Consumer Complaint: Due to a job loss that occurred years ago, I fell behind on my loan and could not afford to reinstate it nor did I qualify for a loan modification because I did not have the income. I have been working for months to do a short sale with the lender and I am currently under contract with an offer but the offer is under review and we are not quite ready to close but the mortgage servicer is not wanting to allow the additional time needed so the that the buyer can close. I have met all requirements given by the servicer and I am in the process of moving out of the house to prepare for closing. At this time, I am a self employed individual and can not afford to deal with the repercussions of a foreclosure, when I am making a great effort to get the debt resolved and settled. It would negatively effect my business. I have provided all of my financial paperwork, settled with the homeowner 's association on the home and just need at least an additional 30 days so that my current buyer can close. I've been doing the short sale for over a year now and do not want my work to go in vain. I just want to get this settled so that me and my family can move forward. Please help me get this resolved, I do not want a foreclosure to affect my credit any further than it has already been affected.

Consumer Complaint: I received a XXXX XXXX XXXX XXXX which led to XXXX XXXX XXXX after my XXXX XXXX XXXX of almost 2yrs. It was towards the end that my Servicer was told by Bank to recall the note and STOP accepting payments which they did. I have an electronic trail of their rejection and receiving of my continuous months, years, decades prior. 18 years Ultimately, they did Foreclose, ( reason used was I ABANDONED my property while I still lived therebWAS ON IT. XXXX, Not XXXX XXXX, but my physical body was AND all they took my home. And sold it while I was in it the VERY SAME DAY a Tuesday. Sheriff came and New owners KEPT EVERYTHING I OWNED after living there over 18 years, including my pets! Putting me a XXXX person out on the street to walk away, me not knowing anything. As My immediate family had began to pass away a couple years prior to my XXXX XXXX, the rest of my immediate family at the onset of my XXXX XXXX, then up thru my first thru 6th quarters of my XXXX, XXXX, Leaving me all alone with no where to turn. It was only the fact I was on auto payments that they did not have a real cause to Foreclose. I had been on auto pay for everything because was most convient. I was raised by my grandparents but knew and visited regularly my biological parents as they began to pass first before my Injury. As I couldn't even think to go to my adopted parents funerals. As I was not only in shock but still in shock at this happening now almost two years ago. But now I am able to think and realize this has got to be wrong. They took my home and EVERYTHING I OWNED BY NEW OWNERS. I had valuable stuff as my extra homeowners insurance can show and I had EQUITY. I'm still basically out in the heat and cold waking up to a nightmare reality. PLEASE SOMEONE WHAT CAN I DO?

Consumer Complaint: The home was scheduled for foreclosure. I appealed the foreclosure. The foreclosure was set aside.There were two loans on the property totaling {$470000.00}. I did a loan modification. It was my understanding that both loans were consolidated in the modification. I have been making the payments as agreed for 16 years and am current in the payments. The public records still show the property as " foreclosed and bank owned XXXX ''. I recently listed the home for sale and the title search revealed that there was a second trust on the property. PHH, added XXXX XXXX 's name on the title. I have no knowledge about this second trust and need to get XXXX XXXX removed from the title so I can sell the home..

Consumer Complaint: I refinanced and took a cash out loan on my home financed with XXXX XXXX XXXX XXXX on which there was a loan remaining balance. My payment history was perfect and my credit scores with the three major credit reporting agencies ranged between XXXX and XXXX. I have spent a lifetime building that credit history. I am considered lower income, elderly, and XXXX, but have perfect credit. The closure on my refinance application was very short. I received coupons to make two payments on the loan, the first of which was due on XX/XX/2021 to my primary lender, XXXX XXXX. I immediately made the first two months ' payments. The checks were cash on XX/XX/XXXX by XXXX, as documented in attachments. Within days, I received a notice from XXXX XXXX that they had purchased my loan and assigned it to PHH Mortgage. I was assured that I had no tasks before me, that any payments would be automatically credited to PHH. I received those assurances from XXXX, PHH, and XXXX XXXX. XXXX refused to transfer the payments to PHH, and PHH refused to pursue the issue with XXXX. After complaints to XXXX XXXX and multiple email contacts with XXXX, PHH acknowledged receipt of the money from XXXX on XX/XX/XXXX, with the notation on my account that the payment was 22 days late. I was assured by all three agencies that my payments from XXXX to PHH by law needed to be transferred and credited when paid, and I had nothing to do whatsoever, that the process would proceed smoothly and without incident. I now have a fraudulent entry on my account and credit history. In addition, the principal should have been credited with the payments on XX/XX/XXXX, when tracking ( attached ) indicates the payments were deposited into the account of XXXX. I have a considerable amount of interest on the principal to which PHH has refused to credit my account. All of those issues have violated both my contracts and the law. PHH is an institution with nearly 1700 complaints before the CFPB. I did months of research before taking out a refinance, and skirted PHH because they have a history of fraud and have learned they can get away with it when they prey upon the elderly, the honest, those with XXXX, and the lower and middle class. XXXX XXXX is equally to blame for continuing to push business toward PHH, knowing that their intent is to engage in illegal and fraudulent business practices.

Consumer Complaint: This is my third complaint filed on PHH Mortgage regarding the same unresolved issue since XXXX XXXX XXXXThe amount of {$900.00} was to be released after mortgage payoff with PHH Mortgage XXXX XXXX. PHH mortgage claimed they mailed a check for this amount on XXXX XXXX XXXX I have not received that check. I have repeatedly contacted PHH Mortgages Customer Service and Research Department with no resolutions to this issue as detailed in my two previous complaints : # XXXX-XXXX filed XXXX XXXX and # XXXX-XXXX filed XXXX XXXX. These complaints are attached. PHH Mortgage claims in their response to have sent three checks. I have received none of them. I have attached PHH Mortgage last response dated XXXX XXXX. PHH MORTGAGE claims to have overnighted a check via XXXX tracking number is XXXX. ( The XXXX number should start with a 1 not an I ). PHH MORTGAGE did not state what address it was sent to. I have attached a screenshot of the XXXX tracking number. It also does not show an address of where it was sent/delivered. I have provided my current address to PHH Mortgage numerous times. My current address is listed on my complaint. You can see on the attached response from PHH Mortgage it has my current address. To be clear, I have attached a document providing my current address. Again, I have attached a document stating my current address My escrow overage check needs to be mailed to my current address. This is NOT the exceptional customer service PHH MORTGAGE claims they strive for. I have been beyond patient in trying to resolve this issue for two years! I have attached all supporting documents for this complaint.

Consumer Complaint: PHH Mortgage claims to be the current holder of the first mortgage that is on my property, with a company known as XXXX. PHH Mortgage offered a loan modification program that includes " forced placed insurance '' and property taxes. The issue is I have had insurance the entire time I've owned the property and have supplied both PHH Mortgage and their attorney, XXXX XXXX, a copy of the insurance that is more coverage than their costly " force placed '' version of insurance. They refuse to remove it from the payment amount, instead claiming they would " deny '' another modification and would " review it '' at the end of the trial period. The next issue, I am an XXXX XXXX and have an active property tax exemption. PHH Mortgage is literally requiring payment for something I have went to court about and dealt directly with the treasurers office. There is no " escrow '' for taxes I do not even have to pay.

Consumer Complaint: I refinanced and PHH Mortgage purchased the loan. I placed myself on autopay, as I have done for every mortgage for the last 15 years. PHH asked me to mail in something to place me on autopay, which I did and my autopay started. PHH mistakenly removed me from autopay. I found out and made several calls, all to which they advised nobody was available to discuss this with me. On one call in the beginning of XXXX, they said there was nobody that could answer the phone at all and to try back another time. I have had nothing but trouble with PHH Mortgage. They did not disclose the problem with autopay until XXXX when they reported this to the credit bureaus and my scores dropped from the XXXX XXXX to the XXXX XXXX. I HAVE NOT RECEIVED A SINGLE LETTER FROM THEM OR I WOULD HAVE DEALT WITH THIS IMMEDIATELY. THEY WILL LE AND SAY THEY DID BUT WHY WOULD I BE DISHONEST? WHY WOULD I RUIN MY CREDIT IF I CAN ABSOLUTELY AFFORD TO PAY MY MORTGAGE??? I am about to lease a new car and sell this property and now I can only sell my property. I can not rent because of the credit score that PHH mistakenly reported was late. The mistake was on THEIR END. I have never made a late mortgage payment, ever. They even agreed to waive the late fees I already paid to bring my account up to date. This is clearly an admission of their mistake. They have still failed to advise the credit bureaus of THEIR mistake and this has impacted my life terribly. THIS EXACT SAME ISSUE OCCURRED IN XX/XX/XXXXWITH PHH!!!!!!!!! On XX/XX/XXXX, I called PHH AGAIN! at XXXX. I spoke to someone to explain the problem again and asked for the escalation manager. This was at XXXX XXXX. After holding for 9 minutes, someone came on the alone and said there was a bad connection and disconnected me!

Consumer Complaint: Okay, here we go again. So on XX/XX/XXXX Ocwen changed the name of the fake insurance they paid from XXXX to XXXX. They did this to hide the scamming. So let me enlighten you by attaching it. Just scroll to XX/XX/XXXX and wow what do you know-fraud. Neither one of these insurance companies exist. Ocwen would purposely not pay your insurance on time and then force their insurance down your throat. Don't believe me? No worries I will prove my point. Click on the attachments and read what the insurance agents had to say. I have been waiting since XX/XX/XXXX and it's XXXX/XXXX/XXXX for the checks we were charged for. Sure is taking a long time to send that proof over. Why do you refuse to send these XXXX? You keep sending me letters that I am not being clear about my complaints. You sir are the one that writes inuendos and refuses to supply the information requested. You state that it is just a waste of time and so many emails. Maybe XXXX you would not get so many emails if you would send the information over. How many times do you need to be asked? So I guess the XXXX complaints online and the numerous lawsuits are all make-believe? Quit telling me I can not contact my mortgage company. You do not have that right. Your 2 months of knowledge does not justify you know the logistics of this XXXX loan. So email me what I have asked for instead of the same bs.

Consumer Complaint: We had asked for a Loan Modification with PHH MORTGAGE XXXX and I sent in everything for it on XX/XX/XXXX and just spoke to a representative on Wednesday the XXXX and they are still charging late payments and also sending it to the credit bureaus when we were under a forbearance plan due to XXXX! My wife is recently diagnosed with XXXX XXXX and XXXX and XXXX due to her having XXXX last year! PHH MORTGAGE ALSO REFUSED TO PUT US ON ANOTHER FORBEARANCE EXTENSION. We had only been on a forbearance since XXXX since we made our mortgage payment for XXXX. They have had multiple lawsuits against them due to this same problem! And I have sent multiple emails to the company and they have yet responded back when we asked the first time about the forbearance extension.

I have no proof where my money is being applied. Or the remaining amount on the mortgage.
