Consumer Complaint: I was contacted stating that my information was exposed during a data breach from the Credit Reporting Agencies. I begin to monitor my credit report. I recently noticed a list of credit inquiries I did not authorize nor did I request. Furnishing information to my credit profile without my written consent is in violation of 15 USC 1681B. Consumer Complaint: CFPB XXXX XXXX XXXX XXXXXXXX XXXX XXXX Subject : Dispute and Request for Removal of Unauthorized Hard Inquiry from Credit Report Dear CFPB, I am writing to formally dispute and request the removal of a hard inquiry that appears on my credit report. After reviewing my credit report, I noticed inquiries listed under my name that I did not authorize or initiate. These inquiries are impacting my credit score negatively until today. I was a victim of the Equifax data breach. I want these items deleted immediately from my credit reports. Consumer Complaint: [ Amended complaint ] On XXXX XX/XX/XXXX XXXX closed out CFPB complaint XXXX claiming it was a duplicate of CFPB XXXX. It in fact was not as XXXX provided detailed evidence that showed the account, as reported across the CRAs, contains facially false data and illogical data. In particular, the account/trade reports derogatory information that predates earlier reports that did not include the derogatory information, and information that is plainly inconsistent with other reported information, such that XXXX piece of information must is inaccurate. From XX/XX/XXXX to XXXX XX/XX/XXXX, XXXX willfully or negligently failed to comply with its responsibilities under the FCRA found at 15 U.S.C. 1681s-2 ( b ) by initially failing to conduct a timely investigation with respect to the disputed information contained in the Consumer 's credit reports after receiving notice of the disputes by Equifax, XXXX, and XXXX, XXXX failing to review all relevant information provided by Equifax, XXXX, and XXXX, XXXX respect to the Consumer 's disputes FCRA found at 15 U.S.C. 1681i. Despite XXXX 's assertion they are reporting the account correctly they are indeed not and at minimum continue to verify facially inaccurate information with XXXX, Equifax, and XXXX. While XXXX may insist " they are responsible for [ furnishing ] data [ regarding the Consumer ] but are NOT responsible for how the data is displayed [ by the CRAs ], '' they share equal culpability with the CRAs for the errors in the Consumers file for the account/tradeline because " CRA [ s ] can best fulfill [ their ] obligation to report accurately under [ 15 U.S.C. ] 1681e if [ they receiv [ e ] accurate information from a furnisher under [ 15 U.S.C. ] 1681s-2 '' ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ) ). XXXX has simply been asked to fix the errors and to cease verifying inaccurate/incomplete/misleading/false information for the Consumer. Discovers inability to fix those errors is clear indication that it lacks adequate policies and procedures for assuring maximum possible accuracy of information they furnish to the CRAs regarding the Consumer, placing XXXX in violation of 12 CFR 1022.42 ( b ) and 12 CFR Appendix E to Part 1022 at III. Violations of 12 CFR 1022.42 are considered to be willful when it is inconsistent with authoritative guidance of a Federal Agency ( Fair Credit Reporting ; Facially False Data 87 FR 64689 ( XX/XX/XXXX ) referencing XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX
