Issue: Struggling to repay your loan
Subissue: Problem lowering your monthly payments
Consumer Complaint: Navient has been leading me into multiple forbearance instead of letting me process a simple income driven plan. My interest has driven the cost of my loans UP {$3000.00} this year ALONE! I called XX/XX/XXXX, XX/XX/XXXX I was told to renew my XXXX plan. I told to wait oh, and I heard nothing for three months. After that. Of time in XX/XX/XXXX I was offered a forbearance. then, after 1 month when I called back after seeing navient raise the principal {$300.00}, they offered me a 3-month forbearance. This year the loan value will increase again over {$1500.00}. This is predatory and unforgivable. I can not sustain an expanding debt. Please XXXX, help me.

Subissue: Trouble with how payments are being handled
Consumer Complaint: I am filing a complaint with the lender XXXX XXXX. for its unlawful tactics and hiding information from me as the borrower. I have made payments the best to my ability and advised them what i could afford. Every time i call for a income based program or forbearance i get told there is nothing they can do there are no options and that i have to continue making my payments. At that point i have made the same payments every month that i could at {$200.00}. The payments jacked up to {$900.00} per month and the payment system blocked any payments that were not the full amount of {$900.00}. They then call my step sister who is the cosigner and myself and family making threats they will get me fired from my job since i work in the XXXX system, they threatened that i would have my wages garnished as well as threatened my step sister advising they will have her children taken away from her. Now if i recall those tactics are unlawful and illegal to try and extort a customer for a payment.

Consumer Complaint: I believe I was deceived by Navient with repayment of my student loans, specifically private loans. I have notes of some of my struggle with Navient. My struggles started around XXXX when Navient was still XXXX XXXX. I was trying to find a way to get into a manageable payment plan and was directed into paying for a forbearance a couple of times ; I believe I paid {$50.00} the first time and then another was {$150.00}. I was then put in a payment plan. However, when Navient took over my payments they started to misapply the payment and some loans that were originally in the payment plan were no longer included. I have first names, specific dates, and some details of my contacts with Navient. I also have notes that some of my payments were misapplied. There's also an instance in XX/XX/2017 where payments were deducted from my bank account incorrectly which incurred overdraft fees. While Navient reversed these charges, they did not refund the overdraft fees that resulted in their mistake, despite the proof I sent them. I believe I was mislead and misinformed regarding my payment options.

Consumer Complaint: I started making payments to Sallie Mae ie now Navient when I graduated with my first XXXX degree. There were several " double payments '' that they claimed they could not refund me since it was already attached to my loan. Then I went back to school for a second XXXX degree to which i continually made payments through a payment plan. But it was starting to get to much for me having to pay $ XXXX a month to just them and needing to pay for school, home, food, gas, etc so I had to work two full-time jobs and two part-time jobs due to not being able to make ends meet. I graduated with my second XXXX degree and got accepted into graduate school. I called Navient since they refused to defer while I was going for my second XXXX degree I thought they would defer for my XXXX program. They told me that my XXXX program at XXXX University does not qualify since it is not XXXX or XXXX program when all my other student loans private and federal have deferred my loans being still in school. So they told me my only other option is to apply for forbearance which is {$150.00} but it does not guarantee forbearance so I wouldn't be given back the money if I don't qualify. I told them I understood and they told me I had a total of three years of forbearance. I worked on financial sheet and figured that out that by then I could make the $ XXXX payments a month again. It would give me time to be secure and safe. After doing the forbearance three times ( total of 18 months ) I was told that I no longer can apply for them and need to start paying on the loan. At first I was able to sign up for a replayment plan but they kept double taking out of my bank account to which I had to close that bank account due to them continually taking out extra money than what I agreed to do. They claim that they weren't taking any extra money! And when that repayment plan " expired '' they were making me pay almost {$700.00} a month for loan repayment ( {$680.00} to be exact ) denying me any service or benefit help. Finally I was able to talk with a nice worker who understood my situation and did a financial sheet with me and my co-signer noticing that there was no way I could afford that unless I was homeless and didn't eat. She set up a payment plan with me that on the XX/XX/XXXX of every month I would pay {$220.00} through XX/XX/XXXX. I agreed to the terms but she needed to take out the payment within ten days of us approving it so the first payment had to come out on XX/XX/XXXX. I told her that was fine. So on the XX/XX/XXXXof every month since they have taken out {$220.00} from my bank account. But apparently for the past three months they have been harassing my mom, my co-signer, with phone calls claiming I am not paying my payments and now just recently are harassing me with emails and stating that I am past due and making all these charges and extra fees. What can I do? They have caused me emotional, physical and psychological stress due to not being to pay for groceries or being late on rent and the constant harassing and scaring me about money and going to jail. What can I do? I have tried to seriously just get a loan for {$36000.00} just so I can pay someone else and not have to deal with them but with all my student debt and other credit history I do not qualify by myself.

Consumer Complaint: We have made numerous attempts with Navient to set up affordable payment arrangements in XXXX that were all denied because the amount was not sufficient for them to accept and they were aware that the payments were unaffordable, was told that various items that we had by one of their agents were " luxury '' items ( such as a vehicle to get to work ). Account was sent to a collection agency, struggled to make {$250.00} a month payments which were supposed to help our credit, they were still reporting the loans as delinquent and not reporting the agreed upon amounts of the loans. Those payments were stopped after one year because they were, again, not affordable and were affecting our ability to pay our monthly rent payment. We were once again connected by yet another credit collection agency in XXXX and we advised them of the previous attempts with Navient to pay something toward the loans and nothing was ever received back from that agency nor Navient. Navient is reporting the loans as Closed and Charged off but still reporting them as being delinquent. If the loans are truly charged off, I would like them to stop being reported as delinquent and the amounts reduced to zero. We would be willing to make monthly payments, however, it would be an amount that we would feel comfortable in paying for a specific period of time and that Navient would need to report them as being current at the agreed upon amount.

Consumer Complaint: I contacted my loan servicer, Navient, regarding the Deferment for Active XXXX Treatment Act ( as signed into law Sept 2018 ). I was diagnosed with XXXX XXXX in XX/XX/2018, and only recently learned of this provision which allows borrowers currently receiving XXXX treatment to have their student loans placed in deferment. I contacted Navient on XX/XX/XXXX to discuss this option. I was told initially that no such program existed, but after insisting, was then told that Navient has no application in place for this " since it is so new '' and therefore I can not qualify at this time. After further insisting, I was told that they could place my loan into temporary forbearance until such time as the " federal government '' makes an application available. If I understand correctly, while my loan payments are now suspended, Navient is continuing to charge interest on my loans ( while under the deferment this would not be the case ).

Consumer Complaint: Complaint to the FTC / CFPB Re : Complaint # XXXX-XXXX, and XXXX-XXXX Re : XXXX XXXXSallie Mae-NavientXXXX XXXX Eccl : 5 PDFs ( included with the online submission ) XX/XX/XXXX To whom it may concern : On XX/XX/XXXX ( very early ), wanting to just solve this, I sent my statement to you using my bad English that had errors, and scans that I now realize were unreadable. I apologize for that. The help Ive received since then is reflected in this submission. Im sorry for any inconvenience I may have caused you. -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- I am an identity theft victim by the hand of my nephew, XXXX XXXX who illicitly got 5 student loans in XXXX & XXXX from his law school : XXXX XXXX XXXX, in California ( presently owing around {$65000.00} with accrued interest ) to Navient. I immigrated to America from XXXX XXXX when I was young ( in my mid-twenties ) and lived in my sister 's house for around 6 years ( XXXX XXXX XXXX, XXXX, CA ). Because my sister helped me to stay in the USA, I helped my sisters family by co-signing for their cars when they asked for help because of their bad credit. From that access, XXXX stole my ID and forged my signature to get his 5 student loans from XXXX XXXX XXXX and lied on all 5 of his 5 loan applications listing his mom 's business as my job, and her residential address and her phone number as mine. XXXX XXXX forged my signatures on all 5 of his loan applications, and on two of them, got my birthdate wrong. Anyone who desires to look can easily see that the signatures on the documents are not mine. Sally Mae, however ( now Navient ), preferred to believe a highly trained smooth talking professional liar/lawyer over the evidence which I presented several times, probably because my English was so bad, and my emotions were so high. Heres the evidence I sent them : 1 ) Two police reports plus one additional supplemental police report 2 ) A copy of my rental agreement proves that I was living at XXXX XXXX XXXX, in XXXX XXXX from XXXX through early XXXX ( not what XXXX wrote, XXXX XXXX XXXX, XXXX on his loan application forms ). Please note that the attached rental agreement copy is for the same time period that XXXX XXXX forged the loan applications. XXXX XXXX a XXXX in XXXX XXXX, was the owner of the rental property, you may verify this with him. 3 ) Notarized copies of my signature, contemporary with the forgeries, show how different my signature was from his forgery. 4 ) My credit history, which XXXX added to ( altered ) during XX/XX/XXXX-XX/XX/XXXX. He added his XXXX middle name, his old phone numbers & address in XXXX and XXXX to cover his tracks to make it look like it was mine on my credit history. ( This is a lawyer who weaponized his knowledge against his victim ). 5 ) Also, I was a XXXX XXXX XXXX at XXXX - I was not working, but XXXX XXXX wrote that I was working for his moms company making {$7000.00} a month on his 5 loan applications. To verify this, you may check my IRS records, and my XXXX school records. Ignoring all this evidence, Navient has continued to pursue me from XXXX to the present. XXXX stopped making monthly payments when the 10-year statute of limitations ran out, which I knew nothing about. Thats when XXXX, the lawyer, purposely defaulted on his loans, knowing that I could no longer pursue him criminally. I learned this later from another lawyer. Ignoring all this evidence, Navient has continued to pursue me from XXXX to the present.
