Consumer Complaint: In accordance with the Fair Credit Reporting Act, this creditor has violated my rights under 15 USC 1681, section 602, which states I have the right to privacy. 15 USC 1681, section 604 ( a ), section 2, also states that a consumer reporting agency can not furnish an account without my written instructions. Under 15 USC 1666 ( b ), a creditor may not treat a payment on a credit card account under an open and consumer credit plan as late for any purpose. I am writing to file a formal complaint against XXXX XXXX for improper use of my consumer report and continued reporting of an account that was allegedly included in a bankruptcy in XXXX. I have contacted XXXX XXXX, expressing my desire to opt out of any use or sharing of my nonpublic personal information, and despite my efforts, the issue persists. XXXX XXXX has improperly used my consumer report in violation of my rights. Despite my clear indication to opt out of any use or sharing of my nonpublic personal information, XXXX XXXX has continued to access my consumer report without authorization. An account that was allegedly included in a bankruptcy in XXXX is still being reported by XXXX XXXX. This reporting is inaccurate and has a detrimental impact on my credit history. I have previously contacted XXXX XXXX XXXX XX/XX/XXXX by telephone and by notorized formal written request, to address these issues and have opted out of any use or sharing of my nonpublic personal information. Despite my efforts, the problems persist, and I have not received a satisfactory resolution from XXXX XXXX. I request that the Consumer Financial Protection Bureau investigate the improper use of my consumer report by XXXX XXXX and their continued reporting of an account supposedly included in a bankruptcy. I request that XXXX XXXX be required to promptly remove any nonpublic personal information they have inappropriately accessed or used. I request compensation to the maximum extent allowed by law for the inaccuracies in reporting, the improper use of my consumer report, and any resulting harm to my financial standing.

Federal courts recently have issued rulings about the use of consumer reports for the collection of an account under the Fair Credit Reporting Act ( FCRA ) Delinquent child support obligation is NOT a credit transaction. As a result, the courts found that collection of this account was not a valid permissible purpose to obtain or report a consumer report. According to the case law XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX ; XXXX, XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX judgments are not considered credit transactions, and it is illegal to report them on a credit report. based on case law XXXX XXXX XXXX XXXX XXXX XXXX XXXX, Experian Information Solutions , IncXXXX, No. XXXX, XXXX XXXX XXXX XXXX, XX/XX/XXXX ( XXXX XXXX XXXX XXXX XXXX XXXX and caselaw XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Experian Information systems , XXXX XXXX, XXXX XXXX XXXX XXXX, XX/XX/XXXX ( XXXX XXXX ), child support accounts are not credit transactions and they are judgements. These accounts are in violation of the FCRA laws of 15 USC 1681 ( a ) ( 2 ) that requires credit bureaus to maintain accurate and reliable records. I requested theses violations be deleted immediately and a written confirmation within 30 days. There responses was that those accounts belonged to me, again they are also in violation of 15 U.S.C. $ 1681b ( b ) ( 1 ) ( A ) - the Certification Requirement. which I requested them to provide the following As an example, for collectors of delinquent child support debt, judgments, fines, or liens, you must have in hand : A written authorization from the debtor to obtain a consumer report, or Some type of contractual agreement with the consumer that rises to the level of a credit transaction under law.

Consumer Complaint: According to 15 use 1681eb Everything must be 100 percent max accurate The credit bureaus keep disrespecting the laws. I showed them multiple times of how they are violating the Fair Credit Reporting Act. According to 15 use 1681 ( 5 ) The credit bureaus said everything was complete and accurate and I asked them how if the open date is wrong. Then I ask them to provide me description of the investigation according to 15 USC 1681 ( 7 ) and they never did. I have proof of my letter for that. Also according to 15 USC 1681 s-2 A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. This is violation after violation after violation. This is causing me stress because I have no hope with this system
