS THE SECOND COMPLAINT. CFP just CLOSED a complaint based on a super flimsy 'reply ' after two months from PHH . I had Multiple complaint topics and PHH ONLY addressed the Property Tax Issue. I will CONTINUE TO RE OPEN UNTIL THEY MEET ALL FAIR LENDING PRACTICES. ~~ The Fraud company Only addressed One small complaint. We have called MULTIPLE times and have sent the form ( lawyer signed ) in to be Able to talk about our account. PHH Somehow never Receives the signed forms from the attorney that are faxed ( hmmm ). 1 ) PHH will not communicate at all about mortgage, nor answer any questions, even after forms sent. 2 ) I have written on every cashiers check to be applied Wholely to principal ( I have copies ) and they have not 3 ) There is a balance in Holding not applied to mortgage and PHH will not communicate about it 4 ) they have charged new attorney fees ( and we will not be paying attorney fees associated with their changes. But they keep adding things to mortgage 5 ) OCWEN forced us into bankruptcy by Refusing late pmts when job lost and Then after bankruptcy court came back and said there was money that had not been added into bankruptcy and added XXXX more in back fees ( don't care what your arguement on This ... it IS FRAUDULENT AND UNFAIR LENDING ). 6 ) Per bankruptcy agreement, all changes are suppose to go through attorney, PHH has sent nothing to attorney. I will not be making a payment that changed and not letting attorney verify it with sending them a written, certified notification. WE have been in continual contact with our attorney and now seeking Consumer Finance and XXXX to make PHH adhere. PHH can not arbitrarily assign fees and Back pmts due, not go through bankruptcy attorney, hold monies and not apply to principal, disregard my instructions to apply pmts to principal, and keep conveniently loosing paper that give us Rights to talk to XXXX company about OUR mortgage. Next step will be filing suit. We are tired of how they conduct 'business '. We already know the high rate of lawsuits because of Unfair Lending PRactices against Both Ocwen and PHH

Consumer Complaint: I have a VA loan. Has changed holders 3-4 times in the year we have had it. During the last transfer there was a lost payment. The company PHH mortgage withdrew the XXXX 2019 payment on XX/XX/XXXX. The loan was transferred to the new company XXXX XXXX around XX/XX/XXXX or so The XXXX payment has not been credited yet I have called PHH three times. During each call they first tell me that they rejected the payment. Then after conferring with a supervisor they say the payment was sent to the new company They have not provided any documentation supporting this and they tell me they will call me back with information which they have yet to to My account is listed a past due with the new company. I went and paid an extra payment to make my account current but I am still out a full payment.

Consumer Complaint: For the last 3 months, I have received a bill stating that I owe {$1300.00} and I have mailed in the payments in the form of certified check and send the payments certified with a signature to show the payments were received. Well with that being said PHH Mortgage states we are behind and we aren't. We are also in bankruptcy and we wouldn't be late because the company would foreclose on us. Our loan was changed over from Ocwen to PHH Mortgage and now it's saying our mortgage is with XXXX how confusing is this. A company that can't get their act together and has so many complaints against them but trying to mess a homeowner out of their home they have been paying for. Also, stating that a home that is only valued at {$24000.00} and the company pulls up these fake sites stating that the homes in my area are worth anywhere from {$50000.00} to {$250000.00} there isn't a home in my area that is worth that amount. Even the home next door with a tree that has grown through the roof and no one lives in the home because of its a run-down home with termites and all its not livable. But PHH Mortgage claims the home next door is worth {$46000.00} not possible at all. The area we live in is nothing but a run-down drug area and it's sad this company is trying to make something off people who are poor and struggle every day to pay for something that isn't worth nothing more than the value that the county states. It really upset me with all the mortgage companies being able to rip people off as they do. This company really seems like a scam without a doubt. I will be contacting a lawyer with this issue I'm sure I have a lawsuit. Also, our payments use to be {$400.00} and then they went up to {$440.00} and it wasn't supposed to stay at that but they have been getting an extra {$40.00} in a payment every month without anything showing where this is going. Bad enough Ocwen put us through XXXX now PHH Mortgage is doing the very same thing. I see that PHH Mortgage has had many lawsuits over the years. This started with Ocwen in XX/XX/XXXX and continued to be an issue this whole time. Now that my account was sold over to PHH Mortgage or XXXX in XX/XX/XXXX that is when the issues got worse to the point of them stating I'm late on my payments and not adding the payments that have been made and weren't late. I send all my payments with a certified check and a certified delivery with a Signature required so I know they got it. Before when I would call in it would say PHH Mortgage now when you call-in it says XXXX WHAT?? What kinda scam am I dealing with here nothing is right with this picture.

Consumer Complaint: I refinanced with XXXX XXXX on XX/XX/XXXX, funds received by PHH mortgage on XX/XX/XXXX and reconciled on XX/XX/XXXX. On XX/XX/XXXX I notice PHH continued to bill me for 2 months mortgage payments and reported to my credit that I Was now 60days delinquent. I called several times to PHH and continue to be put on hold with no one ever coming back. I was told by PHH that the funds had been returned to XXXX because it was short of the payoff they sent. I have all documents and the pay off was accurate yet PHH continued to bill me. All of a sudden I am now being told the funds have been returned to XXXX XXXX on XX/XX/XXXX. PHH held the funds for 6 weeks before returning them to XXXX XXXX. I am currently in a battle when all I wanted to do was a simple refinance and reduce my debt to increase my credit. At this point they have destroyed my credit and I cant understand how PHH could hold these funds for 6 weeks and not communicate with any of the parties involved for 6 weeks and continue to charge me daily interest.

Consumer Complaint: My loan transferred from Ocwen Servicing on XX/XX/XXXX to PHH Mortgage Servicing. At the time I agreed to a loan modification with Ocwen and made the 1st of three trial payments. The remaining two payments were collected by PHH. I tried on several occasions to pay online and was not able to do so, I was told it was due to not having all of the data file transferred. My payments were taken over the phone by an agent for XXXX and XXXX. I have not received any communication from PHH since I made the last trial payment on XX/XX/XXXX. I have called and checked online, even sent messages and have been told that the modification department is still working on my request. In the meantime I received two collection calls but both representatives I spoke to reiterated the thing as before, no further information. I called today XX/XX/XXXX to follow up on a complaint I made on XX/XX/XXXX regarding improper reporting on my credit. I spoke to rep ( XXXX # XXXX ) who refused to provide a reference number for my call. I don't know what is going on with this mortgage, I see property preservation fees ( indication of foreclosure ) however, I have received nothing in regards to the modification of the loan.

Consumer Complaint: Insurance check for hail damage included phh mortgage as payee. Check was sent to phh with the understanding that they would release funds to me and the contractor upon completion as verified by their inspector. I called for an inspection on XX/XX/XXXX and was told that the inspector will call me. The first time I called to ask why no one had called, i was told that the inspection company has 7 business days to respond and it had only been 6. Each time I called after that I was told that another inspection request had been sent. The people who answer the phones in the " Loss Draft '' department say they have no control over the inspectors they hire and can not give me information to allow me to follow up with them. It has been over three weeks since I asked for an inspection. It appears that phh is intentionally delaying the inspection so that they can have the use of my insurance money as long as possible. My contractor has the legal right to a late fee from me and phh would certainly assess a penalty if I was late on a payment to them. So I believe a fair resolution would include a late payment penalty comparable to what they would expect from me if I was a month late on a balloon payment of over {$42000.00}.

Consumer Complaint: THIRD COMPLAINT AGAINST PHH MORTGAGE SERVICES It has been over a month that my insurance company issued checks to repair my home from the Woolsey Fire in CA. We were declared a national disaster. PHH Mortgage has given me wrong and conflicting information regarding the Exception that WAS granted as evidenced by their letters dated XX/XX/XXXX and XX/XX/XXXX. A representative from their " escalation '' department also confirmed on XX/XX/XXXX that my checks had been returned to me and in accordance with this letters. However, she gave me wrong information and the checks arrived not endorsed by the bank today. You will see from the attachments to this complaint that on their online portal, my information ALSO reflects the Exception -- in that all I needed to do was complete repairs and do a final inspection. And now ... they had the audacity to send a completly contradictory letter a week later dated XX/XX/XXXX stating they want to hold my money, do their own process and are ignoring the fact that OVER 50 % OF THE REPAIRS ARE ALREADY DONE. This is added insult to injury. It is also causing severe economic damage to me and my family because I can not even attempt to go back to work until the inside of the house is completed. I need my insurance payments to do these repairs immediately. It is appalling that banks are allowed to get away with their lack of accountability! They need to honor their original letters from XX/XX/XXXX and XX/XX/XXXX!
