Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: On XX/XX/2020 XXXX unsure of the exact day ), a derogatory debt was reported on my credit report. I called the lender, which was now in collection with National Credit Systems in XXXX, GA. I talked to a Ms. XXXX XXXX with the credit company. She explained that they had to investigate with the apartment company that the debt was with. She requested I send copies of two ID 's ( driver 's license and social security card ) to verify my address and identity so that they can investigate and remove the error from my report. I sent the information, but nothing happened. After talking to her several times, she finally transferred me to another person without even explaining that she was transferring me. She did this multiple times when I called her. I don't know if this is a scam or someone that is rude. The XXXX has many complaints on this credit company, but they verified that it was a legitimate company. Company : National Credit Systems Address : XXXX. XXXX XXXX, XXXX, GA XXXX Phone : XXXX ( ext. Consumer Complaint: I contact National Credit System in XXXX because they are reporting on my credit an account for {$2900.00}. I sent them a dispute letter by certified letter asking them to verify the debt. I never heard back from them. So I decided to call them. Before even saying anything regarding that account I let them know that I was recording this call. The representative proceeded to ask me my name and account number. I told them I do not have and account with them, and the number I have is of my credit report and it shows 2 X at the end. They told me I needed the full account number for them to find the account. So she ask for my social security number I gave it to her and again no account was found. She then use my name and an account came up, an account that had my partial name and a different SSN. They didnt have ANY of my information, I had to give it to them. Then told me to send them a copy of my FTC identity theft report in order for them to remove the account. I did it and still nothing. So I disputed it with the credit bureaus and and they told the bureaus they will not remove the account from my report. Ive had enough of their shenanigans, Im at the point where Ill be taking legal action and it will result in small claims legal action against them at my local venue. I would be seeking a minimum of {$1000.00} in damages per violation for : Defamation Negligent Enablement of Identity Fraud Violation of the Fair Debt Collection Practices Act ( including but not limited to Section 807-8 ) Violation of the Fair Credit Reporting Act ( including but not limited to Section 623-b )

Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C. 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. Finally, you are reporting the INQUIRIES that are the result of the same type of fraudulent activities. It must be noted that I did not apply for credit accounts with the below-listed companies and creditors, some of these are the result of attempts to open accounts, but the companies did not approve the accounts. Therefore, these inquiries must be deleted from within my credit file. You can not delete the fraudulently opened accounts without also deleting the fraudulent inquiries. It should be noted that an inquiry that was not made by me is not a factual record, just as a fraudulently opened account is not a factual record and not referred to the creditor to be disputed directly with them. The credit reporting agencies have attempted to address an inquiry as a factual record of file access, but if it was done through fraudulent means, it is not a factual record. As a consumer, I should not be required to dispute each fraudulent inquiry directly with each company. These inquiries are the result of fraudulent activity and therefore, inaccurate in which the credit reporting agencies or the creditors can not verify, meaning that these inquiries are unverifiable information and must be deleted from my credit files. 1. NATIONAL CREDIT SYSTEM bal. {$1000.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Consumer Complaint: My identity was stolen and used to open an apartment in the state of NC, I have never lived in nor do I know anyone that resides in NC, I have lived in GA for over 15 years. upon further review of my credit report, I saw that there was a balance of {$3000.00} and contacted the debt collection agency, National Credit Systems. I informed them that the debt was not mine and they sent me an affidavit to fill out. Prior to mailing it back, I called National Credit Systems to ensure there wasn't any additional information I would need to send along with it, the manager stated no, just the affidavit. To be sure, I sent a copy of the police report and my drivers license along with the notarized affidavit in the month of XXXX by certified mail which they validated they received XX/XX/2021 and that the fraud process would take 30 days, they were waiting on the rental community to verify the validity of the debt. I called again in the beginning of XXXX and they stated they were still in the process of validation. I called again in mid XXXX and they stated their investigation was complete and that they needed more information ( they made no attempt, written nor telephonic to request more information from me ), upon asking to speak with the fraud department they told me that I was unable to speak with them, they do not have a phone number/direct line to the department. Within the same call as I proceeded to get frustrated, the manager stated that the debt was verified to be mine and has been sent to their sister company ( Law Firm : XXXX XXXX ) and I needed to contact them for further information, there was nothing they ( National Credit Systems ) could do. Upon contacting XXXX XXXX, they stated that I needed to contact National Credit Systems regarding the fraud-related portion of the debt and I also needed to send them everything that I have already sent National Credit Systems for them to review. The companies have continued to place the file on my credit for debt collection, latest dates being XX/XX/2021 and XX/XX/2021.The companies have not completed their full due diligence to verify the validity of the debt nor have they provided me with supporting evidence of the results of their " investigation ''. Due to this, my credit score has lowered and I am unable to move out of my current residence due to the eviction still being reported on my credit.

Consumer Complaint: I was hoping it wouldnt come to this. But XXXXXXXX XXXX deserve to be protected!! I lived at XXXX XXXX XXXX for 2 years. I gave them 2 years of loyalty, never a late payment in spite of having to deal with, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX one of which was a good friend of mine in the neighborhood who owned the liquor store across from the apartment complex that happened directly across the street from my apartment unit and another third shooting that happened in my apartment complex at XXXX XXXX. Is one supposed to have to live like that? I carried out 2 years and when it was time for me to sign my third lease I had the option to sign that lease 2 months in advance. At the time my finances were not in the best position to move so I went ahead a signed the lease. Well, things changed when my friend was shot at the store, I needed to desperately move and for a peace of mind. My XXXX, my friend had just been shot and killed in his own store that I frequently shopped at. I never asked for any sympathy but 1 month before my new lease was supposed to go into effect I went to talk to XXXX who was the XXXX XXXX XXXX of the company that owned XXXX XXXX XXXX which was XXXX XXXX. I just asked that because my lease had not gone into effect could they simply waive the fee that they charge to break the lease. I've been a great tenant despite the issues. You have already taken my deposit that I paid which I never got back. Now you want me to pay {$800.00} to break the lease. so boom they put the {$800.00} on my credit when they know I'm moving to another place. the debt hit my credit faster than I could move out. So now I just recently settled the payment at {$400.00} which they could have offered that before and met me half way but now it effects my credit. This how you do XXXX people when it comes to credit. The lease had not even gone into effect. This entire situation was insane. I held up my end of the bargain by paying 2 years straight but they failed me as a tenant. provided no safety measures following the first shooting, didn't even offer resources for therapy for the mental health issues that could arise from simply hearing XXXXXXXX XXXX. we do our communities a disservice when we don't show empathy and we make it all about the money. that is pure greed.
