Consumer Complaint: As of today, XX/XX/XXXX, NationStar Mortgage now doing business as Mr. Cooper, has not reported my payment history nor my current balance to the 3 major bureaus since last year XX/XX/XXXX. I have been with this company for 4 years now. I have called them numerous times and even have a case open with them. They tell me the same thing, every time, " Your case is being worked on, we are looking into it ''. I believe this to be a lie! NationStar was just ordered to pay {$1.00} million in penalties, and they still have not corrected the issue the were penalized for.

Issue: Applying for a mortgage or refinancing an existing mortgage

Consumer Complaint: I appreciate the response to my original complaint : XXXX. I agree with everything in Mr. Cooper 's response ( attached for reference ) except the most critical point of my complaint and problem. Regarding the HAMP Tier II modification that was approved : 1. When I received the final modification package, the signature page included signing blocks for both me and my ex-wife. 2. I immediately called my dedicated loan specialisXXXX, XXXX XXXX, and was specifically told that both signatures were required. I was working with a lawyer at the time and he was also told the same thing. I was unaware of HAMP Supplemental 09-01, XX/XX/2009 at the time. The Supplemental states " If a borrower or co-borrower are divorced and the property has been transferred to one spouse in the divorce decree, the spouse who no longer has an interest in the property is not required to execute the HAMP documents. '' Mr. Cooper had the divorce decree as well as the Quit Claim Deed that clearly complied with the above language. Being told my ex-wife had to sign was clearly illegal. I have nothing in writing stating what I was told, but why would I make 5 trial payments if I didn't want to sign the modification. I am humbly requesting that the modification be reinstated. Or, if this is not possible, I request that similar terms be applied to resolve the current situation. I understand that the HAMP guidelines have expired, however, I am hoping someone can apply some logic to this situation so I can avoid losing my home.

Consumer Complaint: On XX/XX/2018, I requested Mr.cooper ( Mortgage company ) to remove my MIP, since I have met the requirement. On XXXX XXXX, I received the letter from Mr. Cooper that my monthly MIP in the amount of {$310.00} has been removed. After I check my XXXX statement, I didn't see any MIP disbursement from my Escrow account. However on XXXX statement, I saw two amount of MIP disbursement from my Escrow account. So I called Mr cooper and was informed that they will request the refund. I've waited for 4 weeks and called Mr cooper and was informed that they will not refund because the 2 MIP disbursement on XXXX statement were from XXXX and XXXX. I argue that the XX/XX/XXXX letter state that " From now on, your monthly MIP in the amount of {$310.00} has been removed ''

Consumer Complaint: My payments increased from {$800.00} to approx {$1100.00} and I did my best to pay. I became delinquent around XX/XX/XXXX. I was confused, facing homelessness, and not sure what to do about this. I reached out to Nationstar/Mr Cooper, for assistance. They spread the payments over a few months. I was unable to maintain. I was not given any other options. In XX/XX/XXXX, a local ministry/consultant informed me of possible options to Prevent Foreclosure. I paid No Money to this Consultant and gave written authorization to Consultant to speak on the account. On XX/XX/XXXX, we informed Nationstar of our intention to short sale and prevent a foreclosure. We were informed that when an offer is received it must be initiated by a real estate agent via XXXX XXXX. We advised Nationstar/Cooper that there was no real estate agent involved and that we hoped to have a Cash Offer soon after the home inspection is completed. Nationstar/Cooper did NOT CLARIFY PROTOCOL to complete a Loan mod packet FIRST, then go to XXXX. On XX/XX/XXXX, XXXX rep Unique, XXXX, and XXXX informed Consultant of Mr Cooper site and XXXX. However, the packet was to be mailed to my address as we focused on details of raising the money to pay Cooper account off. I never received the packet that Cooper says was mailed out. All of my mail is being delivered properly EXCEPT Mr Cooper. During this time, the account was sent to foreclosure and a foreclosure sale date was set for XX/XX/XXXX. TO DATE, I HAVE NEVER RECEIVED A NOTICE OF A FORECLOSURE SALE. The Consultant found out about the f/c sale date by word of mouth. In fact, when we call in they verify the account but did not mention the sale date until we asked. As of XX/XX/XXXX, it was made clear to me and the consultant. XXXXXXXX never had intention to assist me with saving the home from foreclosure. Therefore, I am writing you for help. This Home does NOT have to go to foreclosure if given clear instruction for mortgage assistance.

Consumer Complaint: Hello, I submitted papers to Mr. Cooper ( FKA ) Nationstar Mortgage in XXXX or XX/XX/2017, for a modification for my mortgage ; in which I was approved. I noticed during the 3 month trail period my mortgage payment were more, in which I thought would be less. As I struggle to make the 3 month payments of {$2000.00} after the loss of my job, I received my final modification forms which indicated my mortgage would be more than the original payments before the modification. I was thinking the the rate would decrease from 4.625 to a lower percent. It appears that Mr.Copper added additional fees, did not decrease the rate and made the mortgage payments more. I would like to know what are the criteria for obtaining a lower rate. I know individuals who did a modification with the same mortgage company and received a 3.75 or less rate. The modified payment is more than the original payment I started with. As I stated, I would like to know the criteria that was used to determine how a lower interest is provided. In addition, I can never contact my DEDICATED loan Specialist XXXX XXXX to ask any questions Please Advise ... XXXX XXXX

Consumer Complaint: I am the primary borrower on a home mortgage loan held by Nationstar/Mr. Cooper. I did a Quit Claim Deed on the mortgaged property 12 years ago but remained on the loan with the co-borrower. The property went into foreclosure last year and the co-borrower, who remains on the deed, requested a loan modification. I told Nationstar/Mr. Cooper not to process the loan modification because I didn't request it, did not agree with it and would not sign it. The co-borrower had agreed to sell the property since I did not agree to the modification. Against my directions Nationstar/Mr. Cooper processed and recorded the loan modification on XXXX-18 without my consent or signature. They removed me from the modification and executed the modification solely with the co-borrower. This is illegal because I'm on the original mortgage note and the Quit Claim Deed did not release me of the loan liability. I was not married to the co-borrower and, therefore, there was no divorce or divorce decree. A Quit Claim Deed without a divorce decree is not a valid legal instrument to remove me from the modification. I have now asked Nationstar/Mr. Cooper to deobligate me from the mortgage and they refuse to do so. They are still holding me liable for the modified loan which I did not sign or agree to. The property was supposed to have been sold by the co-borrower when the foreclosure proceedings began but the co-borrower will not sell now because they obtained the loan modification. Therefore, I am still liable for the loan and it has damaged my credit and I'm not able to obtain a new mortgage. Had Nationstar/Mr. Cooper not processed the illegal modification I would have been free of the mortgage liability when the property got sold. Nationstar/Mr. Cooper needs to deobligate me from the loan since they removed me from the loan modification without a legal right to do so. Therefore, the recorded loan modification is not legal and does not obligate me to the new loan agreement.

Consumer Complaint: The XXXX XXXX, XXXX and Mr. Cooper are violating The Virginia foreclosure laws by foreclosing on my house on XX/XX/XXXX. According to Virginia foreclosure laws a sale can not be held less than 8 days following the first advertisement or more than thirty days following the last advertisement. Also, the advertisement must be published in the local newspaper. My Deed of Trust specified to make advertisement a week for two weeks. In their last foreclosure sale scheduled onXX/XX/XXXX the Trustees only made one advertisement and that was on XX/XX/XXXX. That advertisement was supposed to run through XX/XX/XXXX. That is not what Virginia Foreclosure Laws said. It said once a week for two weeks. So there was no second advertisement made in XX/XX/XXXX. So, trustees is taking the only one and first advertisement made in XX/XX/XXXX as its second advertisement and that violates the Virginia Foreclosure Laws. The Laws did not say sale can not held more than thirty days following the First advertisement. It say more than thirty days following the second advertisement. So, technically the Trustees is violating the foreclosure laws in its quest to foreclose on house that came in quick succession following theXX/XX/XXXX foreclosure sale.

Consumer Complaint: My lender Nationstar is refusing to work with me and is trying to tell me that I have no options for resolution. They are saying there is nothing that can be done, because they had lowered my interest rate in the past. I do not believe this is true, I believe they could look at options such as forbearance, restructured loan or possibly recapitalizing the late payments back into the balance or even a repayment plan. I am back on my feet financially and I can afford a fair payment but it seems that Nationstar does not want to give me a chance. My problem is that they have closed out my case and told me there is nothing that can be donemy only option is full reinstatement of close to $ XXXX or they will foreclose. This is not possible. I am frustrated that I am being told there are no options when I am certain there are other methods or programs that could resolve this matter. I feel that Nationstar is obstructing the process and denying me access to government programs that I qualify for. Additionally they are not giving me the information on the figures used to calculate while underwriting my file. How did they reach the conclusion that there are no options? What criteria was this based on? Also, if Nationstar is claiming that there are no options because this is all the investor will allow then I would like to see a copy of their pooling and servicing agreement and would like the section relating to modification highlighted for my review I went through a very long and real financial hardship relating to my business that I have owned for 22 years. Due to this I had a problem making my monthly mortgage payments. My lender Nationstar was helpful in the past and worked with me to address this. However, I was not able to cure my default because the financial hardship was extended longer than anticipated. I am now back on my feet financially and in a good place and eager and anxious to work something out with Nationstar. As explained, I have owned my own company for the last 22 years and was making a solid living through XXXX XXXX. Our company specialized in underground construction and my biggest contract was with XXXX. A few years ago, XXXX XXXX purchased all of XXXX landlines in an XXXX deal. Once they took over they wanted to save money and stopped expanding and my business dropped nearly 70 %. I was struggling for a good three years trying to make ends meet. I was finally able to strike a new deal with XXXX 3 months ago and my new business is looking good. I am appreciative of the fact that Nationstar has made concessions in the past to try and help me get back on track with my mortgage. However, at this time I am still behind thousands of dollars and am being told there are absolutely no options. I have tried to get a review conducted to figure out a program or a way to take care of this delinquency, but Nationstars agents tell me the only way is to reinstate the loan. I am not in a position after XXXX plus years of hard times to reinstate the loan. However, I am once again making a good living. I could easily afford a fair payment through modification or a restructuring of the loan. Or at least Nationstar should be looking at some type of repayment plan. Their agents tell me if I dont come up with this lump sum that they will foreclose on my home. This makes no sense. Nationstar would make significantly more money if they were to work with me on this delinquent amount and collect interest and payments from me over the next several years than they would selling the home for less than is owed.
