Consumer Complaint: There is a XXXX XXXX account on my credit report that does not belong to me. I have been disputing this with Experian for XXXX years. When Experian calls the company, XXXX XXXX confirms that it is my account, ALTHOUGH IT IS NOT! Upon further review I realized that there are XXXX social security numbers attached to my credit report, perhaps the person whom owes the account has my same name ( I don't know but I'll give the benefit of the doubt ). I asked Experian to delete the erroneous social from my account, they claim that they did. I have called XXXX XXXX and Experian several times and I'm in a constant loop with no remedy in sight. I don't understand how or why XXXX XXXX does not ask for a social security card/proof before putting debts on credit reports. With that all of this could have been avoided. Please Help!

Consumer Complaint: XXXX is intentionally being misleading by not revealing the most recent infomation. Although I asked previously for a discharge and should have received it, I am attaching a XX/XX/XXXX email from XXXX 's representative XXXX XXXX saying XXXX received my Cease and Desist and that there is no further responsability to repay the loan. Experian received a copy of this same email on various occasions via certified mail. I am also attaching the XX/XX/XXXX Notice to Cease and Desist and other documents that I sent via certified mail to XXXX in XXXX, PA. According to the attached page from the Internal Revenue Service site, charged off debts are considered income and XXXX is required to provide me a XXXX form. If XXXX refuses to provide me a 1099-C then this is tax fraud on XXXX 's part. According to the US Courts website ( document attached ) Creditors such as XXXX can not collect discharged debts This means Affirm may NOT make any attempt to collect a discharged debt from me personally. For example, XXXX can not sue, garnish wages, assert a deficiency ( i.e. make a negative report to the credit reporting agencies ), or otherwise try to collect from me personally on this discharged debt. XXXX can not contact me by mail, phone, or otherwise in any attempt to collect the debt personally. Any creditor who does not comply with this can be required to pay debtors damages and attorneys fees. According to page XXXX of XXXX 's XXXX form for the fiscal year ending XX/XX/XXXX ( attached and also found here XXXX XXXX XXXXXXXX ) : " The allowance for credit losses on loans held for investment is determined based on managements current estimate of expected credit losses over the remaining contractual term, historical credit losses, consumer payment trends, estimates of recoveries, and future expectations on individual loans as of each balance sheet date. We immediately recognize an allowance for expected credit losses upon the origination of a loan... The Company considers the impact of current economic factors at the reporting date that did not exist over the period from which historical experience was used. As of XX/XX/XXXX, we have considered the impact of Federal Reserve monetary policy, labor market trends, inflation and consumer sentiment... When available information confirms that specific loans or portions thereof are uncollectible, identified amounts are charged against the allowance for credit losses. Loans are charged-off in accordance with our charge-off policy, as the contractual principal becomes XXXX days past due. Consumer Complaint: Hello, My name is XXXX XXXX XXXX. I live at XXXX XXXX XXXX XXXX. I am not sure if youd need my SS but its XXXX. Me and my wife are in the process of buying a house. A loan officer said I have a student loan that is paid off but is showing up on my credit report as open. The company that was used to pull my credit was Experian. I have been trying to talk to creat an account on their website to get a credit report but an error screen keeps popping up on their website. I have tried calling support for the last three days. The one time I actually got ahold of an actual person my account got frozen and the specialist told me to call in 72 hours. I have been trying to get an actual live person to talk to for an 1.5 hours but am having no luck. Consumer Complaint: Experian Dispute Department Re : Formal Dispute and Request for Correction of Credit Report Information Dear Experian Dispute Department, I am writing to bring to your attention several billing errors and discrepancies on my credit report, which I recently obtained. After thorough review, I have identified violations of the United States Code Law, specifically the Truth in Lending Act ( TILA ) under 15 U.S. Code 1666 ( b ) ( billing error ), 15 U.S.C 1681A ( 2 ) ( B ), and 15 U.S.C 1681s2. Under 15 U.S. Code 1666 ( b ) ( billing error ), I observed the following errors : The creditor 's failure to properly reflect a payment made by me or a credit issued to me. Computation errors or similar errors of an accounting nature by the creditor on my statement. Additionally, it has come to my attention that the creditor failed to provide a statement 21 days before the due date, which is a violation of TILA. Consequently, there should be no late payments reported on my accounts, and I demand verifiable proof from the creditor 's bank account that supports any claim of non-payment leading to late marks. Lets begin with my name many of them are unidentifiable and need to me removed as well as you are reporting several non-mailable addresses that are undeliverable and I have requested removal of these on several occasions and it is now evident that many of these inaccuracies reporting is intentional pursuant to 15 U.S. Code 1681n - Civil liability for willful noncompliance. ( a ) In general Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer. 15 U.S. Code 1681b - Permissible purposes of consumer reports Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other ( 2 ) In accordance with the written instructions of the consumer to whom it relates. You need my written consent to add anything to my consumer report since I did not give this authorization then you are in violation of the Fair Credit Reporting Act.
