Issue: Struggling to pay mortgage

Consumer Complaint: Sometime in XX/XX/XXXX, my wife and I went into mortgage forbearance under the Cares Act of 2020. Our Mortgage Company, XXXX XXXXXX/XX/XXXX automatically granted us 3 months of forbearance. We extended it by another 3 months before XX/XX/XXXX and were scheduled to end our forbearance at the end of XX/XX/XXXX. Sometime in XXXX, I called my mortgage servicer, Phh Mortgage Services, to see the steps I needed to take to transition smoothly from a mortgage forbearance back into a regular mortgage and was told we would be put through a loan modification process that would involve 3 trial payments of {$2100.00} each for three months starting XX/XX/XXXX. We made all payments on time and in full with no problems but now we have a few issues with PHH Mortgage Services that they seem unable or unwilling to resolve. 1. Sometime between XXXX and XX/XX/XXXX PHH Mortgage Sevices reported our mortgage loan account as being in default to credit reporting agencies. This affected the credit scores of both my wife and myself in a big way. 2. The modified loan term that was sent to us increases our principal from its original amount by adding accrued interest over the period we were in forbearance. Escrow fees were also added. This increases our loan balance from {$360000.00} to {$360000.00}. 3. Our interest rate was increased under the new terms from 3.125 % to 3.25 % 4. It is indicated in the terms that after we sign, there will be more fees, costs, or corporate advances that will be added to our loan. 5. We have till XX/XX/XXXX to agree to these new and completely illegal terms under the Cares Act of 2020, or else we will not be able to get a loan modification. Basically, The terms from PHH Mortgage Services take my mortgage from a balance of {$360000.00}, an interest rate of 3.125 % with 29 years worth of payments left to a balance of {$360000.00}, an interest rate of 3.25 % with 30 years left to go. All payments made previously have been completely wiped out. With severely damaged credit done by PHH Mortgage Services so I am not even able to get better terms from someone else.

Consumer Complaint: My original loan was with OCWEN who transferred ownership of my loan to PHH on XX/XX/XXXX. My ex-wife was removed from my mortgage as of XX/XX/XXXX due to reorganizing the loan and her chapter XXXX discharge along with a quitclaim. The first year and four months PHH had control of the mortgage my ex-wife was still off of the loan, but around XXXX of XXXX they started putting her name back on everything. l contacted them several times about correcting it but they didn't. I n XXXX of XXXX I filed for a mortgage modification that was approved. I made the final trial payment in XX/XX/XXXX and am still making the regular payments for the modification. However, when they sent me the final modification documents they had my ex-wife 's name back on the mortgage. I did the same thing I did with the Modification application and crossed her name out and initialed it, signed and had it notarized. I sent the modification back to PHH along with the documentation from OCWEN ( OMBUDSMAN ) showing that her name was removed and why, along with a letter and all the details and asked them to forward it to their legal department. I also sent several emails explaining this and asking them to call me or set up a phone appointment to go over it. I never got a call, but they did send me another blank copy of the modification because the first was altered. The new one still has her name on it and I would be committing fraud by signing it. I have tried my best to get this corrected on my own and do not want to file a law suit, I just want the documents fixed. I can provide you with all of the documents upon request, including almost a year and a half of correspondence with PHH, bills etc. showing only my name on all documents until XXXX of last year. I don't know why they changed it, and they won't address it, but when they bought my mortgage from OCWEN they bought all of the details with it.

Consumer Complaint: My mortgage was sold to PHH Mortgage. They refuse to send statements, tax documents, or any documentation of my mortgage. They refuse to give me online access to my account. Each time I call to discuss the issue I am told a special agent needs to help me, that they are not available, and that the agent will transfer me to their voicemail. I called today XX/XX/XXXX and was told the same thing. They refuse to give me written notices of what I owe and why. I need help as they refuse to work with me.

Consumer Complaint: Not only did Ocwen XXXX us over for over a decade, so we also filed a complaint with CFPB due to their lies and demanding they fix the credit report. Instead of doing what is right, they purchased PHH mortgage, sold our mortgage to them, and still haven't fixed their wrongdoing. Ocwen needs to completely remove their account off of all three credit reporting agencies. PHH needs to update the account as we have paid in full on time every single month since they became our account holders. This is beyond ridiculous. We have found a lawyer who has successfully won litigation against them in the past and will be working with him. We have documentation to prove that they are liars and have unethical practices. These companies must be stopped and held to a higher standard. You would think that failing time after time they would be shut down for good. But instead, they pay a hefty fine and keep screwing people over. DISGUSTING!!!!!

Consumer Complaint: I have had a very difficult time with PHH. I have tried to submit for a loan modification a couple times. I was never able to communicate to the same person which always caused confusion. PHH always seemed to lose my paperwork, which I constantly had to re-fax. I fell behind in 2017 and had to file a bankruptcy to protect my self from this aggressive lender. I have paid them a lot of money to catch up. But PHH keeps adding fees and has been very difficult to deal with to resolve. I have recently been declined for a modification and feel is was not reviewed correctly.

Consumer Complaint: I applied for a refinance of mortgage that I have been paying on since 2017. The property once belonged to my deceased son, through probate court I became executor of the estate. The mortgage company listed my name on the monthly mortgage statements. On XX/XX/XXXX I applied online with the XXXXPHH Mortgage Services mortgage for refinancing of the two mortgages ( loan XXXX and XXXX ). I wanted to get just one mortgage at lower interest rate and backed by my VA certificate since I am a veteran. After receiving no communication from XXXX/PHH Mortgage Services, I checked the status of my loan application and it showed there was two tasks to complete but huge red bar at the top stating " inactive ''. There was no explanation why it was inactive or rather the loan was denied or what other reasons. This home has sentimental value to me. I wanted to assume or purchase it under my name as well as with my daughter as co-borrower.
