Consumer Complaint: Hi, my servicer MR. COOPER will be violating my California Home Owners Bill of Rights and other laws and are making fraudulent foreclosure sale on my property if they proceed. I have mailed in a complete Request for Mortgage Assistance package with everything that MR. COOPER needs and requests to have deemed a completed package. Friday MR. COOPER representative advised that they have received a completed packet and it went to the underwriters on XXXX/XXXX/XXXX for review. Also they have not yet removed the foreclosure sale date which is scheduled for XXXX/XXXX/XXXX while the review is in process. MR. COOPER is saying that there is no sale date and the sale is placed on Hold but when calling and looking online it shows its still scheduled for XXXX XXXX, 2017. They will clearly be in violation of the California Homeowners Bill of Rights and other laws as well.

Her income was removed from my budget. I was attempting to get a workout Modification I mailed many documents and the next i new was i had a sale date for foreclosure from XXXX XXXX I am also questioning the loan trust, and the assignment being used I asked the my foreclosure be held in a courtroom by a judge. I revoked the power of atty that i gave at the origination of my loan. this power of atty was revoked in XXXX Co XXXX on XXXX XXXX XXXX. I SAID THE BORROWS WAVIER OF RIGHTS without understanding.everyone is entitle to due process of Law, but i was forced to give up my rights. i do not want my home sold on the courthouse steps

Consumer Complaint: Every lawsuit agreement between the Regulators and XXXX have not been kept on my XXXX ' origination. Instead I 've encountered continued abuses. It appears that XXXX XXXX XXXX SOLD to Nationstar a Bill of Goods. And at the Same time transferred Servicing to " XXXX '' this caused massive DUAL Servicer 's and 5 Claims to " who '' was the Investor. NONE of this makes sense. XXXX was found to have not transferred therefore breaching the Deed of Trust. XXXX went to XXXX XXXX XXXX then XXXX XXXX XXXX stated that Investor was XXXX XXXX. However at the same time SOLD to Nationstar. Nationstar said they were " owner '' two of the hired attorney firms stated NO that is not true. Nationstar then switched gears and stated they were the Servicer - transferred from XXXX XXXX XXXX. However XXXX transferred to XXXX for over two years. This also caused massive confusion that resulted in outrageous conduct from every angle. Nationstar then stated they SOLD to XXXX XXXX. However under XXXX own requirements this was impossible. As this was during a BK Stay and made this Assignment by FAKE Persons at XXXX XXXX. Not even real persons acting outside of all CA LAWS. Now a continued dual pattern acting as if they were going to rewrite ; then broke into my home causing total ruin. At the same time their XXXX XXXX Attorney firm ( the 4th firm hired two refusing and the other shut down for illegal foreclosure work ) now XXXX XXXX attempts to conduct HIDDEN SALE DATES and continues to harass by not mailing to home or homeowner. AT the same time raised up threats to harm and sent men to stalk at her house peaking into her windows. XXXX acted without any directions and stated they did not have to wait for any instructions. Now hear forced into a BK and fraud presented to the Federal Courts. Now coming out of FED Court - a new attorney firm SUB OF TRUSTEE assigned again as XXXX XXXX XXXX. This firm has used a false affidavit that was not accurate on the last NOD filed to again jump past the CA LAWS. Filed the NOD using defective and false affidavit. Then furthering the abuses by publishing personal information on XXXX web site. They published my Full Name, Address, wrong figures, and Slandered my Reputation ; and PUBLISHED MY ENTIRE ACCOUNT NUMBER TO THE WORLD. A letter was sent to cease and reverse the Notice of Sale and XXXX. However a Sale was set on Calendar for XX/XX/XXXX. They moved it on Calendar to XX/XX/XXXX to look into the details raised. A Letter was sent Certified Mail however it was never answered. A CA DBO complaint was filed. NO Answer. A XXXX CFPB complaint was filed NO Answer : A CFPB a non answer to nothing raised. AND theXX/XX/XXXX Sale Date caused MY OTHER PROPERTY TO BE STOLEN. A Deed Theft Ring is stealing Properties having been with no real underlying owners over 10 years, and with a Sale Auction Date. However on the Date of the PROPERTY Theft I had no sale on my other home however the Title Records shows " this '' property had a Posted Sale and it appears that is why my XXXX XXXX dollar home was STOLEN. Now I explained to Nationstar, Sent an EMAIL to Executive Staff including speaking to XXXX XXXX AND sent Email to XXXX XXXX to inform him. Now again spoke to XXXX and nobody has answered the topics at hand.

Consumer Complaint: I starting noticing quite a bit of irregularities after XXXX XXXX fka Nationstar Mortgage LLC ( " Nationstar '' ) denied my request for HAMP in XX/XX/XXXX and was denied loan modification. Before I could appeal my denial I requested the full details of the denial and after many months of calling and writing, they finally apologized for not giving sufficient reasons for the denial but in the end they still did not provide the net present value data that we 've been requesting for. I also disputed the validity of the debt on XX/XX/XXXX because of conflicting information regarding the legal ownership of my note and deed of trust. They violated RESPA because they never sent the 5-day notice of receipt of communication and inquiry and which XXXX and I did a conference call to follow up on getting a valid hamp modification from Nationstar and inform them that they have not responded to my debt validation/dispute. On XX/XX/XXXX we spoke to a XXXX XXXX, Nationstars Customer Advocate Specialist, by telephone to follow up on my Debt Validation/Dispute Request on XX/XX/XXXX. XXXX XXXX confirmed that Nationstar did in fact receive it on XX/XX/XXXX in a letter dated XX/XX/XXXX. Nationstar finally responded in 49 days which would make that their second RESPA violation that I with regards to the Debt Validation/Dispute in XX/XX/XXXX. I sent a Qualified Written Request ( QWR ) on XX/XX/XXXX and I received a response on XX/XX/XXXX stating that they will respond no later than XX/XX/XXXX. I first received a respond on XX/XX/XXXX and more financial records and other relating to QWR on XX/XX/XXXX and XX/XX/XXXX. They did not give me time to review the records and decided to file/record a Notice of Default at the XXXX County Recorder 's Office on XX/XX/XXXX @ XXXX XXXX which is only 1 or 2 days from the time I received the third part of my QWR response. To add insult to injury, on the exact same date and time the Notice of Default was recorded, a Subtitution of Trustee was also recorded. The Substitution of Trustee was executed but not recorded on XX/XX/XXXX. Nationstar violated California Civil Code 2934 ( b ) where they did not sent me a copy of the Substitution of Trustee in the same manner provided in Section 2924b and an Affidavit must be attached to the Substitution of Trustee. Nationstar violated RESPA and the California Homeowner Bill of Rights and other State and Federal Laws including the False Claims Act when they ( non-parties to my NOTE and Deed of Trust ) fraudulently recorded a Corporation Assignment of Deed of Trust. I am disputing the validity of the Corporate Assignment of Deed of Trust, Substitution of Trustee, Validity of the Debt and Fraudulent indorsement of the Note. Nationstar, the purported Trustee of the purported Trust, XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX came show unbroken chain of title and valid and proper intervening assignments and indorsements of the instruments that they are claiming, they MUST CEASE AND DESIST from any further Trustee Sale Activities especially the need to cancel or postpone the fraudulent Trustee Sale scheduled next week Wednesday, XX/XX/XXXX at XXXX XXXX. The Trustee is XXXX XXXX XXXX and being assited by XXXX XXXX, who turns out to be an indirect subsidiary of the puported sub-servicer of the XXXX XXXX, Nationstar Mortgage LLC See attached detailed complaint and explanation.

At that time we had a scheduled sale date of XXXX XXXX, XXXX, which would have been in about XXXX days. They explained to us that they can not start a modification process, with a sale date that close, and said WE HAD TO SEND IN AN APPLICATION XXXX DAYS BEFORE NEXT SALE DATE. We went to the XXXX office and paid for XXXX adjournments ( XXXX days XXXX which pushed our new sale date to XXXX XXXX. We submitted the application on XXXX XXXX, XXXX, which is actually XXXX days before sale date, which falls WITHIN THEIR GUIDELINE. When we called for a status on the modification, we were told that they can not process because they had to get ALL DOCUMENTS in within the XXXX days. PLEASE NOTE, THIS IS NOT WHAT WE WERE TOLD. WE WERE TOLD TO SEND IN THE APPLICATION START THE PROCESS XXXX DAYS OUT, CAUSE IT TAKES XXXX DAYS TO PROCESS!!! How were we to know every single document they would request subsequent to starting the process? We went on their website, printed and signed the application, and sent in with the supporting documents. Now they are refusing to process our application, even though we did EVERYTHING they asked us to do, in the time they asked us to do it! IF THE BANK REP GAVE THE WRONG INFORMATION TO US, WHY IS THAT OUR FAULT??

Consumer Complaint: XXXX XXXX, XXXX Nationstar Mortgage is refusing to give details as to some XXXX of unspecified charges that were added to our Mortgage. Our mortgage Balance is XXXX now when our first Mortgage note was XXXX 10 years ago. We were never more than 3 months behind on our mortgage thus there could never be XXXX in deferred interest. We realized the seriousness of the issue when we contacted Nationstar for a refinance and were told that there is a specified second mortgage on the house and that they could not refinance us, nor could anyone else. We do not have a second mortgage, we make XXXX payment. Sequence of events : XXXX XXXX : We had contacted Nationstar for some account research with an official XXXX request. They assigned a number XXXX. Representative XXXX XXXX in XXXX Tx began to investigate the issue and could not explain what the charges were except to say that they were added during a government sponsored making home affordable modification. On XXXX XXXX, XXXX she confirmed Nationstar does not have the actual details of the charges and that they were reaching out to the mortgage owner. I have attache said correspondence. XXXX XXXX stopped talking to us and everyone else can no longer see the case. XXXX XXXXXXXX XXXX, XXXX XXXX and XXXX XXXX were all involved in or first mortgage origination and modification, yet they all seem to have thrown out all the evidence. We ask that the CFPB give XXXX XXXX a deadline to accurately detail the charges that build up our balance higher than our original note. This can not be called " deferred principle '' because we did not originate this amount. They need to describe each line item as a fee, penalty or differed interest and back up with the proper paperwork. If not done in a timely fashion, we ask CFPB assist in removal of this fraudulent amount. Thank you

Consumer Complaint: I have recently received a discharge on my Chapter XXXX bankruptcy where I completed my plan making every payment on time. In XXXX 2017, I received a letter from the trustee to begin making payments to Nationstar Mortgage. I called the company and was told a different amount ( 300+dollars ) instead of the XXXX payment the trustee said I would be paying. I questioned the representative at that time who said I had funds left over in my bankruptcy account that covered the remaining portion. Again in XXXX, the XXXX was owed. At that point I spoke with a representative in the bankruptcy dept who agreed this was wrong. The rep submitted an inquiry to the research dept. XXXX rolls around and I officially got my court paperwork finalizing my discharge. I receive a statement in the mail from Nationstar saying I am past due. I call them and the rep said no, we have money holding in an account that can not yet be applied to your account. That was last week. Today, I get a note taped to my door of my house saying I should immediately call the company. I call, they said they actually owed me money and dont know whats going on. You can not get a straight answer.

At this time, Nationstar is aware that the above referenced loan was discharged in a Chapter XXXX Bankruptcy in XXXX XXXX XXXX, FL on XXXX/XXXX/XXXX under Case Number XXXX XXXX. At the time of the bankruptcy, the loan was owned by XXXX XXXX XXXX and then sold or transferred to Nationstar after the discharge date of XXXX/XXXX/XXXX. Regardless, the loan is XXXX and should no longer be reported to any credit bureau - positively or negatively. At this time, it has come to my attention that Nationstar is reporting to all three credit bureaus on my behalf on this account that has been XXXX for over 7 years. At this time, I am requesting that an update and correction be made on my behalf to all three credit bureaus by Nationstar and all negative or positive information about this XXXX account be removed from my credit report with all three credit bureaus. Consumer Complaint: XXXX XXXX XXXX XXXX formerly NationStar - XXXX XXXX XXXX Texas, XXXX, phone XXXX, holds the mortgage to our home. On at least five separate occasions, I submitted a regular monthly payment plus additional funds to be applied against the principal. When that amount was greater than the monthly mortgage payment due, the company applied the funds to the next monthly payment ( principal, interest and escrow ) rather than applying the additional amount to the principal. After each of these incidents, I contacted the mortgage company and requested that the amount be corrected. The prinicpal payments were corrected. I further requested that future payments with additional funds be applied to principal. On XXXX XXXX, 2017, I contacted the company after the fourth incident and also filed a complaint with the company. I have not received a response to that complaint. On XXXX XXXX, I again made a payment greater than the regular monthly payment due, and the company took two monthly payments out of the amount instead of applying all of it against the principal. Furthermore, the additional interest was not recalculated after these payments. My concern is not only the effect of these unfair practices on my mortgage but the impact on others as well that may not be aware of this practice.

But months later they asked for additional chatrges, and I asked them several times to explain the additional charges. Tey have not done so. Also they took one of my mortgage payments and redireted it into a general account, instead of applying it to my mortgage. I did not authorize them to do this, and now they claim my balance is short.
