Consumer Complaint: Complaint details : PHH MORTGAGE SERVICER has changed their payoff quote several times because they alleged they overpaid the insurance premium. We sold the house and the title company wired the funds to PHH as of XX/XX/23. PHH never credited that they received the funds. They insisted that we pay them $ XXXX. They told us they would charge us attorney fees foreclosure fees etc if we did not pay immediately. The XXXX XXXX XXXX sent us the refund. Because of the confusion I submitted a complaint to the XXXX and PHH response letter indicated that they can not verify they overpaid the insurance and that I can claim the refund. They also said our account was not in foreclosure and that they admit no error. They advised by emailed letter there was an outstanding set of fees totaling {$170.00}. We immediately notified the title company and provided a personal check so the outstanding balance could be wire transferred. They would not confirm that the account was satisfied. The escalation department and customer service has advised us that we owe several different amounts. I do believe we are entitled to claim the insurance overpayment because according to PHH Website we owed $ XXXX but they made us pay $ XXXX so we thought that was them charging us for what they paid the insurance. I am requesting correction and that they abide by the letter that their research department has sent. We should not be charged anything above the amount demanded in the original pay off quote. We made the payments in good faith and we are not responsible for any errors or miscalculations. PHH held our funds for 30 days before returning to the title company on XX/XX/23. We need immediate intervention and I would also like them to immediately provide a lien release to us. The Title company attempted to send all the funds again this week and the funds were returned by the mortgage SERVICER.

Issue: Applying for a mortgage or refinancing an existing mortgage

Consumer Complaint: I will continue to open complaints about PHH and XXXX XXXX XXXX XXXX. XXXX XXXX XXXX is who REFUSES to modify our loan after covid layoffs. The bank kept sending paperwork that says " If you are struggling to pay, we can help you with modification ''. We applied 4 times and denied. This is fraudulent lending ( yet again ). When gyms and schools closed ( where we work!! ) And we had no funds coming in, and fell behind this time, they refused partial payments and said they would not apply and also refused modification. I am working with Texas Attorney General currently & submitting complaint to Dept of Savings and Mortgage Lending and also another organization that is looking into it ( that I will not name ). PHH ( XXXX XXXX old Ocwen ), who also had to pay us for class action lawsuit because of unfair practices, is purposefully not helping. I know they will send a rebuttal and you will " close the case '' in a few days, but I will have on record all the times we tried to get them to Help ( just by remodification, not a 'give away ', not lowering XXXX, JUST doing their job and remodifying while we were FORCED out of work by govt ). Posting this to both of your media websites and to XXXX XXXX XXXX NY. CFPB will probably help them sweep their responsibility under the rug, but everyone is going to know about it I notice XXXX XXXX XXXX XXXX is " currently not signed up to receive complaints through the system '' ( exact message I got ), which is very interesting and people will probably be interested in that since it is Them denying the modification. And I know that because an employee of PHH told me

Consumer Complaint: On XX/XX/XXXXXXXX XXXX XXXX XXXX I spoke to a representative at PHH and she stated that I had to submit one more document for Mortgage Assistance. I sent the required document at XXXX XXXX Yesterday I received a letter from PHH stating that you had not received all of the documents and therefore we could not get mortgage assistance. We are extremely confused. How can we be told one thing and then we are told another thing. We desperately want to keep the house but need assistance. We are slowly repairing the home meet todays standards. We have had many expensive items arise in the last 6 months that we have repaired. We have windows that are covered in lead paint that we were not aware of at the time of purchase. ( at least not to the extent we have found )

Consumer Complaint: I attempted to make my mortgage payment on XX/XX/2023, through my mortgage companys app. The app only recorded a portion of the payment, and failed to record the payment in full. I was notified on XX/XX/2023 from my credit bureau that the mortgage company reported a late payment to the bureau. At that time, I simultaneously called my mortgage company, and logged into my app and made another payment. The representative for the mortgage company requested that I email an appeal, explaining that the app failed to record the payment, and to request that the late payment be removed from my credit record. I did so. I recently received word from the mortgage company that they will not remove the reported late payment, even though I paid the proper amount on time, and their app failed to record it.

I have called multiple times requesting accountability on where escrow funds were going. i was told that i needed my attorney present. at on time in febraury of XXXX i had over XXXX dollars in escrow and now on my last statement it was XXXX dollars and saying that it is negative. i asked where this had gone and again i was told that i needed my attorney present. i was also transferred to several other people that also could tell me nor could they account where the money had gone. upon my own research PHH and OCWEN do not follow federal banking laws. ive been over charged on my escrow account for years. any help in this matter would be greatly appreciated, thank you XXXX XXXX

Consumer Complaint: Im in the tail end of a XXXX XXXX bankruptcy. All payments are current and the trustee has filed a motion to close the case and issue a discharge. The mortgage of course will continue. The last I heard the mortgage company PHH MORTGAGE was not cooperating with the court but was holding various sums in various suspense balances and not crediting the accounts as required! However the REAL issue is a hail damage claim from my insurance carrier XXXX XXXX who issued a {$25000.00} + check which I and my wife endorsed and sent to PHH as required. Weve since had our roof replaced at a cost of {$10000.00} and the mortgage company sent the check to a DEAD LAWYER in spite of being notified he died when my current lawyer enter his notice of appearance on XX/XX/XXXX NEARLY THREE YEARS AGO! Now Im in a pickle because I can not pay the roofer and PHH CLAIMS they have resent the check overnight mail to the current lawyer on XX/XX/XXXX yet he doesnt have it and PHH CAN NOT provide a USPS tracking number and if they were not lying YET AGAIN theyd know that number! I also have damage to my boat dock I can not even begin to think about repairs to because I know they can not be trusted to send me the insurance money I have been paying my premiums for so this dock which is now part of the mortgage after it was modified is being destroyed because the welds are broken and unable to be fixed. Ive addressed this with the lawyer and the mortgage company to no avail! Ive paid my XXXX XXXX payments on time and in accordance with the plan for 58 months yet have NOTHING to show for it because PHH is allowing this property to be destroyed!

Consumer Complaint: XXXX Mortgage XXXX XXXX XXXX XXXX XXXX, NJ XXXX XX/XX/XXXX I have been trying to resolve this matter for over a year. XXXX XXXX asked me to help reconcile his account and I sent an email to customer care on XX/XX/XXXX. The email I received stated that he needed to give written authorization, which he did on XX/XX/XXXX. He died on XX/XX/XXXX. No one ever got back to me. I was told that I needed letters testamentary to get any information regarding the account. The probate process is long, and I received letters on XX/XX/XXXX. I contacted them again on XX/XX/XXXX. Their response on XX/XX/XXXX stated that my information would be forwarded to the appropriate department for review and processing. It never stated they had filed for foreclosure. I sent another email on XX/XX/XXXX requesting information because I had not heard from the company, and I learned that the property was being foreclosed on even though it was still in probate. They never properly informed me on this matter. No timely information was sent to resolve the matter before it was sent to foreclosure. In doing my research a letter was sent to me and the deceased at his property address on XX/XX/XXXX giving him 30 days to dispute. However, 2 days later a foreclosure in XXXX XXXX was filed on XX/XX/XXXX even though they knew the property was in probate. Then a duplicate letter was sent to me at the deceased address on XX/XX/XXXX. This seemed like a bad faith attempt. All letters addressed to me should have been sent to my address. When I contacted them on XX/XX/XXXX this was within the XXXXday period of the XX/XX/XXXX letter, so a foreclosure should not have been filed. Their responses to me should have included the fact that they prematurely filed for foreclosure, so I do not feel that those fees are warranted. I asked for a waiver of the fees, and I never received a response to my request. The account was reinstated and I still have not received notice of cancellation of the foreclosure. I received the XXXX statement with assessed expenses of {$2400.00} and no explanation. When I called, I was told to look at the transaction part which had an assessed expense of {$100.00} for attorneys fees on XX/XX/XXXX but no other explanation. Customer service told me that they sent a reply to my waiver request to an XXXX XXXX XXXX instead of my office address or even the property address. It is unfortunate that no one is taking accountability for the multiple mistakes made in reconciliation of this account. No one seems to have any authority to give me requested information and correspondence is continually being sent to the wrong place even though my information has been given to you multiple times. Extra fees are still being added to the account.

Consumer Complaint: I have filed several complaints against this company. They have lied to you and you have closed the complaint instead of addressing the issue. Consumers are depending on government agencies to look out for their best interest. The information provided is inaccurate, but your records on your website is incorrect. The Prepaid principal should be {$170000.00}, however, your website shows something different. This was copied from your website : Your Loan Started : XX/XX/XXXX ; Your Loan Ends : XX/XX/XXXX ; Prepaid Principal : {$150000.00} ( a difference of {$24000.00}, Where is this money? What did you do to this money ) ; Prior Year ( XXXX ) Principal Paid : {$8200.00} ; Prior Year Interest Paid ( XXXX ) {$2100.00}, This is the discrepancy and the overcharge resulting in a negative amortization. The balance transferred from XXXX XXXX XXXX and not XXXX as in your paperwork to XXXX XXXX XXXX as you claimed was {$240000.00}. Note : I have a HAMP from XXXX XXXX XXXX then 2 years later another from XXXX XXXX XXXX XXXX which is missing from the documentation provided resulting in Improper Record Keeping. XXXX XXXX XXXX misapplied my payments. As a result, in XXXX and XXXX Deferred Principal Bal ( non-interest-bearing forbearance was bearing interest ). The account was not in default. An error on XXXX XXXX part put my account into default because of failure to maintain proper records. The New principal balance after the last ( third ) anniversary the balance should be {$66000.00}. All my payments have been up to date since XXXX, Are you saying that all my payments including the additional principals since XXXX ( XXXX years ) is only {>= $1,000,000}. In XXXX, my principal was {$820000.00}. That's where the discrepancy is? Thus the negative amortization which Newrez/C/o PPH Mortgage Services refuses to fix and correct their records and keep providing false information to your office.
