Consumer Complaint: On XX/XX/2024 I notified this agency that I was a victim of identity theft via certified mail and as of today XX/XX/2024 this agency continues to report information that resulted from the identity theft. Section 605B, Block of Information Resulting From Identity Theft, requires consumer reporting agencies to notify furnishers of information, including financial institutions, that information may be the result of identity theft, and that an identity theft report has been filed. I provided them with FTC report number XXXX and XXXX, as well as a block that had been requested. Upon receiving such notice, Section 623 ( a ) ( 6 ) requires furnishers to block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from identity theft, not later than 4 business days after the date of receipt by such agency of ; 1. appropriate proof of the identity of the consumer ; ( 2 ) a copy of an identity theft report ; ( 3 ) the identification of such information by the consumer; and ( 4 ) a statement by the consumer that the information is not information relating to any transaction by the consumer. All four requirements were met by me and will be attached to this complaint. At this time the agency has failed a requirement of the FCRA 15 U.S. Code 1681c2 to block the reporting of the information in my file that I identified as information that resulted from the identity theft, not later than 4 business days after the date of receipt by such agency which is a violation of law and is civilly liable to me for willful noncompliance actual damages sustained by me as a result of this failure under 15 U.S. Code 1681n. Resolution : For the agency to comply with the requirements of the FCRA 15 U.S. Code 1681c2 and block the reporting of the information in my file that I identified as information that resulted from the identity theft. Due to the failures to block the information no later than four days after receipt the agency is civilly liable to me for willful noncompliance actual damages sustained by me as a result of this failure under 15 U.S. Code 1681n. Consumer Complaint: XXXX XXXX XXXX has my XXXX 's social security number. They have said on the phone and accused me of giving them the wrong social security number and they are refusing to take ownership on their mistake, stating that they verify everything, yet somehow this social security number was linked with my birthday. This should not have happened. I spoke with their supervisor about this and my struggle to maintain payments and he recommended to file bankruptcy, as well as said that the issue with my XXXX 's SS would be resolved. Since then I have continued to receive over XXXX calls a week from XXXX XXXX XXXX, which is harassment per the law, and was advised by a bankruptcy lawyer to tell my creditors I was filing. ( I have not filed yet ). On the phone I was threatened by someone else named XXXX, after I advised them of this, who stated that they would garnish my wages and also accused me of lying about not giving them my XXXX XXXX social and lying about the XXXX advising to file for bankruptcy. It was also suggested by them that bankruptcy would impede their removal of my XXXX XXXX social security number from the loan. They are continuing to call me multiple times per week, around XXXX times a week under different numbers. I would like them entirely abolished from my credit report. They have too much information mixed up and can not be trusted.
