Consumer Complaint: I have a few complaints about my home and I feel that it was sold to me with undisclosed defects. When we purchased our home, we soon noticed that the roof in the master bedroom had a leak. We also found the original warranty request from the original owner informing the builder of the defect. The builder XXXX XXXX sent a roofer out but the problem is still not repaired. Next we 've recently had a soap dish in our upstairs bathroom break off. When the repair company came out they informed us that any repair made would only be temporary since there was sheetrock behind the shower tile and is was soft and would not hold. The repair company also informed us that sheetrock in the shower is out of building code and should not have been used, that there is a sturdier substance that is made for wet applications and is approved by building code. My attempts to contact XXXX XXXX XXXX to repair have been unsuccessful. So I 'm filing a claim against my mortgage company since : 1. ) The leaking roof was a preexisting problem which I was not made aware of when purchasing the home, 2. ) The sheetrock in the shower is out of building code and should not have been approved and changed before home was sold.

Consumer Complaint: NATIONSTAR AND ITS ATTORNEYS, OFFICERS OF THE COURT, ARE KNOWINGLY COMMITTING THE IN-PROGRESS CRIMINAL ACT OF GRAND THEFT AGAINST ME AND MY HOME BY USING THE POST-RESCISSION, VOID AND UNENFORCEABLE NOTE AND DEED OF TRUST IN THEIR ILLEGAL NON-JUDICIAL CALIFORNIA FORECLOSURE ON MY HOME OF 26 YEARS!!! REGARDING : XXXX year old XXXX XXXX XXXX home of 26 years : XXXX XXXX XXXX ; XXXX XXXX, CA XXXX REFERENCING : Alleged XXXX Loan Number XXXX : Deed of Trust Document Number XXXX recorded on XXXX XXXX, XXXX in XXXX XXXX California REFERENCING : Alleged Nationstar Mortgage LLC Loan Number XXXX Corporate : Assignment of Deed of Trust Document Number XXXX recorded on XXXX XXXX, XXXX in XXXX XXXX California I XXXX XXXX XXXX exercised my right to rescind on XXXX XXXX, XXXX under TILA Section 1635 ( a ), and that rescission was both timely and unchallenged. I, XXXX XXXX XXXX, rescinded immediately upon depositing my rescission into the USPS mail on XXXX XXXX, XXXX under TILA statutes immediately rendering the transaction, loan and security instrument void and unenforceable by operation of law and pursuant to XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX ). See attached XXXX rescission and proof of receipts : XXXX XXXX XXXX, XXXX for XXXX - LETTER of RESCISSION & Proof of XXXX Receipt and XXXX XXXX XXXX, XXXX for XXXX - LETTER of RESCISSION & Proof of XXXX Receipt. In the XXXX XXXX, XXXX XXXX decision Justice XXXX, in his Opinion of the Court for a unanimous SUPREME COURT OF THE UNITED STATES decision stated : " The clear import of 1635 ( a ) is that a borrower need only provide written notice to a lender in order to exercise his right to rescind. To the extent 1635 ( b ) alters the traditional process for unwinding such a unilaterally rescinded transaction, this is simply a case in which statutory law modifies common-law practices. '' USC Section 1635 ( b ) clearly states, " When an obligor exercises his right to rescind under subsection ( a ) of this section, he is not liable for any finance or other charge, and any security interest given by the obligor, including any such interest arising by operation of law, becomes void upon such a rescission. '' Nationstar who is in violation of TILA 1635 ( b ) allowed all of its rights to challenge or object to my XXXX XXXX, XXXX rescission to lapse and expire on XXXX XXXX, XXXX by not filing a timely lawsuit within 20 days of the date it received the rescission on XXXX XXXX, XXXX. This is currently postponed until XXXX XXXX, XXXX. See attached XXXX NT TRUSTEE SALE. It is a basic precept of the law that one can not use, enforce nor foreclose an interest in a null and void contract or security instrument, yet that is exactly what Nationstar is doing TO COMMIT ITS CRIMINAL ACT OF GRAND THEFT!!!!

Consumer Complaint: On XXXX XXXX, 2015, I refinanced my house in order to get the mortgage in my name and out of my deceased father 's name. My mortgage was with Nationstar Mortgage LLC at the time I refinanced with another mortgage company. At closing, I was told that I would probably receive a refund. I received a refund this week but can not cash the check ( {$140.00} ) because it was issued to the ESTATE XXXX. I have called Nationstar yesterday and today to inform them that my father 's estate did not pay off this loan, I did and my name should be on the check. So far I have not resolved this matter and am very upset with the way I have been treated my Nationstar Mortgage LLC. I have demanded that they reissue the check in my name.

Consumer Complaint: Our mortgage was recently purchased by Nationstar Mortgage Company. We keep scheduling our payments online via their website well within the payment period but continue getting phone calls on our home and cell phones advising that our mortgage payment is late. This happens every month and have asked that they check their records prior to calling and disturbing us. We have asked numerous times but they continue to call day and night. No matter who we speak with they will not stop calling and harassing us.

Consumer Complaint: I applied for assistance in saving my home from foreclosure. My servicer Nationstar Mortgage denied me for assistance on XXXX XXXX, 2015 and again on XXXX XXXX, 2015. Both times my attorney requested from Nationstar Mortgage my denial letter and the mandated NPV chart that goes with it. Nationstar has withheld the NPV chart and refuses to send it to me. My attorney states since I was denied for the Making Home Affordable Program ( HAMP Tier 2 ) and I was told I was denied due to NPV the servicer is required by law to give me a copy of the NPV chart. I believe I qualify as Nationstar has said my new payment could not be reduced by the amount required by the program. My attorney states this is not correct and Nationstar must be using incorrect figures. I feel as if Nationstar is purposely evading giving me this information solely to try and evade and block me from assistance I know I qualify for. They also are not sending me the denial letters until almost 30 days after I am denied. My attorney has to demand the denial letter just to get any copy of it and they basically try to keep it so I can not appeal the denial. My last loan modification request was denied on XXXX XXXX, 2015. Nationstar withheld the denial letter until XXXX XXXX, 2015 and they still have not given me the NPV chart. Tomorrow is XXXX XXXX, 2015 and even if they now give it to me they have achieved with holding it from me for the 30 day appeal period and now I can not appeal because they with held the information from me to be able to appeal. I think this is very disturbing and I may lose my home over their illegal actions.

Consumer Complaint: Please stop the Default / foreclosure process as my property is currently in default, and Nationstar Mortgage told me in a phone call on XXXX/XXXX/XXXX, that the foreclosure process shall begin on XXXX XXXX, XXXX. Please investigate XXXX ( XXXX ) separate matters : 1 ) Please investigate the criminal misconduct of Nationstar employees and their affiliates whom illegally intercepted and forged XXXX ( XXXX ) XXXX money orders which I mailed by certified mail, earmarked for my XXXX XXXX payment. Understanding the unsavory reputation of Nationstar Mortgage, I made copies of these money orders BEFORE I mailed them to Nationstar Mortgage, via certified mail. As a result, I retained the serial numbers of these money orders and was able to order copies of the 'processed 'money orders from XXXX showing these money orders had been altered /forged illegally and 'cashed ' for the personal benefit my Nationstar employees and their affiliates. Nationstar Mortgage has NOT provided a refund for these money orders, which were used for the personal benefit of Nationstar Employees and their affiliates, at my expense nor as Nationstar Mortgage provided me with a credit toward a future mortgage payment. Please provide an update regarding the investigation, as well, regarding the police report submitted on XXXX/XXXX/XXXX. 2 ) Nationstar Mortgage deliberately omitted a 'principle reduction /debt forgiveness incentive clause ' totaling {$330000.00} ( {$110000.00} per year over the first 3 years of the loan ) from the loan modification agreement, that was explicitly stated on my Trial Payment Letter. 3 ) Nationstar Mortgage is attempting to foreclose on my home by mismanaging federal funds from a federal program operated by the State of California, ironically called " Keep Your Home California '' ( KYHC ). In this regard, {$100000.00} from this federal program was wire to Nationstar Mortgage on my behalf, and posted to my account on XXXX XXXX, XXXX. Nationstar Mortgage provided explicit authorization for me to utilize these funds for future mortgage payments via email. To be clear, my last mortgage payment from my personal funds was made to Nationstar Mortgage in XXXX XXXX, as Nationstar Mortgage was made the payments from XXXX XXXX though XXXX XXXX, utilizing the federal funds from XXXX This agreement is well documented. To be very clear, written authorization was provided both via email from Nationstar Mortgage and reflected in Nationstar Mortgage Statements. I am told that Nationstar has applied a portion of these federal funds to the months of XXXX XXXX through XXXX XXXX, but is now refusing to apply any additional federal funds toward additional future payments. Nationstar Mortgage told me in a phone conversation on XXXX/XXXX/XXXX that I still owe mortgage payments for XXXX XXXX, XXXX XXXX and XXXX XXXX, such that on XXXX XXXX, XXXX, the foreclosure process shall begin for my home.

Consumer Complaint: After 5 years of spending thousands of dollars, as well as sustaining bankruptcy in efforts to save my home that is my primary residence, a company that worked on my behalf got my mortgage company, Nationstar, to agree to modify my loan, if I agreed to drop a 'QUIET TITLE ' civil suit that was pending in civil court against them as well as sign a legal statement from their attorney stating that I would no longer be represented by my former attorney. They sent me what I just discovered was some sort of general modification agreement and not one that is HUD oriented. The modification was originated by 'The XXXX XXXX XXXX who worked out the negotiations. My loan was modified to 2 % and the new monthly payments are more affordable and now I am able to continue to successfully meet my mortgage payments. However after I was no longer legally represented by 'ANY FIRM OR LEGAL REPRESENTATIVE ' ; three months into my trial period, the mortgage company REJECTED MY NEW MODIFICATION AND IS NOW TRYING TO FORECLOSE ON MY PROPERTY FOR THE 4TH TIME SINCE ALL OF THIS STARTED. I sought legal help AGAIN, and this time finally got help from XXXX of the HAMP agencies who work through HUD. BUT now they have told me that after finding issues with what I just went through, they could not help me either. I AM SEEKING A GOOD MORTGAGE LIGITATION ATTORNEY TO ASSIST ME WITH BEING SCAMMED OUT OF MONEY AND BEING TAKEN ADVANTAGE OF BY ALL OF THESE PROGRAMS WHO PROCLAIM THEIR HELP BUT NEVER HELP YOU ACHIEVE THE DESIRED RESULTS YOU SEEK. ALL I WANT TO DO IS TO SAVE MY HOME. I DO N'T WANT THIS TO DRAG OUT FOR ANOTHER 5 YEARS UNTIL I EITHER LOOSE MY MIND OR MY JOB AGAIN! Thus becoming a victim of 'less than qualifying income ' that will put me in the status of 'REALLY NOT BEING QUALIFIED ' for continuing to keep my home. Is this the undercover strategy being use to achieve the mortgagors primary goal? : : 'to obtain property for future profit ' ; NO MATTER WHO SUFFERS THE LOSS? PUT A FAMILY IN THE STREET FOR THE PURPOSE OF GAINING A PROFIT LATER WHEN TIME MAKE IT PROFITABLE FOR THEM TO DO SO! IS 'GREED ' THE NEW DESEASE WE NOW HAVE TO FIGHT? WHAT HAPPEND TO THE LEGAL ACTIONS OF FORFITING A CONTRACT? WHAT LAWYER CAN ARGUE THESE FACTS? PLESE CONTACT ME. I NEED LEGITIMATE LEGAL REPRESENTATION FROM A FIRM/ATTORNEY WHO IS WILLING TO SUPPORT WHAT IS RIGH UNDER THE LAW IN OFFERING ME THE LEGAL ASSISTANCE I NEED TO SECURE MY HOME FROM THESE PREDITORY LENDORS WHO BREAK CONTRACTS FOR THEIR PROFITS ' SAKE!

Consumer Complaint: My home loan was transferred to Nationstar Mortgage from XXXX XXXX in XXXX 2015. Prior to the loan being transferred, XXXX XXXX honored the 15 day grace period for loan payments made online, as outlined in my Note and Mortgage. However, the first month that Nationstar Mortgage was servicing my loan, I made my payment after the XXXX of the month and found a {$9.00} " late fee '' assessed to my account solely due to the fact I made my payment online after the XXXX day of the month. This fee is unscrupulous as it contradicts the 15 day grace period as agreed upon in my Note and Mortgage. I was never made aware of the fee through separate letter ; I had to call Nationstar Mortgage 's customer service department to find out the information. They bury it in the monthly statement under the heading " Payment Options ''. I do not feel it is fair to punish people who make their payments on time, who are current on their mortgage payments and during the legally allowable grace period. Some people do not get paid during the first week of the month and the 15 day grace period allows flexibility to all. I was happy to refinance my loan in XX/XX/XXXX to XXXX XXXX only to receive a letter last week that my loan is now being transferred once again to Nationstar Mortgage. Again, I feel this matter should be looked into as it goes directly against the verbiage as agreed upon between Mortgagor and Mortgagee in the Note and Mortgage. I do not want to be subjected to unnecessary and illegal fees. Thank you for your time and consideration.

Consumer Complaint: Nationstar XXXX XXXX XXXX, XXXX XXXX CA XXXX XXXXShort sale was started XXXX/XXXX/2015 with Nationstar. We were informed that this was going to be run through Nationstar 's " XXXX '' program. The bidding started on XXXX/XXXX/15 and ended on XXXX/XXXX/15. On XXXX/XXXX/2015 we were informed that the highest bidder walked and Nationstar was going to go to the 2nd highest bidder. On XXXX/XXXX/2015 we were informed that the back-up bidders ( Nationstar 's pool of shill buyers ) also declined to move forward with the purchase of this property. The negotiator stated that they would continue with foreclosure until they get a reasonable offer that we can proceed with. They stated that since they could not procure a buyer through their auction process, they would be cancelling the file and asked us to remarket the property to find a buyer giving us the guidelines the investor wanted for an approval. The negotiator went on to state that if we could find a byer to meet those approval conditions they would be able to approve the buyer and close the short sale. We remarketed the property and found a buyer that was willing to meet the requested sales price, and now Nationstar is refusing to work with this buyer. They are stating it is required to go through their ( ALREADY FAILED ) auction process yet again. NATIONSTAR OWNS XXXX. I know for a fact that Nationstar/XXXX work with a special pool of buyers, whom they even claim to represent as their 'agent '. TWO ISSUES with this ... .. 1- Nationstar/XXXX are not licensed to represent buyers/sellers in this state. 2-'Representing a buyer ' goes directly against the idea of a public fair-market auction. In addition, Nationstar 's own shill buyers DO NOT HAVE TO PAY THE 5 % PREMIUM that the 'public ' is required to pay. IS NATIONSTAR DEFRAUDING THE INVESTOR BY FORCING THE PROPERTY TO BE OFFERED TO THEIR SELECT POOL OF SHILL BUYERS???? It is obvious the auctions are fixed ... .... Yet another way for Nationstar to defraud their investors, the community, and their own clients.
