Consumer Complaint: The borrower experienced XXXX ( XXXX ) XXXX infections from XXXX through XXXX. After each XXXX XXXX the borrower struggled for periods in excess of one ( XXXX ) year with XXXX. The borrower has XXXX and his symptoms include processing nominal levels of light and sound as physical pain. The borrower manages his XXXX with a combination of medications, XXXX of which has been in sortt supply since XX/XX/XXXX and now affects the class of medications used to treat ADHD. The combined pathology of long-COVID and ADHD qualifies the borrower as an individual with a XXXX under the ADA ( 28 C.F.R. 36.105 ). The nature of the disability renders the borrower unable to write, speak, think, or communicate. The borrower and a coborrower took out a private student loan in XXXX with XXXX to pay for the borrower 's education expenses. The coborrower is now in their nineties. In XXXX XXXX XXXX acquired XXXX and the loan was transferred to XXXX XXXX XXXX. XXXX XXXX exited the student loan business and sold its loan portfolio in XXXX to XXXX XXXX XXXXXXXX, which is serviced by Firstmark Services. For the period XX/XX/XXXX through XX/XX/XXXX Firsmark sent multiple billing statements and payment reminders to incorrect addresses. The borrower made several attempts to correct the address information and notified Firstmark of the billing errors. FM acts or practices allowed cascading skip-tracing to occur from XX/XX/XXXX until XX/XX/XXXX, causing multiple payments to be reported late because statements were not received by the borrower. Those statements were instead mailed to addresses where neither the borrower nor coborrower receives mail. Consequentially, Firstmark furnished payment history to the CRAs indicating late payments by up to sixty ( XXXX ) days covering the period XX/XX/XXXX through XX/XX/XXXX. The borrower requested relief from Firstmark to include removal of the derogatory payment history spanning XX/XX/XXXX through XX/XX/XXXX because it is false/incomplete/inaccurate/misleading. Firstmark has declined to offer relief alleging no basis in law to cease its normal servicing practices. Firstmark has continued to blame the borrower for the billing errors alleging he did not contact them to let them know the addresses were invalid. The borrower has notified Firstmark of the incorrect address information in complaint filings to the CFPB. The borrower has found an e-mail from XXXX XX/XX/XXXX that shows Firstmark knew the address they were mailing statements to was not an address at which the borrower receives mail. Each of Firstmark 's written responses to the CFPB complants have instructed the borrower to subject himself to additional pain by enrolling in electronic statements so that the borrower may counteract any of Firstmarks future billing errors. On XXXX XX/XX/XXXX, a Firstmark representative asked the borrower if he would be interested in a Release Authorization Form. The representative explained the form would allow a designated individual to discuss the status of his account to include updating address information, and payments due. At no point did an agent of Firstmark inform the borrower the form existed before XXXX XX/XX/XXXX. Firstmark Services is a covered person and is subject to the CFPB 's enforcement authority ( XXXX XXXX. XXXX. XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX ( XXXX XXXX. XXXX XXXX, XXXX ) ). The payment history furnished by Firstmark to the XXXX from XX/XX/XXXX to XX/XX/XXXX is a consequence of Firstmark 's own unfair ( 12 U.S.C. 5531 ( c ) ), deceptive ( 12 U.S.C. 5531 ), abusive ( 12 U.S.C. 5531 ( d ) ), unlawful ( 12 U.S.C 5536 ( a ) ( 1 ) ( B ) as covered person, 15 U.S.C. 1681e and 15 U.S.C. 1681s-2 as data furnisher ), and discriminatory ( 28 C.F.R. 36.105, and 42 U.S.C. 12182 ( b ) ( 2 ) ( A ) ( ii ) ) acts or practices. This action by Nelnet Loan Services is a clear violation of the Family Education Rights and Privacy Act ( FERPA ) of 1974. The Family Education Rights and Privacy Act ( FERPA ) safeguards educational records, encompassing a wide array of information, including but not limited to grades, transcripts, disciplinary records, and personally identifiable information ( PII ) directly linked to a student. Transaction history pertinent to educational loans or financial matters, although not explicitly outlined in FERPA, falls squarely within the realm of protected information due to its direct association with the educational journey and financial status of the student. As custodians of these records, Nelnet Loan Services is bound by FERPA regulations. However, they have egregiously disregarded these regulations by reporting transaction histories to consumer reporting agencies without obtaining my explicit consent, thereby breaching the privacy rights guaranteed under FERPA. Moreover, the Privacy Act of 1974 supplements FERPA by regulating the collection, use, and dissemination of personal information by federal agencies. I am seeking not only accountability for Nelnet Loan Services ' actions but also compensation for the financial damages and emotional distress incurred due to their illegal reporting activities. Consumer Complaint: The accounts in question ( Dept of Edu/Nelnet ) all transfered to XXXX in XX/XX/2023 ( Please see Transfer Letter and XXXX Payoff and XXXX Balance attachments ). However, although Nelnet shows a {$0.00} balance, they have not closed the accounts or reported them to XXXX as paid off, so my credit report shows the same amounts for both Nelnet and XXXX ( see XXXX attachment ). The Nelnet accounts show as open and 0 % paid for each amount and this has already negatively affected our credit and ability to get a better car loan. I filed a dispute with XXXX in XXXX, but they resolved that we must contact Nelnet because the accounts are still open. I contacted Nelnet on XX/XX/23 and was told that nothing can be done because their bank has a " credit suppression '' hold. This is unacceptable. The accounts, by law, have to be closed and reported to all three credit agencies, including XXXX, as paid in full and closed. Nelnet refuses to take these rightful actions.

Consumer Complaint: I requested a refund for the student loan payments I made during the COVID pause. I only received 3 payments back. I called Nelnet to make sure they sent all of my records for my payment records. My loan was transferred from Great Lakes to them during COVID and they have the records of all my payments for the last 5 years. They said that they sent my Great Lakes record of payments as well. I received checks for 3 of the payments dated XX/XX/XXXX I did not receive a refund for the other payments I made. In XXXX, I called and spoke to a representative that told me that they also sent my payment records from Great Lakes since my loan had been transferred and I should be receiving my refund shortly. I called again at the end of XXXX and asked for the representative to re-send the request because I still had not received my refund for all the payments. It is now almost XXXX and I have yet to receive that refund. I have attached the documentation.

Consumer Complaint: I applied for public service loan waiver when that went into effect and sent all of my paperwork in to fedloan who was in charge of pslf program. I was pleased to find out I qualified for the forgiveness and had made 159 qualifying pslf payments. My 120 payments ( 10 years worth ) according to fedloan would have been done on XX/XX/XXXX ( I have the letter from fedloan ). According to the XXXX waiver, any payments made after 120 would be refunded to me as an overpayment due to waiver. Well I waited to get my refund check from the department of treasury and never recieved anything. I waited the recommended time frame of 4-6 weeks and emailed fedloan and asked when to expect my refund. Fedloan emailed back and said they didn't have my payment records on my loans after XX/XX/XXXX so they had nothing to send to department of treasury for refund. This was not true, because when I had access to my XXXX account online I could see all of my payments that qualified for XXXX and it was 159. They told me that since my loans were discharged through the pslf they no longer had my records and would have to open a reconsideration case with department of education FSA. Which I did file a case complaint/reconsideration and got a letter that makes no sense. They said that because my loans were paid off in XX/XX/XXXX, and I didn't make payments after that I would not get a refund. They didn't even look at my emails I sent them saying I qualify for pslf as of XX/XX/XXXX and will be due to get refund after the 120 payments. I am getting the run around and no one has my records it seems of my pslf and how many payments I have made. This is frustrating. I need help as fedloan is not even in business anymore. I reached to nelnet who is supposed to be holding my records but when I called they said they could not help me because they were not my loan servicer, but my loan servicer who handled my pslf is no longer in business. I am not sure how to handle this. I have been on reddit and people who were in the exact same position ( no refund, even though we clearly qualified for it ) had said to file a complaint here for help and they had some success.
