Consumer Complaint: I have reviewed my consumer report and have been made aware that it is reporting that I have a 60 day late payment on an account that was never late. To my understanding consumer reporting agencies have the duty of reporting consumer information accurately to the best of their ability. I have never been late and a 60 day late payment for on date XX/XX/XXXX is blatant inaccurate reporting. Please investigate provide proof, preferably with statements showing that this payment was late. Alternately, if proof can not be provided I demand that this payment be updated to " paid as agreed, on time '' as they should to reflect accurate reporting on my consumer report. Consumer Complaint: This is regarding the XXXX XXXX XXXX account. On XX/XX/2022 I contacted an alleged creditor. I will say alleged because I never received a debt validation letter and was never contacted regarding this debt. When I contacted the creditor I had been informed by the original debtor that my balance was {$1900.00}. I attempted to pay the balance to original debtor, they accepted the payment and then the debt collection agency said that the amount was incorrect. Every credit agency is reporting the original and current balance of the debt being {$2000.00}. The orginal amount of the debt was {$1900.00}. The company that I paid for the debt was not the creditor listed but a company called XXXX XXXX XXXX XXXX To this company I paid {$2400.00}. And yet the balance verified by the credit agencies is still {$2000.00} or {$2000.00} depending on which credit report you look at. Every site has a different and inaccurate amount that continues to be verified as accurate Not only are there inaccuracies with balance, but I was never notified by the company about the debt in the first. They never gave me an opportunity to verify it or pay it ahead of time. Also, the dates listed of payment are inaccurate. I paid the alleged balance in full on XX/XX/2022 but it's listed as paid in full in XXXXXXXX XXXX XXXX Please refer to 15 USC 1681 : where it states that consumer reports must be accurate. I am reporting to you an instance of inaccuracy and it is not being removed. This information is not correct and thus be removed Furthermore, a 1099c has been filed on this account which makes it income for me and income can not be reported as a collection account. My account with this company was never authorized with my express written or verbal consent to report any adverse information in relation to credit card with them. Per the FCRA, as a federally protected consumer, I am now opting out of any and all authorization I, the consumer, may have given you written, unwritten, verbal and non-verbal per 15 USC 6802 to report any adverse information in relation to my account. That includes balance information and missed payments. Please also see this code for the penalties associated with not respecting my request to opt out of the reporting of adverse information.

'' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. Consumer Complaint: Demand for Compliance with 15 U.S. Code 6802, 12 CFR 1016.7 Section ( a ), 5 U.S. Code 552 ( a ) & ( b ), and Account Removal Request Dear Equifax, XXXX, and XXXX Customer Relations Frauds department, I hope this letter finds you well. I am writing to bring to your attention certain legal provisions under the Gramm-Leach-Bliley Act ( GLBA ), specifically 15 U.S. Code 6802, which outlines obligations concerning the disclosure of nonpublic personal information. In conjunction with this, I have attached a relevant Federal Trade Commission ( FTC ) report for your reference. According to 15 U.S. Code 6802, a financial institution is prohibited from disclosing nonpublic personal information to a nonaffiliated third party unless certain conditions are met. These conditions include providing clear and conspicuous disclosure to the consumer, offering the consumer an opportunity to opt out of such disclosure, and explaining how the consumer can exercise the opt-out option. Furthermore, regulations such as 12 CFR 1016.7 Section ( a ), 5 U.S. Code 552 ( a ) & ( b ), along with 1016.7 and 162.6, detail the form and methods of opt-out notices to consumers, emphasizing the consumer 's right to opt out of the disclosure of their information to nonaffiliated third parties. Additionally, 1022.24 stipulates that covered affiliates must provide consumers with a reasonable opportunity to opt out when using eligibility information for solicitation purposes. As per the Credit CARD Act of 2009, consumers have the right to opt out of interest rate increases, fee increases, and other significant changes in terms, as outlined in 15 U.S. Code 6805.
