Consumer Complaint: Dear Consumer Financial Protection Bureau, Under the Fair Credit Reporting Act ( 15 USC 1681, Section 602a ), it is emphasized that consumer reporting agencies, such as XXXX, Experian, and XXXX must carry out their responsibilities with fairness, impartiality, and respect for the consumer 's right to privacy. As a consumer, I am entitled to ensure the protection of my private information, as supported by 15 USC 6801, which states It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' The entity providing information to credit agencies, commonly known as the 'Furnisher of information, ' qualifies as a financial institution under this title. According to 15 USC 1681, Section 604 a ( 2 ), a consumer reporting agency may only furnish a consumer report in accordance with the written instructions of the relevant consumer. In this case, both the financial institution ( Furnisher of information ) and the consumer reporting agencies, XXXX, Experian, and XXXX lack my consent and, specifically, my written consent to furnish this information. Referring to 15 USC 6802 ( b ) ( c ), which states that A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. Unfortunately, the furnisher of information did not inform me of my right to exercise this option. Furthermore, 15 USC 1681C ( a ) ( 5 ) explicitly states Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. Therefore, reporting this adverse item without my permission is a violation of the law. According to 15 U.S. Code 1681s2 ( A ) ( 1 ) A, A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. Additionally, 15 U.S. Code 1681e mandates that every consumer reporting agency must maintain reasonable procedures to avoid violations of section 1681c and limit the furnishing of consumer reports to the purposes listed under section 1681b. XXXX, Experian, and XXXX appear to be failing in maintaining these reasonable procedures. Furthermore, as per 12 CFR 1016.7, XXXX, Experian and XXXX have failed to comply with all the laws mentioned above. I, the consumer, am rescinding any previous authorization given to XXXX XXXX, whether it was written, unwritten, verbal, or nonverbal, to report ANY of my transaction history to ANY credit bureau. Not only am I opting out of all or any authorization, but I am also requesting that XXXX XXXX cease and desist immediately from all illegal activities. Finally, the CFPB is required to contact the consumer reporting agencies to update my consumer credit profile accordingly, specially for any transactions that XXXX XXXX has reported or any other transaction history or experiences I have with XXXX XXXX, please have them fix these violations by deleting these transactions from my consumer report. Consumer Complaint: Pursuant to FCRA, XXXX credit bureau must furnish true and accurate information reported on the consumer. XXXX is required to obtain the original contract with the consumer 's wet signature to furnish a report on the consumer. XXXX XXXX XXXX has been reporting delinquent account information on to my credit report to harm my reputation and credit worthiness. I have never had any relationship with XXXX XXXX XXXX. I have disputed this account with XXXX more than once and XXXX has refused to validate the debt. Subsequently, the incorrect account has remained on my credit report. XXXX XXXX XXXX has sent written documentation confirming that an unlawful purchase in violation of the Privacy Act of 1974 took place of my personal identifiable information. XXXX XXXX XXXX is a third party, not a party affiliated with any agreement with XXXX XXXX, who is engaging in unlawful debt collection practices to harass consumers in to making payments towards fraudulent contracts. XXXX XXXX XXXX has provided documentation stating that the collection attempts are for a contract XXXX XXXX XXXX is not a party to. Failure to provide a written contract between XXXX XXXX XXXX and XXXX XXXX make the fraudulent relationship void ab initio. XXXX XXXX XXXX has kept record of my personal identifiable information without my consent. XXXX XXXX XXXX has made an unlawful purchase of my personal identifiable information with XXXXXXXX XXXX to engage in unfair and abusive debt collection practices. XXXX XXXX XXXX has furnished false reports to at least 3 credit bureaus, including XXXX, Experian, and XXXX, to harm the reputation of consumer XXXX XXXX without lawful proof of any debt obligation. Consumer Complaint: Attached, please see I have tried several times, XXXX ( XXXX ) to Experian credit reporting agency only, to please remove a creditor, XXXX bank that they continue to report twice on my Experian credit report, both with potentially negative next to both. This Creditor, XXXX bank was an original personal loan for {$9000.00} then due to XXXX XXXX medical complications and being seriously injured XXXX XXXX XXXX XXXX XXXX. I fell behind in monthly payments. I stayed in contact with XXXX bank, promising to work out a payment plan as soon as I could. This contact was by phone about every month. Finally after getting out of the hospital, regaining my balance and finding a new job, I contacted XXXX bank personally by phone in XXXX of XXXX. I spoke with the supervisor in the collections department and worked out a payment to settle this account for less then the balance owed. I paid that agreement amount via my banking information, given to XXXX bank. The amount of agreement was deducted and payed off this account. I received a fax from XXXX bank of settlement, paid as agreed and closed. This information was provided to all three credit reporting agencies and appears as updated as of XX/XX/XXXX with account # beginning with XXXX. Also, appearing on my Experian credit report is another XXXX bank account, with a different account # which is XXXX with identical account information because it is the same XXXX bank account creditor, but this account reads, Transferred, closed, {$7300.00} writing off with updated as of XX/XX/XXXX. Thats it. This information causes an illusion of appearing that another account/ creditor XXXX is showing a possible XXXX separate account with same account information as the original but with deceptive information as to account closed due to transfer, closed and written off. This information is false, inaccurate and misleading information as it relates to only one XXXX account with # XXXX that was settled in XX/XX/XXXX in that settlement, then reported as paid for less then owed, settled, closed. This information is being correctly reported by XXXX and XXXX but not Experian, who has continuously denied, refused and ignored my three disputed claims on three separate occasions to correct and remove this second XXXX account information with last updated information being stated by Experian as of XX/XX/XXXX and its information as to transferred, closed with a balance of {$7300.00} written off. Not removing this old, outdated, misleading and inaccurate information from my Experian credit report has continued to show as seen in pics Im providing, causing confusion and the illusion of two potentially negative accounts with identical information but one with different account information and different account # with last update of XX/XX/XXXX but only the XXXX account with identical information with correct account information as paid, settled for less then owed and updated information of XX/XX/XXXX should only be provided, showing on my Experian credit report. The other inaccurate XXXX account with last updated information of XX/XX/XXXX should be removed immediately. This is the XXXX time Ive attempted to file a complaint against Experian to comply and remove false, inaccurate and misleading information as to this XXXX outdated information and related inaccurate information be removed. Im asking for your help again with more additional details and information to force Experian to remove this information immediately. This really comes down to incompetent and ignorant individuals within Experian to just use common sense but refuse to ignore that facts as I, the consumer suffers from negative information that affects my fico score and applying for credit, future credit card companies will see this information as two separate accounts with negative information and not one with showing the only one XXXX account was actually paid, closed and settled.
