Consumer Complaint: In XXXX we bought a condo and used XXXX XXXX. In XXXX ( I believe ), PHH mortgage bought or otherwise took over servicing the loan. The condo is now for sale and has a contract. The Title search has revealed that PHH neglected to file the correct paperwork. This means we do not have clear title and can not sell the condo. This is beyond unacceptable. Further, I've been spending a great deal of time on the phone with their customer service team - including the so-called " Escalation Manager ''. These people refuse to help in any way shape or form. My contract is past due and at risk of falling through because PHH mortgage 's off-shore customer support team ( it's a stretch to call them " support '' ). I'm sure PHH would be willing to fix this problem if I ( or the Closing Officer ) could simply talk with the correct person. This is definitely a matter of gross negligence on the part of PHH. One would think that they would be more interested in fixing it.

Consumer Complaint: My principal balance was {$35000.00} on my statement for XX/XX/XXXX. When the loan was transferred to PHH the balance became {$50000.00}. My loan was modified back in XXXX with principal forgiveness of {$8700.00}. The unpaid balance was {$41000.00}. My mortgage payment is drafted each month on time. I have been current on my mortgage to this present day. I questioned the increase in my balance and was given a letter stating I had outstanding principal. They also mentioned I was assigned to HUD under their " Assignment Program '' and payments submitted were less than the contractual amount. I requested my payment history and that isn't true. Payments I made would have been sent to suspense if they were less than the contractual amount. I have not signed or requested any additional assistance from my mortgage company since XXXX. I have not received a legitimate reason for this increase. I don't want to be responsible for any servicing mistakes that may have been made 10 years ago. Thank you.

Consumer Complaint: PHH Mortgage owns the reverse mortgage on my home loan # XXXX. 1. PHH Mortgage unfairly receives excess interest on the loan by only accepting payments via mail. Thus by not accepting online payments, interest is charged for up to two weeks or more after a payment is mailed, unfairly limiting my ability to reduce the amount of the mortgage and unfairly benefiting from the excess interest income. 2. PHH Mortgage does not permit direct access to Customers Service Representatives who can answer specific questions related to accounting and or specific payments such as the status of a bank wire transfer. When I asked to speak to someone in the accounting office, I was told that I had to submit my questions in writing to the accounting department and they would get back to me. This practice unfairly discriminates against borrowers who do not possess adequate education and financial awareness to write clear and concise questions. Further, the practice discourages borrowers from being able to obtain timely information about their loan in the event of an emergency. Further, this oversight increases the length of time that mistakes and/or oversights in accounting are allowed to impact the borrowers loan.

Consumer Complaint: Continuation of XXXX In the forensic report the MERS : is yes at this time the status was changed after the report. Thank you very much for your very rapid and expedient response. Although you have answered all of my concerns in the previous letter, I am still not satisfied with the response being that PHH Mortgage can hold my {$55.00} ( which was a claim check from the hurricane damage to the property ) and claim that it belongs to them under Paragraph 5 which states because property was purchased through foreclosure. I did a forensic audit report on the property on XXXX of XXXX and it stated that XXXX XXXX , XXXX, Lender was a California Corporation was not a licensed corporation. It states, and I will attach a copy for you to review as well : The end result would be that the mortgage file, or any part thereof ( mortgage or security interest ), would not have legally been transferred to the trust to allow the trust to be considered a holder of your mortgage entitled to bring the foreclosure action, as they would not be a proper party before the court. You can read this information along with the rest of the report. This particular quote is on page 7. My question to you is, how is it possible for the mortgage company to acquire my property if the original agreement was obtained fraudulently according to the findings described in the attachment? All I am trying to do is keep my property and your company insist on fighting unnecessarily. This house has been in my possession for 30 years, and my familys possession since XXXX. I have described to you how much I would pay for the purchase of my property and that included the {$55.00} ( which was a claim check from the hurricane damage to the property ) which I believe to rightfully belong to me, bringing the amount again to {$210.00}. This offer was denied, that being stated again how can an illegal mortgage company sell something legal under illegal pretense? Consumer Complaint: In XX/XX/XXXX I had applied for a loan modification because I had fallen behind on my mortgage. I had contacted my mortgage company PHH and told then that I've fallen behind on my payments due to an injury that I sustained and needed XXXX. This process dragged on for several months until I was told that my case has been closed. I had reapplied for the modification once again and the process is still pain staking. I've been asked to send in the same documents over and over again. The frustration has gotten even more once I've found out that one of the mortgage rep. lied to me and told me that I, had a completed modification package. This phone call had taken placed on XX/XX/XXXX at XXXX XXXX and lasted 27 minutes. The rep. told me several times " I am looking at your package and it's stamp complete so you have nothing to worry about. '' It wasn't until I've called back several days later to get an update that I was told that I did not have a completed package. If I would have known that I didn't have a complete package I would've made a payment. Now several days later I'm 90 days past due. To make matters worst It was confirmed on XX/XX/XXXX that I had a complete package. Today ( XX/XX/XXXX ) I've called again to check my status and was told that it's still under review and that can take up to 30 days. I was told that I would need to pay 90 days of payment now. I've asked the rep. that if my account is under review could I wait until the review is over. I was told I can depending if my house is not in foreclosure. It's my understanding that if the mortgage company have a complete modification package and the modification is under review, then the can not foreclose. " No foreclosure can be instituted until 120 days have passed from the first delinquency. More importantly, if a complete loan modification application has been submitted to the the servicer by the 120 day point, no foreclosure can be begun. Reg. X 1024.41 " Can someone help it's been a nightmare dealing with this company. They quote is " We're here to help home owner '' I can not see that

Consumer Complaint: I was under a forbearance plan when my account got transferred to PHH Mortgage. I was told that no bad credit reporting and no late payment charges was going to take place while I was on the plan. When I got transferred I started to receive harassing calls and was told i needed to pay all my payments at once or go on a repayment plan right away. I was without a job and had no money to pay. I managed to pay for al the payments and then after a year PHH bills me for inspections and other fees when the inspection took place I was no longer behind on my mortgage. I demand that all those assessment fees be taken off my account or credited. PHH failed to follow my forbearance plan prior to the account transfer to them, they also failed to give me assistance and demanded I pay all my payments.

Consumer Complaint: I applied for assistance after my mortgage almost doubled causing me to fall behind. I hired an attorney to assist me in putting together an application for assistance. My attorney sent in my application on XX/XX/2020. After calling to see if they received it they are telling me I have to resend my bank statements and circle the rents I receive. I have already put check marks next to the amounts for rent. I applied previously and the same mortgage company kept saying they needed bank statements over and over after I had already sent them. It appears they are doing the same thing this time. Why would it matter if there is a check mark or a circle next to or around the amount I receive for rent is beyond me. In addition, my attorney called to discuss this with PHH and the person was rude on the phone and put my attorney on hold and left him on hold refusing to transfer him to an attorney. This company is purposely evading reviewing my application for assistance every time using bank statements as an excuse. According to my attorney this is a violation of RESPA Regulation X ( 1024.41 ).
