Consumer Complaint: Re : XXXX XXXX XXXX. To Whom it May Concern : I am writing this letter with hopes to clearly explain to you what has taken place with my current mortgage company. The events of concerns begin near the end XXXX of XXXX when I started the process to attempt to refinancing my mortgage loan understanding that I had a balloon note that would mature XXXX XXXX of XXXX, with that understanding I began communication with my current lender with the help of my son XXXX XXXX, around the XX/XX/XXXX I received from Nationstar Mortgage a letter title Declaration of Intent which I can provide to you. This document provided me with option on how I would like to move forward and proceed with my current mortgage. From the option given I selected that I would like to retain my home as my primary residence and that I elected to proceed with the terms they would set out as described in my balloon note rider. This letter was then sent back to them by certified mail and stamped received in their mail room on XXXX XXXX, XXXX. For the next 6 weeks I continue to call them for answers so that my loan or decision regarding my loan would be made prior to the maturity date of XXXX XXXX, XXXX. I left messages and emails repeatedly with no response coming from NationStar Mortgage. My son was able speak with several managers who ask the he resend all the documents directly to them since the XXXX document sent could not be found he then sent them the documents again on XXXX different occasions along with the proof from the postal service that the original document had been received on XXXX XXXX, XXXX. Each manager he spoke stop returning his calls and emails as did my calls go unreturned as well. XXXX XXXX came and on the XXXX of XXXX I attempted to make my mortgage payment as usual online and my payment would not go through I then begin trying to make the payment almost daily and to this very day the payments are not accepted. In XXXX of XXXX we finally got a response from NationStar but they still were not acknowledging or addressing the declaration of Intent Document nor explaining what happened that I never got a timely response. The young lady I spoke to said she would look into it again and call me back within few days, a few days went by and I did not get a response. I attempted to call her at the number she provided over and over again with no response finally near the end of XXXX someone at Nationstar recommended to my son to apply for loan modification so we did and was told in XXXX that the modification was denied due to missing information so we completed the package again and sent it in with all required documentation by the end of XXXX XXXX we were told the modification was denied again due to my housing Ratio being below 28 %. Throughout this entire process I have tried to make payments by mail and online continuously but to no avail. I would get statements stating to pay the past due amount so I would mail it in with the letter and they have been sent back to my address. My husband and I have owned our land since XXXX and raised our children and grandchildren here. In XXXX we purchased the doublewide manufactured home to replace previous home on our property. We have always paid our mortgage on time. I lost my husband in XXXX of XXXX to his battle with XXXX and I promised him on his death bed that I would never let anything happen to our home and I would be sure to get it paid off. I have not done anything wrong here, I have never refuse to make a payment or miss a payment. My situation is not from my unwillingness to pay my mortgage but from a refusal to accept my payment and the failure by my mortgage company to respond to me in timely manner. I trusted that the people holding my mortgage would do the right thing knowing that I tried to communicate with them long before my maturity date and help provide me with a solution but that

Consumer Complaint: My house was sold while I was under review, I tried everything the service conmpany asked me to do to stop the sale date, I was told if I did everything they would postpone sale date, I submitted everything on time and was calling to see status leaving messages and my house was sold on XX/XX/XXXX. The next da it had been sold I get a call from Nation Star mortgage serviser asking me for some docs that were in file to do a modification on my mortgage. My loan came from XXXX XXXX XXXX and they never worked with me so they sold my loan to Nation Star Mortgage on XX/XX/XXXX, 10 months into Nation Star Mortgage they foreclosed my house violating my rights and laws of my modification. I was evicted within 6 weeks without a place to go leave or stay, I had to leave in a hotel for a month and than a month into an empty house that was for sale and they let me stay in the kitchen with some mattresess with my XXXX kids ages XXXX and husband. We hit rock bottom with this action.

Consumer Complaint: Nationstar Mortgage is sending foreclosure notices - we had to borrow against our house because of medical necessities and were charge 19 % interest on a $ 58K house. We got behind on our taxes but made a deal to pay them off with the City and met our payment schedule. Nationstar decided to go ahead and add that to our mortgage and pay the taxes off and add to the note. Then apparently we did not realize the full extent of a balloon note - seems like they went ahead and paid taxes off so we would owe them more in the end AND 19 % interest that the City would not have charged us. Plus insurance the same way. We are now being sent foreclosure papers and they offer no ability to repay or save our house in any way. We in no way understood the problems what we were signing up for. My husband became XXXX to work and I am working XXXX jobs trying to make any money. There was a loan modification after they paid the taxes off ( I was paying those to the City ) and my payments soared and now there is a balloon payment of the whole note. Our original loan was sold to this mortgage company. We did n't understand how they sold our loan. I have documents but have no way of emailing information but can get someone to help. We are trying to dig ourselves out of the hole and are willing to do it but they will give no options. We were desparate to get our grandchild surgery and took the loan out. Now we have been paying 19 % and they have added on at the last minute and are telling us we have a balloon note and have no other way unless we come up with the complete balance. This is our home and we have no where else to go

Consumer Complaint: I have XXXX mortgage loans with Nationstar Mortgage. XXXX of the loans was paid in full because I sold the home. Nationstar Mortgage withdrew a XXXX payment from my bank account for the property that was already paid off from my bank account. Therefore my primary residence loan that I have with them was unable to be paid because of insufficient funds in my bank account. I contacted them as soon as I realized what happened. I spoke to several representatives regarding this issue. I was transeferred to a manager and she said they would send a check to me. After 2 weeks i contacted the manager and she said they would transfer the funds to my primary mortgage. I received a letter stating that my loan was 35 days past due and was going to be sent to the credit bureau. 3 weeks later and I just received a check from them and it is short {$1000.00} from the payment they withdrew from the account. I have been unable to get into contact with the manager at this time to see why the account is short. I would like to get the remaining balance of {$1000.00}. I need this to pay my mortgage. I do not want my credit to be affected by their discrepency. I have phone records and emails that show how many times i tried contacting them regarding this issue. Consumer Complaint: I am having great difficulty with my current mortgage company Nationstar Mortgage. For the last 3 years, I have been trying to get a loan modification without success. It started in late XX/XX/XXXX I started having difficulty paying my mortgage on time, and by XXXX XXXX, I was 3 months behind. I contacted XXXX XXXX XXXX and explained my situation and they started the loan modification process. After several months of sending documents, hardship letters, pay stubs, etc, on XXXX/XXXX/XXXX we had a loan modification Trial Period Plan. I was to make my XXXX payment by XXXX/XXXX/XXXX. However, XXXX XXXX XXXX sold my loan to Nationstar Mortgage and they became my service provider on XXXX/XXXX/XXXX, 15 days before my XXXX trial payment was to be made. Once I found out this information, I instantly contacted Nationstar about my loan and the modification I have with XXXX XXXX XXXX, and they said they knew nothing about it. I faxed over the paperwork I had from XXXX XXXX XXXX, including the XXXX payment stubs and they said they will have to investigate it. Nationstar then told me after several weeks that my paperwork is too old, and they do not have to accept the terms of my current modification and want to start their own modification. On XXXX/XXXX/XXXX Nationstar sent me a letter that they were doing a XXXX XXXX modification because I was not eligible for a HAMP modification. I made my XXXX XXXX payments before their due dates and when I went to make my XXXX payment, I was told I did n't qualify for a loan modification because I already had XXXX modifications, and refused to take my XXXX payment. ( I did have a loan mod in XXXX w/XXXX ). I had then called the NC foreclosure prevention fund program, and they put me in contact with XXXX XXXX Council of Government which is a HUD-certified housing counseling agency. After many months of paperwork, faxes, documentation, XXXX XXXX Council of Government was able to get Nationstar to do another loan modification, and on XXXX/XXXX/XXXX I was to make my first trial payment. I paid the first XXXX payment a month early both times to ensure Nationstar I can Pay my payments in a timely manner, and again they refused to accept my XXXX payment and stating since I already had XXXX modifications and that the law does n't require them to make a XXXX modification. On XXXX/XXXX/XXXX I went to see XXXX XXXX XXXX, a bankruptcy attorney about filing for chapter XXXX bankruptcy. After telling Nationstar of my intentions, they offered me another chance for a loan modification, and I postponed the bankruptcy. Again, after several months of Nationstar dragging their feet, the acceptance letter and documentation was faxed over and I heard nothing from Nationstar in two months. I called to see what was going on and Nationstar told me they never received my fax and to send it in again. I did and now they said I waited to long and the request is incomplete. We had a court hearing on XXXX/XXXX/XXXX and the attorney for Nationstar was not prepared and the case was dismissed. I am sure Nationstar will be filing for foreclosure soon. I have been to many HUD approved credit counseling agencies including XXXX XXXX XXXX XXXX XXXX NC, and XXXX XXXX XXXX XXXX of XXXX XXXX, and no one has been able to help. I had called Nationstar and asked them to send me proof of both modifications and they are only able to locate XXXX. I asked them to send it to me, and two weeks later, still have n't received it. I was told to contact your agency and file a complaint. I am at the end of my rope hanging on for dear life. I want to keep my home and finish raising my family in our home. Please help me, and thank you from the bottom of my heart.

At the time our loan was transferred to Nationstar, per the letter their was a transferred escrow amount of {$1600.00}. Nationstar states they only received {$1.00} from XXXX XXXX from the transfer of the account. In the meantime, my homeowners insurance has expired because no one sent payment. And the {$1600.00} escrow account of my funds is missing. No one can tell me where the funds have been applied and why they are not in my current escrow account.

Consumer Complaint: My wife and I purchased our XXXX home using my VA loan which I earned through military service for my country. Our initial mortgage lender, XXXX XXXX XXXX was wonderful and made process very easy. But all that came to an end once our loan was then in turn sold to another financial institution that would continue maintenance on our loan. Bad part is as a consumer you have no way to research, review, or have a choice in who gets your loan, Our loan ended up in the hands of Nationstar Mortgage and after the XXXX year of us sending our payments in the same exact way every time and on time, we received a statement showing XXXX payment was allegedly " not received '' by Nationstar Mortgage. We researched and had our bank and the XXXX Postal Service provide documentation showing that we did in fact make the payment and that the payment WAS received by Nationstar Mortgage due to the fact that everything today is electronic. The XXXX documentation showed the signature of the Nationstar Mortgage Representative as receiving our payment along with the date received and company name " Nationstar Mortgage '' underneath. We provided this documentation to Nationstar Mortgage through XXXX of several representatives we spoke to was told the late fee would be removed and they would search for lost payment. Nothing happened. XX/XX/XXXX came and we sent our payment the same way we always have, certified mail and on time. Nationstar Mortgage received this payment but because our account showed a past due payment ( Nothing was done about lost payment from XX/XX/XXXX ), they applied XX/XX/XXXX 's payment to XX/XX/XXXX which left our account still one month behind for XXXX and all the while late fees applied and credit report reflecting late payments towards mortgage payment. Once again we contact Nationstar and speak with a different representative, explain the situation ( No notes was put in our account from prior conversations regarding lost payments ) and was told to, AGAIN, send in our supporting documentation and they would search for our payment. We did exactly that and sent in now XXXX sets of paperwork showing that we sent, AND, payment was received by Nationstar Mortgage and representative who signed for it. SO, XX/XX/XXXX comes and we send in our payment as usual certified mail and on time as a trustworthy borrower should. **Keep in mind we are sending a Cashier 's Check which is as good as cash and we have a way to track it, so they money is instantly deducted from our account. We receive statement for XX/XX/XXXX showing that no payment was received and all the while our past due amount was increasing and the days past due was increasing as well. We contact Nationstar concerning all the lost payments and was again instructed to send in our supporting documentation. We followed their instructions and sent in NOW XXXX sets of documents showing payment made and Nationstar Rep siging for as received. Following this we receive a letter from Nationstar stating the Research Dept. investigated and found nothing wrong. XX/XX/XXXX comes and we send our payment again the same way. Mid-XX/XX/XXXX we receive statement showing no payment received for XX/XX/XXXX We contact Nationstar, they tell us to send in documents, we send in now XXXX sets of documents, and still receive a letter stating they investigated the issue and found no faults. We are left with no option but to seek legal assistance after numerous attempts to fix this problem went without notice even with hard documentation showing that employees from Nationstar signed as receiving our payments. Our past due amount has increased dramatically, but we do not have the money in our account because it is in the form of a cashier 's check lost within Nationstar Mortgage and fear that foreclosure is looming due to the number of days behind and foreclosure paperwork being sent.

Today, when I was about to make the XXXX payment I realized that the funds were not applied, I presume because my plan changed to regular amortization. My complain is that I was not advised of the change during the last 60 days so I could refinance ; they do not send me any document in writing by mail, and by e-mail I was not warned to. I need to refinance my XXXX and XXXX mortgage that has been impossible since my mortgage is not owned by XXXX or XXXX XXXX, so it will be a no ending struggle with this company?

Consumer Complaint: I have tried to do everything we can to keep our home but seems those options are no longer a possibility. It seems that NATIONSTAR simple prefers to remove us from our home with a foreclosure or short sale. At the current market rate, NATIONSTAR will not benefit for any of these XXXX options, however I know that it will be at the best interest for NATIONSTAR to help us with the modification. According to Nationstar, the denial was based on that by the time the modification matured, there was a remaining balance due of {$99000.00} and due to the net property value. We do NOT want to lose our home and for this reason we are asking for NATIONSTAR to carefully re-review our finances and reconsider their decision. I know that with my income and my husband 's contribution income, we CAN afford our home, however we are only asking for NATIONSTAR to help us in reducing our mortgage payment. We want to stay in this home and our childrens home until our last breath however the only way we can do that is by making our mortgage more affordable within our means. We have also put on complaints letter thru NATIONSTAR 's CEO 's office in hopes that they will escalate my case within their office, as well as a filed complaint thru the Attorney General 's Office of the state of California and the Consumer Financial Protection Bureau. I hope that after NATIONSTAR re-reviews our finances more carefully, determines that the best option for them is to help us keep our home with a loan modification.
