Consumer Complaint: XXXX continues to report the consolidated loans to the credit bureaus, while the loans are continuing to accrue interest and the balances continue to increase which is negatively impacting my credit scores and credit profiles. My latest credit bureau reports state that the balances on that consolidated loan balance has increased again. That solely decreased my credit score. Here is what the US. Department of Education is saying about forbearance and interest on borrower defense approvals. " Title 34, Subtitle B, Chapter VI, Part 685, Subpart D, Section 685.406 ( 1 ) Approval of a Borrower Defense Claim. If the Secretary approves the borrower defense claim ( i ) The written decision states the Secretary 's determination and the relief provided as defined in 685.401 on the basis of that claim. ( ii ) The Secretary places a borrower 's Direct Loans associated with a group borrower defense claim into forbearance until the Secretary discharges the loan obligations under 685.212 ( k ). If any balance remains on the Direct Loans not associated with the borrower defense claim, those loans will return to their status prior to the claim process. The Secretary resumes collection activities on those Direct Loans not associated with the borrower defense claim no earlier than 90 days from the date the Department official issues a written decision. No interest will be charged on the loans during the forbearance period. " Those consolidated loans are a part of the Borrower Defense to Repayment approved application and they are supposed to be discharged and the tradelines deleted from my credit profiles. While in forbearance and awaiting discharge they should not be accruing interest. Why is interest still accruing? XXXX XXXX

I informed them of their violations to my consumer report and provided a list of the accounts. They have not responded in excess of XXXX days. All of the letters that were sent are attached below. By failing to mark this disputed account as disputed, this company has violated FCRA 623 ( a ) b ). Since this account 's last activity date is reporting, 605 ( c ) is operating if the period has also been broken. The last date on which a payment was made should be reflected. The Federal Trade Commission believes that this company has consistently neglected to verify this collection account, thereby breaching FDCPA 809b.
