Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: I had no knowledge of a debt with NCS debt collector until it was on my credit report. I have disputed on several occasions that I had no knowledge because I wasnt notified by the original creditor XXXX XXXX XXXX or the collection agency. On XX/XX/2019, I learned that the original creditor has been under new ownership twice when I contacted them so any questions about a debt is the responsibility of the original owner. No information on the owner during my residency can be found or provided by the two buyers. NCS was contacted, I requested the information of whom they was collecting the debt. XXXX XXXX at ext XXXX told me she handles XXXX XXXX accounts and that she can not provide her client information. That I can dispute it with her and she will let her client know. She refused several times to give me the information which is a violation FCDPA Section 809. I suspect that they maybe also in violation of Section 812 reason being that I have never received notice of debt and the fact that they refused to provide the information requested.

Issue: Attempts to collect debt not owed
Subissue: Debt was already discharged in bankruptcy and is no longer owed
Consumer Complaint: Hello, XXXX XXXX XXXX placed a collection on my credit report. When I contacted them on 3 different occasions requesting debt validation, they advised me that they were in fact a lawyer. The person who answered the phone took my name and email address stating she would have her manager contact me back about this debt. Not one time did they return my call or send information like I was advised. So I filed a complaint with all three credit Bureaus, providing them all of the evidence that I do not owe the debt. Then I filed a complaint with the BBB against XXXX XXXX XXXX since I could not get a reply. XXXX XXXX XXXX replied to the complaint stating this account is no longer with our company, please contact the XXXX XXXX XXXX XXXX XXXX. I responded to their response saying I did not accept their response because I wanted to know why my account had been placed with someone else. They responded again stating basically the same thing, for me to contact XXXX XXXX XXXX XXXX XXXX. So they refuse to validate the debt, then also refuse to even give an explanation as to why it was sent to another attorney. They claimed to be a lawyer so why are they sending it to another attorney? During this time, XXXX sent me a letter stating that the account I was disputing was no longer on my account. So I had in fact won the dispute. My next step was contacting XXXX XXXX XXXX XXXX XXXX. I emailed them all of the proof on XX/XX/XXXX, showing them I do not owe this debt, then on the XXXX of XXXX National Credit Systems placed this back on my Credit again. Im still waiting to hear back from XXXX XXXX XXXX XXXX XXXX, but they have not moved forward since I sent them the proof. There are many complaints of both of these companies online, and XXXX XXXX XXXX has actually been sued successfully for unethical practices. If this company no longer has my account then why are they continuing to place false information on my credit. Companies like this need to be stopped. I have Retained legal counsel and in the process of filing a lawsuit.

Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: On XX/XX/XXXX XXXX XXXX at XXXX XXXX XXXX opened a balance in the amount of {$2900.00}. This is an apartment community in XXXX, Ohio. I called the apartment community and their corporate office and they said they had no record of me living there. I told them this charge was appearing on my credit, I asked them for proof of residency. They do not have it. I also asked for proof of my identification and signature on the lease agreement, they didn't have that either. The charge is for a month of rent for the fall of XX/XX/XXXX per the collection agency, but the apartment complex knows nothing about it. In the fall of XX/XX/XXXX I lived at another apartment community that I worked for. I have witnesses with my previous supervisor and records showing my dates of residency. I never occupied an apartment at XXXX at XXXX XXXX. When I spoke to someone at their corporate office they said maybe it was identity theft, but again they have no lease or documents proving that I owe or stayed there. For the past five years I have completed paperwork to remove this debt, I have struggled to try to purchase a home or even lease an apartment. Everything has had to be under my husbands name. I need this debt removed, I never lived or even applied to live at this community and they have been affecting my credit score for 5 years for collecting a debt I don't owe.

Consumer Complaint: I have been harassed by national credit systems in the following ways : -would not stop calling even after repeated requests. -would not furnish documentation regarding alleged debt. -they play games on the phone and avoid any questions and abruptly hang up when I question the validity of the debt. -they manipulate the dates reported to the credit bureaus whenever I make a dispute as a way to keep the alleged debt on my credit report. They leverage themselves by negatively reporting false information as a means of power over me. I HAVE RECORD OF THEM CHANGING DATES AND MANIPULATING THE SYSTEM. This is causing major financial stress as well as emotional stress.

Consumer Complaint: I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Please provide a complete account history, including any charges added for collection activity.
