Issue: Loan servicing, payments, escrow account

Subissue:

Consumer Complaint: I refinanced my home in XXXX XXXX for a 10-year loan. On XXXX XXXX, XXXX I received a letter from XXXX that the servicer of my mortgage loan was XXXX XXXX XXXX DBA XXXX XXXX. I received a letter dated XXXX XXXX, XXXX of Notice of Assignment, Sale or Transfer of Servicing Rights of our loan to Nationstar Mortgage LLC effective XXXX XXXX, XXXX. I started making payments to Nationstar Mortgage in XXXX XXXX. In XXXX XXXX while reviewing my documents, I could tell the escrow account would be underfunded, so I was pro-active and started making additional payments into my escrow account. In XXXX XXXX Nationstar Mortgage did a recalculation on my escrow account and changed by monthly payment to {$2100.00}, which I thought that would settle the escrow problem and adequately fund and stabilize our monthly payments. In XXXX XXXX Nationstar Mortgage did another recalculation of my escrow account, and changed my monthly payment 's, ( One ) day before the monthly payment was due on XXXX the XXXX, which was XX/XX/XXXX. The confusion of the Payment change resulted in a double payment being made in XXXX XXXX. I contacted Nationstar for over two weeks and kept being told that they did not receive a double payment. I also ask that my payments not be lower, because I could tell that it was going to cause a shortage in my escrow account. Talking to many agents with Nationstar I requested that my payments not be reduced and to resolve the issue of the double payment. Getting no response from Nationstar I filed a complaint with the XXXX, and that was the only reason I got a written response back from Nationstar. In the complaint I outlined the struggles that I was having with Nationstar, and Nationstar 's non-response to my messages, and I did not want my monthly payments reduced because it was going to cause escrow problems. Nationstar went ahead and lowered my payments against my wishes, and agreed in a written response, that the double payment made in XXXX XXXX, would be applied to the XXXX XXXX and XXXX XXXX payments, and that my next payment would be XXXX XXXX. This agreement that was written to the XXXX was not honored, and my next payment was not applied to the XXXX XXXX payment, but the XXXX XXXX payment. On XXXX XXXX, XXXX my wife was contacted by Nationstar stating that we were in default, even though I knew that all my payment were made prior to the due date, and never late. Upon further review of my account I found out that Nationstar had recalculated my escrow account again and our payment had increased, to which we had no knowledge of the increase until XX/XX/XXXX. I was informed that I owed {$140.00}, which I immediately sent in once I was made aware of the shortage. Then looking at the Nationstar website, I saw letters and the transaction history where Nationstar had completely made our account look like we had not been making monthly payments. Nationstar did not contact us by US Mail, that there was an increase in our monthly payments, or for any reason about our account being short of the funds. But Nationstar, sent a packet on XXXX XXXX, XXXX in the US Mail, stating that we were in default of our loan, because of their manipulating their books, over {$140.00} that we owed as the result of the increase of our loan. If one were to look at my credit history, you would see that we have excellent credit and have always paid our bills on time and the correct owed amount that we are made aware of. I have made numerous requests for the name and contact information of someone at Nationstar who could resolve my issues. Nationstar has not given me any response to my numerous requests. Prior to the XXXX XXXX, XXXX contact, my wife had received several calls from someone who said they were from Nationstar, with the calls being between XXXX - XXXX. My wife would ask

Issue: Loan modification,collection,foreclosure

Subissue:

Consumer Complaint: My spouse lost his job and we fell behind on our XXXX mortgage. I tried on several occasions to get my mortgage modified to an acceptable rate but I have been told that I can not get anything lower than the 7.5 % interest rate that I have because my loan is n't backed by XXXX or XXXX. Since I am unable to modify or refinance my loan according to Nationstar, I would like to make payment arrangements since my family is helping us with the money to get the account current. I have left several messages for the loan specialist assigned to my loan but no one has returned my calls or left me a message if I was n't home. I am trying to pay 3 months of my mortgage now ( XXXX/XXXX/15 ) and the remaining 3 months on XXXX/XXXX/15 to bring my account current. Any assistance to help me get some customer service would be greatly appreciated. I did call and spoke to a general rep that provided horrible customer service and was rude. Thank you for any assistance you can offer in getting someone to return my calls!

Issue: Loan servicing, payments, escrow account

Subissue:

Consumer Complaint: Nation star has increased my escrow by {$60.00} so I will have excess in my escrow account. I refused to pay over my payment amount. I have made all my payments on time since I 've had this loan. This loan is a modification due to the fact I am XXXX. According to their paper work they sent me. I am paying the proper amount of escrow. {$140.00} that covers the amount of tax and ins. XXXX. I received a phone call from Nation Star not a notice. That they have suspended my account and if I did not make the payment it could result in forcloser. I do n't understand how they can force me to pay over my escrow amount that I do not owe. Then foreclose on my home because I will not. I am XXXX and I am on a fixed income. From reading the comments about these practices it looks like this organization looks for people like me. From what I understand this practise is used to let the individual not make XXXX payments then start forecloser procedings. The person owing the money does not have the funds to pay the jacked up charges so Nationstar forcloses on the home. They are looking for homes with equity that they can turn over. I hope this is not true. I still want to believe businesses are honest. Thank you for your time.

Consumer Complaint: I refi'ed my mortgage with XXXX. I had no issue with them. They sold it to Nationstar. NS immediately tried to force me into their homeowner 's insurance. I had it already with XXXX. They then tried to force me into flood insurance. I already had it with XXXX. Now, they are sticking me with " gap '' flood insurance. They insist on {$2400.00} right away and they are boosting my monthly mortgage payment from {$700.00} to {$1200.00} a month. Repeated calls and letters are useless with them. In checking with the XXXX, they are not accredited and have an " F '' rating. They are terrible! This useless " gap '' insurance will cost me an additional {$15000.00} over the term of my mortgage and I have no right for refusal. They " claim '' I agreed through " terms and conditions '' even though that agreement was with XXXX, not them. It is forcing me to consider another refi 12 months after I just did it. This will cost me {$3000.00} but it saves me {$12000.00}. I could pay off mortgage but would get hammered XXXX by income tax. ( XXXX with withdrawl, XXXX with the boost in % income tax bracket )

Consumer Complaint: We presented a complaint on XXXX XXXX here at the Consumer Finance Protection Agency Case number : XXXX. On XXXX XXXX XXXX XXXX XXXX, exactly 27 days before our trial decided to file a motion to substitute party plaintiff and throwing our case to Nationstar Mortgage LLC as the " new '' plaintiff. For five years our case have been bouncing from XXXX, to XXXX, to XXXX XXXX XXXX and have changed law firms over and over again. They keep us in constant stress and keep avoiding to help us as mandated by the Government. Here is again our case : On XXXX XXXX XXXX after several months of paperwork we closed on our home with XXXX XXXX. I was asked to sign hundreds of papers with little or no time to review any of them. At that moment I was pressured to get the closing done. We provided XXXX % of the value of our home and our mortgage was {$1400.00} plus a MIP of {$390.00} or {$1800.00} per month with an interest rate of 2.5 %. By the end of the fifth year payments blew up to {$2800.00} plus {$390.00} of MIP to {$3200.00} per month. Just the mortgage grew XXXX %. During that process XXXX sold our mortgage to several other banks including XXXX XXXX XXXX and XXXX XXXX XXXX. Before the XXXX % increase in our mortgage payment came through we requested XXXX XXXX XXXX to refinance and their response every time was " you are paying on time we ca n't help you ''. We kept on calling until one XXXX XXXX XXXX representative stated that the reason they were unable to help us was because we were current with our payments and we needed to be in default for them to be able to help ''. Based on those instructions we defaulted and 60 days later re-applied through the Home Affordable Refinance Act three times. Even thou we fulfilled XXXX % of the criteria XXXX refused to refinance and proceeded with a foreclosure. Since we found the whole situation building up against us we hired an attorney and we did a compliance stress test of our mortgage with a certified reputable Loan Analyst for the RESPA and TILA and the result stated that the mortgage generator and its successors violated many RESPA and TILA federal and state statutes. We filed a counter claim at the court stating that not only the mortgage note are unforceable due to direct violations of TILA but also of the HOEPA and failed to deliver a notice of acceleration to us the homeowners violating the Federal Debt Collection Practices Act and also XXXX XXXX XXXX breached the mortgage agreement by force placed insurance in an amount in excess of that required under the mortgage. The mortgage also understated the finance charges and annual percentage rate violating the Truth in Lending Disclosure Statement at the time of closing. To top all that we requested a Home Equity Line of Credit for {$100000.00} which XXXX XXXX XXXX provided even though our home did n't have enough equity. Throwout the life of the HELOC we paid it in full several times and XXXX XXXX XXXX kept on lending us money even there was not equity to support that loan also known as predatory lending practices. Even after XXXX XXXX XXXX tries to foreclose in our primary residency and put our family on the street, we made and arrangement to pay the {$110000.00} HELOC and we satisfied that mortgage on XXXX XXXX XXXX.

Consumer Complaint: My with Aurora Loan XXXX was scheduled to be service released to Nationstar on XXXX/XXXX/12. Instead, my home sold ( closed escrow ) on XXXX/XXXX/12. Despite this, Nationstar continues to report that I had a loan with them ( even though the Aurora Loan XXXX record is still reflected on my credit ), and they reported that my account began with them on XXXX/XXXX/12 and was derogatory. They continue to show this on all credit bureaus despite the fact that I 've contested it and shown them that they did not even have servicing at any time.

Consumer Complaint: We are trying to refinance our interest only mortgage. This mortgage was obtained in 2007 with XXXX. When the mortgage was originated the house address was incorrect. At closing I told the title company the address was incorrect according to the XXXX XXXX but the title company said they did not care because they did not want to redo all the paperwork. XXXX XXXX XXXX then purchased our mortgage and never changed the address. Nationstar Mortgage Company now owns our loan and although they did make correct the address in their files they refuse to give this information to HARP so we can refinance our Freddie Mac loan. The bank that is willing to refinance our mortgage said Nationstar flat out refused to acknowledge the address change. Yet all the paperwork we received from Nationstar ( i.e., interest statement for tax purchases ) has the corrected address. We also received a notice of a change of address from Nationstar. How do we get Nationstar to cooperate with the bank that is trying to refinance our loan? As you can see from the attachments Nationstar acknowledges our address is XXXX XXXX XXXX XXXX, XXXX XXXX, MO XXXX. The original paperwork that XXXX had was XXXX XXXX XXXX XXXX, XXXX XXXX, MO XXXX. This address does not exist.

Consumer Complaint: I am having trouble XXXX my mortgage company, Nationstar. I am accusing them of purposely losing payments so they can charge me late fees and make me lose my home. They lose notes, comments, communications, written paperwork ... thye force place insurance when you have it paid in advance for one year just so they can tag a premium delinquency on your acct ... ... thereby putting all of your now " short '' payments into a suspense account ... .this now goes on your credit as delinquent payments. I pay my own insurance myself, yet they say they have paid it since they have had my loan. Please help
