Consumer Complaint: Complaint Regarding Credit Report Inaccuracies Dear CFPB, I am writing to file a complaint regarding inaccurate information on my credit report. I have been actively disputing these inaccuracies with the credit bureaus, but they have failed to adequately investigate my claims or remove the incorrect information. In accordance with the Fair Credit Reporting Act. I attached the PDF file below containing the list of items that have violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. Credit Bureau stated everything was complete and accurate. But how is that possible if the open date, date of last activity and much more is incorrect. According to 15 USC 1681i ( 5 ), they are supposed to modify or delete accounts that aren't reporting correctly. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. I also believe that the credit bureaus have violated the Fair Credit Reporting Act ( FCRA ) by failing to : 1. Investigate my disputes in a timely and reasonable manner : The credit bureaus have not provided a clear explanation for their decision not to remove the inaccurate information, and I believe their investigation was inadequate. 2. Furnish accurate information to creditors : The inaccurate information on my credit report is harming my ability to obtain credit and other financial services. 3. Follow the FCRA 's dispute resolution procedures : The credit bureaus have failed to comply with the timeframes and procedures outlined in the FCRA. I am requesting that the CFPB investigate my complaint and take the following actions : 1. Order the credit bureaus to remove the inaccurate information from my credit report. 2. Require the credit bureaus to provide me with a copy of my updated credit report reflecting the changes. Consumer Complaint: I am writing to formally dispute the accuracy of information on my credit report, which I recently obtained. After a thorough review, I have identified several discrepancies that I believe violate the Fair Credit Reporting Act ( FCRA ) and other relevant statutes, such as the Truth in Lending Act ( TILA ) 15 U.S. Code 1666 ( b ) regarding billing errors. Under TILA 15 U.S. Code 1666 ( b ) billing error, I observed the following violations : Failure to Reflect Payments on Statements : The creditor failed to properly reflect a payment made by me, resulting in inaccurate reporting on my credit statement. Computation Errors : I identified computation errors and similar accounting errors by the creditor on my statement, leading to inaccuracies in the reported information. Furthermore, it has come to my attention that the creditor did not provide a statement 21 days prior, as required by law. As a result, any reported late payments are deemed invalid, and I request substantial evidence from the creditor to substantiate these claims. Moreover, my right to privacy, as outlined in 15 U.S.C. 1681 Section 602 ( A ), and the requirement for written consent under 15 U.S.C. 1681 Section 604 ( a ) ( 2 ) have been violated. I insist on a thorough investigation into these matters. According to the FCRA 15 U.S.C. 1681, any unproven, non-compliant, incomplete, untrue, incorrect, or unverified aspects of alleged derogatory accounts must be promptly rectified, or the accounts in question should be entirely removed. They are received per my credit report stating, " account disputed by consumer ''. They never sent documentation of their investigation proving how they determined the accounts to be accurate. PER the FCRA section 623 & Regulations V a furnisher must not furnish inaccurate information to CRA, and that the furnisher ( credit bureaus ) must investigate a consumer 's dispute that the information is inaccurate or incomplete. How is this being accomplished if documentation required by law is being honored. I requested. 1. An agreement with the creditor that authorizes you to collect on this alleged debt. 2. The agreement bearing my signature, demonstrating my agreement to assume debt. 3. Valid copies of the debt agreement, clearly stating the exact amount of the alleged debt and any interest. 4. Consumer Complaint: I have sent XXXX a letter on XX/XX/XXXX requesting that they update my records in accordance with FERPA laws as to not violate my financial privacy. Under 15 us code section 6802 obligations with respect to disclosure of personal information states, Except as otherwise provided in this subchapter, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title. To which department of education did not do and furthermore they stated in their response that I may not opt out to which is a clear violation of the law stated above as well as 15 USC 1681a2. Also, Third party sharing is a misuse of my credit report and further violation of my consumer rights. Family Educational Rights and Privacy Act ( FERPA ) The Family Educational Rights and Privacy Act ( FERPA ) is a federal law enacted in 1974 that protects the privacy of student education records. FERPA applies to any public or private elementary, secondary, or post-secondary school. 20 USC 1232g ( b ) According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. Equifax, XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information.is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. The financial institution and the Consumer reporting agencies do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option.they Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title XXXX is not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services of my transactional information.

Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated ', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. XXXX and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer reports are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. Consumer Complaint: I disputed a public record ( Collection Account ) which is not mine to Equifax, and Equifax continues to report the damaging information on my report. Equifax sent me a " Dispute Results '' pdf, stating that the information I disputed has been " verified as accurate ''. This is impossible, as the Collection account is not mine. The Collection company reporting to Equifax, XXXX XXXX XXXX, can not have any valid proof that connects me as owner of the account, as I don't have, or have ever had any contractual relationship with the utilities company claiming a defaulted account. Equifax is the ONLY reporting agency erroneously posting this negative and derogatory information about me. PLEASE HELP!!! Equifax 's dispute process is a joke. I have always had excellent credit, and what Equifax is doing is certainly not FAIR CREDIT REPORTING!!!
