Consumer Complaint: In accordance with the provisions outlined in the Fair Credit Reporting Act ( FCRA ) under 15 USC 1681 section 602 ( a ), it is mandated that consumer reporting agencies, such as XXXX, Experian, and XXXX, exercise their significant responsibilities with fairness, impartiality, and due regard for the consumer 's right to privacy. Referring to 15 USC 1681 section 604 ( a ) ( 2 ), it is explicitly stated that a consumer reporting agency may furnish a consumer report only in accordance with the written instructions of the respective consumer. To this effect, neither the financial institution, as defined in 15 USC 6802, nor the consumer reporting agencies, XXXX, Experian, XXXX, etc., possess my consent, whether explicit or implied, to disclose my information. All forms of consent, be they verbal, non-verbal, written, implied, or otherwise, are hereby revoked. Moreover, in compliance with 15 USC 6802 ( b ) ( c ), a financial institution is prohibited from disclosing nonpublic personal information to a nonaffiliated third party without providing the consumer with an explanation of how to exercise the nondisclosure option. In this instance, I was never informed of my right to exercise such an option. Lastly, in accordance with 12 CFR 1016.7, I am exercising my right to opt out of your reporting services at this time. This decision is made in light of the aforementioned legal provisions and the failure of the financial institution and consumer reporting agencies to uphold the necessary procedures and disclosures as mandated by applicable laws.

I am still waiting on the letter from XXXX XXXX as they once again reported me as delinquent but instead of in XX/XX/XXXXXXXX they changed it to XX/XX/XXXX. I have three weeks to move and my and my kids now have no were to go because of this. I have contacted a lawyer, and plan to sue XXXX XXXX as they are unwilling to fix their issue. They have reported illegal information, this card had nothing at all to do with the bankruptcy, nothing at all, I do not understand why it is so hard for them to read. I will try again the XXXX XXXX was filed in XX/XX/XXXX, and discharged in XX/XX/XXXXXXXX if the card was not open in XXXX it could not be included in the bankruptcy, it was illegal of them to closed the account using an old bankruptcy case. And no payments were late, as they refused to take a payment from me in XX/XX/XXXXXXXX this is all XXXX XXXX error. Consumer Complaint: My disputes have not been properly investigated nor reinvestigated as you claim. My rights, as protected under the Fair Credit Reporting Act ( FCRA ), specifically 15 U.S. Code 1681s-2 ( b ), have been blatantly disregarded, leading to significant personal and financial distress. Despite my repeated attempts to rectify these inaccuracies, including direct communication and provision of evidence to your agencies, the wrongful information persists. Under the FCRA, you are obligated to conduct a thorough and reasonable investigation of disputed information upon receipt of a consumers dispute. Failure to do so, as evidenced in my case, is a direct violation of 15 U.S. Code 1681i ( a ). I have never knowingly entered into any agreement or contract with XXXX or XXXX, nor with any entities they claim to represent. The documentation provided by XXXX in response to my request for proof of debt was grossly inaccurate, containing information and a name not attributable to me. This is a clear violation of 15 U.S. Code 1681e ( b ), which requires credit reporting agencies to follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. Moreover, XXXX has completely neglected to respond to my requests for validation, further exacerbating the issue. This non-compliance is an infringement of my rights under the FCRA and demonstrates a lack of due diligence required by law. The ongoing misreporting of my credit history has led to significant financial loss, reputational damage, and emotional distress. This situation is further compounded by the fact that I have been a victim of identity theft, a circumstance that has been aggravated by the widely reported XXXX data breach. Despite providing substantial evidence to support my claims of identity theft, as required under 15 U.S. Code 1681c-2, my documentation has been repeatedly overlooked for 2+ years now. I have compiled hundreds of certified green receipts between these companies showing proof that I have repeatedly mailed via USPS documentation proving these accounts to be fraudulent and Experian continue to willfully report this false information on my CONSUMER file. To date, the resolution of disputes I filed, most recently on XX/XX/2024, has been grossly mishandled. Notices from Experian, for instance, declare the account in question as certified without providing requisite proof. This approach not only contravenes the FCRA stipulations for accuracy and verification but also my rights under the Consumer Credit Protection Act ( CCPA ), which emphasizes fair and respectful treatment of consumers in the credit marketplace. The negligence exhibited by your organizations in handling my credit information is a clear violation of the FCRA, particularly sections pertaining to the accuracy and integrity of credit reporting ( 15 U.S. Code 1681e and 1681i ). This negligence has cost me time, money, and a significant detriment to my financial reputation and enjoyment of life. Consequently, I demand the immediate and complete removal of all false information from my consumer file. Should this issue not be resolved promptly and satisfactorily, I am prepared to escalate this matter by filing formal complaints with the Federal Trade Commission ( FTC ), the U.S. Securities and Exchange Commission ( SEC ), the Better Business Bureau, the federal Bureau of Investigation, ( FBI ) and pursue any and all legal action in the appropriate civil courts. I expect a written response confirming the rectification of these inaccuracies and a detailed report of your investigation findings, sent to me via the United States Postal Service, as a matter of urgency and legal compliance. Once again, I do not, nor have I ever had a loan or a contract with XXXX or XXXX, nor any company they claim to represent. I demand a copy of the alleged contract with my signature on it and my information and if no such contract can be produced, I demand that these fraudulent accounts be removed from my CONSUMER file immediately. 15 U.S. Code 1681s-2 ( b ) ( A ) Reporting information with actual knowledge of errors ( I have provided physical proof that the disputed account are inaccurate, incomplete and not mine, therefore Experian, XXXX and XXXX are knowingly reporting false information ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. ( B ) Reporting information after notice and confirmation of errors A person shall not furnish information relating to a consumer to any consumer reporting agency if ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate; and ( ii ) the information is, in fact, inaccurate. ( 2 ) Duty to correct and update information A person who ( A ) regularly and in the ordinary course of business furnishes information to one or more consumer reporting agencies about the persons transactions or experiences with any consumer ; and ( B ) has furnished to a consumer reporting agency information that the person determines is not complete or accurate, ( 7 ) Negative information ( A ) Notice to consumer required ( i ) In general If any financial institution that extends credit and regularly and in the ordinary course of business furnishes information to a consumer reporting agency described in section 1681a ( p ) of this title furnishes negative information to such an agency regarding credit extended to a customer, the financial institution shall provide a notice of such furnishing of negative information, in writing, to the customer. b ) Duties of furnishers of information upon notice of dispute ( 1 ) In general After receiving notice pursuant to section 1681i ( a ) ( 2 ) of this title of a dispute with regard to the completeness or accuracy of any information provided by a person to a consumer reporting agency, the person shall ( A ) conduct an investigation with respect to the disputed information ; ( B ) review all relevant information provided by the consumer reporting agency pursuant to section 1681i ( a ) ( 2 ) of this title ; ( C ) report the results of the investigation to the consumer reporting agency ; ( D ) if the investigation finds that the information is incomplete or inaccurate, report those results to all other consumer reporting agencies to which the person furnished the information and that compile and maintain files on consumers on a nationwide basis ; and ( E ) if an item of information disputed by a consumer is found to be inaccurate or incomplete or can not be verified after any reinvestigation under paragraph ( 1 ), for purposes of reporting to a consumer reporting agency only, as appropriate, based on the results of the reinvestigation promptly ( i ) modify that item of information ; ( ii ) delete that item of information ; or ( iii ) permanently block the reporting of that item of information. information. ( 2 ) Deadline A person shall complete all investigations, reviews, and reports required under paragraph ( 1 ) regarding information provided by the person to a consumer reporting agency, before the expiration of the period under section 1681i ( a ) ( 1 ) of this title within which the consumer reporting agency is required to complete actions required by that section regarding that information.
