Consumer Complaint: Experian XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX Dear sir, Today, I received the credit report ( # XXXX ) of your company by mail and decided to inquire why your company credit report online has the personal statements, which states : ID FRAUD VICTIM ALERT FRAUDULENT APPLICATIONS MAY BE SUBMITTED IN MY NAME OR MY IDENTITY MAY HAVE BEEN USED WITHOUT MY CONSENT TO FRAUDULENTLY OBTAIN GOODS OR SERVICES. DO NOT EXTEND CREDIT WITHOUT FIRST CONTACTING ME PERSONALLY AND VERIFYING ALL APPLICATION INFORMATION AT DAY XXXX OR EVENING XXXX. THIS VICTIM ALERT WILL BE MAINTAINED FOR SEVEN YEARS BEGINNING XXXX. FILE FROZEN DUE TO FEDERAL LEGISLATION As you might have realized this part, personal statements, is not included in the printed credit report. And as far as I see with other company printed credit reports and online reports, this part is not included. This discrepancy might be said allowable due to the nature of private company, which allows the individual expression of document. However, I believe the function of credit report should be the statement of private and individual information, which needs to be kept safely. Therefore, I wonder why the United States government allows these credit report companies create their own format of credit reports. I believe it need to have the consistency to show the reliability ; otherwise, they are not reliable and allows the possibilities to create several possibilities of identity formation, which might allow the identity fraud. Since other companies do not have this part in the credit reports, I expect you will explain why you added this part in the online version. If you consider this part is unnecessary after a few months questions why my credit report has the duty alert even though I asked many times the reason why this alert had added. Your company has never answered this question and now you just omitted this questionable part as if to tell it is not important at all since, I have a good credit score and do not have to worry so much. To say truth, other company credit reports do not have the credit score at all. I can not see any credit score at other company website. I expect your company will explain why your company credit report tends to delete many things without any explanation, because this is my credit, not yours. Your company needs to remind yourself you are just one private company in the middle of global world. What is this FILE FROZEN DUE TO FEDERAL LEGISLATION. I need the explanation on this part. And I request the clarification of meaning of EXTEND, because it might have the extension of fraud alert or extension of credit limit. If it is meant the latter, your company shows the function of credit card company ; therefore, I need to ask another question why your company needs to ask the credit card companies not to extend the limit. Consumer Complaint: To Whom It May Concern : I recently received a copy of my ( Experian XXXX XXXX ) credit report, and I noticed a late payment of 30 days posted on my credit report : XXXX XXXX XXXX, XXXX account ending in XXXX for XX/XX/2019. XXXX XXXX XXXX XXXX XXXX XXXX Experian- Your company is in clear violation of the law. Under 15 USC 1681b - permissible purpose of consumer reports, THE LAW CLEARLY STATES : ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the written instructions of the consumer to whom it relates. Did I give you written instructions to furnish this on my credit report? Furthermore, the FAIR CREDIT REPORTING ACT 15 USC 1681 ( 2 ) ( a ) ( i ) Exclusions from a consumer credit report clearly states : ( 2 ) EXCLUSIONS. Except as provided in paragraph ( 3 ), the term consumer report does not include ( A ) Subject to section 1681s-3 of this title, any ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report. 15 USC 6802 ( b ) ( c ) states that 'A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unlessthe consumer is given an explanation of how the consumer can exercise that nondisclosure option. ' ( Furnisher of information to credit agencies ) XXXX & Experian nor XXXX XXXX XXXX NEVER informed me of my right to exercise my nondisclosure option. Not only that, 15 USC 1681C ( a ) ( 5 ) states : 'Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : Any other adverse item of information, other than records of convictions of crimes which antedate the report by more than seven years. ' This account is an adverse item they are reporting again without my permission, which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states : 'A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states : 'Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. ' XXXX and Experian are not maintaining reasonable procedures. Also, 12 CFR 1016.7 states that 'A consumer may exercise the right to opt-out at any time. ' I am opting out of your reporting services for the XXXX XXXX, 30 day late payment on account ending in XXXX per 15 USC 6802 & 16 CFR 313.7. Delete the above late payment for account ending in XXXX for XX/XX/2019 from my consumer report, this agency is in violation of 15 USC 1681. Failure to respond satisfactorily with deletion of the above referenced account, and send out a free copy of my report after the changes have been made will result in legal actions being taken against your company, for which I will also be seeking { {$1000.00} } per violation for : 1. Defamation of Character ( per se ) 2. Negligent Enablement of Identity Fraud 3. Fair Debt Collections Practices Act 15 USC 1692g violations. 4. XXXX XXXX XXXX colluded with XXXX XXXX of XXXX XXXX, TX to defraud me into buying a car that was almost XXXX times the worth. I attached the Settlement offer that XXXX company I came into agreement so that I could be done with this fraud against me. I paid a total of {$1400.00} to end this fraud perpetrated against me due to me not having knowledge of buying a car. They took total advantage of me. I have included the total contract. They electronically signed my name and I was not aware of how much this car was until I received the contract in the mail XXXX weeks after having the car. I did not have a XXXX paper in the window of the car or nor was it produced to me. I was taken advantaged of and want the CPFB to look into this contract also. I am complaining that XXXX XXXX XXXX allowed this incorrect and inaccurated information to be projected on my credit report erroneously thereby causing me harm, financial hardship, and credit denial. I tried to get XXXX to accurately reflect that my account was correct, From XX/XX/2023 to present reporting of this fradulent reporting, they are still reflecting a negative and erronous amount on my report. I am asking that the CFPB send this complaint to the appropriate entity that will help me with taking the next step so that I can be compensated for XXXX XXXX blatent false reporting of negative items on my report that caused me and my family harm. My credit score suffered due to this erronous reporting of inaccurate information that harmed me per failure due to a violation of the Fair Credit Reporting Act ( 15 U.S.C. state statute 1681 g ). I want XXXX to take all late payments off my credit report due to a Pandemic that kept me and other Americans from going to work due to Covid-19 Pandemic.
