Issue: Improper use of your report
Subissue: Reporting company used your report improperly
Consumer Complaint: My credit report is littered with negative items. I have attempted to call and REPEATEDLY write Experian, XXXX, XXXXXXXX XXXX XXXX and XXXX XXXX requesting that each of these private companies remove the numerus and violations of my privacy, as well as infringement on my rights of liberty and enjoyment for the better part of a year. These derogatory items have negatively and grossly impacted my life, causing me to be denied apartment rentals, denied consumer credit cards and other lines of credit. At no point have I EVER given any secondary or third party reporting agencies written permission to add these unfounded derogatory items to my report. Per the Fair Credit Reporting Act 15 USC 1681 section 602 a, " there is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and Experian are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which, by the way is backed by 15 USC 6801 which also states that " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX are all financial institutions by definition under that title. Additionally, 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX are the financial institutions and the Consumer reporting agencies, specifically XXXX, XXXX and Experian DO NOT have my consent to furnish this information and they most certainly do not have my expressed written consent. Any and all consent to XXXX, XXXX and Experian, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. Furthermore, according to 15 USC 6802 ( b ) ( c ), " a financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless, the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX at no point was I informed by any of these bureaus ( XXXX, XXXX nor Experian ) of my right to exercise my nondisclosure option. Additionally, per 15 USC 1681c ( a ) ( 5 ), " except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' These numerous, fraudulent and derogatory accounts on each of these credit bureau, consumer credit reports are clearly adverse items that are reported and once more, the bureaus are reporting them without my permission which is a violation of the law and several of my rights. Furthermore, 15 U.S. Code 1681s2 ( a ) ( 1 ) a states that a person " shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. Also, 15 U.S. Code 1681e states that " every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of, section 1681c of this title and to limit the furnishing of consumer reports for the purposes listed under section 1681b of this title. XXXX, XXXX and Experian are clearly not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. I am definitely opting out of your reporting services.

Consumer Complaint: I have already sent a letter addressing the inaccuracies and unknown items on my credit report, but unfortunately, I have not received any response even after 30 days. It feels like I'm being taken advantage of and my disputes are being ignored. According to Section 611 ( a ), if these items are not investigated within 30 days, they should be promptly removed from my credit report. Since it has been over 30 days, I expect these accounts to be updated immediately. If not, I will have no choice but to pursue legal action due to the stress this situation has caused me. Consumer Complaint: I am trying to buy a house and these things are delaying my home buying process. I have been a victim of aggravated identity theft. I need these items removed asap. Each creditor should have form SSA-89 signed by the consumer whenever credit is requested that way they have proof it was mailed and received by the said consumer and that way each person knows if/ and when fraud has or hasn't been committed. That form was requested by me to the creditor and they have yet to send that. It's been over 30 days since requested and over the timeframe. If they can't provide it they need to respectfully remove these items. Study what this form entails. I understand my consumer rights and how to proceed. I will contact the XXXX, and state attorney general to let them know such things are happening and not being honored if this isn't handled asap. Do not send a bill as a bill doesn't provide sufficient proof the said has applied for anything. Thank you for your prompt assistance.
